REQUESTS FOR QUALIFICATIONS/PROPOSALS
Pursuant to the provisions of N.J.S.A. 19:44A-20.5, et seq., the Borough of Carteret is hereby
requesting proposals through a fair and open process for the award of contracts for the following
“Professional Services” for the 2026 calendar year. In submitting your response to any
applicable RFQ hereby requested, please also be advised that your response must also be
available for utilization by any Borough Agency, Board, Commission or affiliated non-profit
corporation:

You are hereby requested to submit a proposal to provide the respective professional services
which provides the Mayor and Council with information to evaluate your firm with regard to the
following factors:
A) Experience and reputation in the field.
B) Knowledge of the subject matter.
C) Availability to attend all required meetings.
D) Availability of personnel, facilities, equipment and other resources to provide such
services.
E) Qualifications and experience of personnel and organization including a list and status of
major projects.
F) Any other factors your firm wishes the Mayor and Council to consider in evaluating the
firm’s ability to perform the respective professional services requested by the Borough.
When submitting your response to this Request for Qualifications/Proposals (RFQ/P), please
identify which positions you wish to be considered for. Please submit two (2) original copies
and one (1) digital copy on flash drive or CD.
Pursuant to N.J.S.A. 40A:11-23c, addenda may be issued for proposals.
It is the sole responsibility of the person submitting the bid to be knowledgeable of all addenda
related to this procurement. If bidders obtain a Bid/RFP/RFQ from the website, it is the
responsibility of the person submitting the bid to check prior to the bid opening to see if
addenda have been issued. Copies of addenda or notice of the same will be made available on
the Borough website - www.carteret.net

Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C.
17:27-1 et seq., Affirmative Action requirements, N.J.S.A. 19:44A-20.4 et seq., P.L. 2004,
Chapter 19 (as amended by P.L. 2005, c.51
Please be advised that all proposals shall be evaluated by the Borough Council on the basis of
that which is the most advantageous to the Borough, taking into consideration the above factors.
Please be further advised that the Borough reserves the right to reject all of the proposals
submitted. The Borough Council reserves the right to reject any or all proposals in whole or in
part and to waive such informalities as may be permitted by law.

C. 271 POLITICAL CONTRIBUTION DISCLOSURE FORM
Contractor Instructions
Business entities (contractors) receiving contracts from a public agency that are NOT awarded pursuant to
a “fair and open” process (defined at N.J.S.A. 19:44A-20.7) are subject to the provisions of N.J.S.A.
19:44A-20.26. This law provides that 10 days prior to the award of such a contract, the contractor shall
disclose contributions to:
any continuing political committee (a.k.a., political action committee)
any candidate committee of a candidate for, or holder of, an elective office:
o of the public entity awarding the contract
o of that county in which that public entity is located
o of another public entity within that county
o or of a legislative district in which that public entity is located or, when the
public entity is a county, of any legislative district which includes all or part
of the county
The disclosure must list reportable contributions to any of the committees that exceed $200 per election
cycle that were made during the 12 months prior to award of the contract. See N.J.S.A. 19:44A-8 and
19:44A-16 for more details on reportable contributions.
N.J.S.A. 19:44A-20.26 itemizes the parties from whom contributions must be disclosed when a business
entity is not a natural person. This includes the following:
individuals with an “interest” ownership or control of more than 10% of the profits or assets
of a business entity or 10% of the stock in the case of a business entity that is a corporation
for profit
all principals, partners, officers, or directors of the business entity or their spouses
any subsidiaries directly or indirectly controlled by the business entity
IRS Code Section 527 New Jersey based organizations, directly or indirectly controlled by
the business entity and filing as continuing political committees, (PACs).
When the business entity is a natural person, “a contribution by that person’s spouse or child, residing
therewith, shall be deemed to be a contribution by the business entity.” [N.J.S.A. 19:44A-20.26(b)] The
contributor must be listed on the disclosure.
Any business entity that fails to comply with the disclosure provisions shall be subject to a fine imposed
by ELEC in an amount to be determined by the Commission which may be based upon the amount that
the business entity failed to report.
The enclosed list of agencies is provided to assist the contractor in identifying those public agencies whose
elected official and/or candidate campaign committees are affected by the disclosure requirement. It is the
contractor’s responsibility to identify the specific committees to which contributions may have been made
and need to be disclosed. The disclosed information may exceed the minimum requirement.
The enclosed form, a content-consistent facsimile, or an electronic data file containing the required details
(along with a signed cover sheet) may be used as the contractor’s submission and is disclosable to the
public under the Open Public Records Act.
The contractor must also complete the attached Ownership Disclosure Certification. This will assist the
agency in meeting its obligations under the law. NOTE: This section does not apply to Board of
Education contracts.

NOTICE IS HEREBY GIVEN that sealed bids for the Accessible Entrance and Rehabilitation at Blazing Star
Cultural Center will be received, by the Borough of Carteret, opened and read aloud at Borough Hall
Council Chambers located at 61 Cooke Avenue, Carteret, Middlesex County, New Jersey on Thursday,
March 12, 2026, until 11:00 A.M.
Sealed bids will be received for the following contract(s): Overall Single Prime (General Construction, all of
the work, Lump Sum, All Trades, All Inclusive).
**(If you send a sealed bid packet via FEDEX or UPS make sure the contents inside the FEDEX or UPS
envelope is also sealed and must be received on or by March 12,2026 at 11:00A.M.)**
Bids must be furnished on the proposal sheets included in the Contract Documents, enclosed in a sealed
envelope, marked “SEALED BID – Accessible Entrance and Rehabilitation at Blazing Star Cultural
Center”, addressed to Mr. Ricardo Llanos, Purchasing Agent, 61 Cooke Avenue, Office of the Mayor,
Carteret, New Jersey, 07008, marked with the name and address of the Bidder, the Project Title,
and Architects Project Number. Five (5) copies of the completed Bid package shall be provided: one

No Bids will be received after public call. The bids must be accompanied by those documents and
materials described in the Proposal Checklist provided in the Project Manual. The Borough and the
Architect assume no responsibility for bids mis-mailed or misdirected.
Bidding Documents may be examined and obtained during normal business hours by contacting the office
of USA Architects, Planners and Interior Designers Ltd., 20 North Doughty Avenue, Somerville, NJ 08876, T:
610-217-6577, attention Mr. Anthony Civitella, until 48 hours prior to the time set for the opening of Bids.
Bidders shall contact USA Architects, Planners and Interior Designers, Ltd. to receive an electronic
download of the Plans, Specifications and Proposal Sheets at no cost to the bidder.
A Pre-Bid Conference, for the purpose of reviewing the project scope and any possible clarifications on
the intent of the contract documents, will be held on THURSDAY FEBRUARY 19, 2026 AT 9:00 A.M. at the
site; 63 Carteret Avenue, Carteret, NJ. While attendance is not mandatory, this will be the only
opportunity to meet with the Architect, Engineer and other representatives prior to the bid opening.
Therefore, it is strongly recommended that all potential bidders be in attendance.
The Architect may send a written memorandum to all bidders indicating any addenda and / or clarification
items, if required.
Upon receipt and opening of the bids, the Borough reserves the right to hold the bids for up to a period
of sixty (60) days thereafter before making an award. The Borough reserves the right to reject any or all

bids or to waive or permit the cure of any minor deficiency or irregularity in accordance with New Jersey
law.
Submission of Bonds
All bids must be accompanied by a bid guaranty in the form of either a certified check, cashier's check or
bid bond drawn to the order of the Borough for not less than ten (10%) percent of the amount of the bid,
but not in excess of Twenty Thousand ($20,000) Dollars
The Bidder must also furnish at the time the bid is submitted a Consent of Surety supported by a power of
attorney and financial statement evidencing that a performance bond containing material and payment
guarantees in the full amount of the Contract price shall be provided at the expense of the Bidder to the
Borough at the time designated by the Borough for the execution of the contract.
Pursuant to N.J.S.A. 40A: 11-22, the successful contractor shall furnish the Borough with a 100% (of the
contract amount) Performance Bond and 100% (of the contract amount) Labor and Material Payment,
and Completion Bond issued by the Contractor’s insurance carrier / surety, for the purpose of
guaranteeing the faithful fulfillment of the Agreement. This bond shall meet the requirements of N.J.S.A.
2A: 44-143 through 147, entitled “Bonds of Contractors on Public Works and Improvements.”
Compliance With Law
The successful contractor shall comply with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and
all applicable regulations in meeting its obligations under the Bid Documents.
In accordance with the Local Public Contracts Law, as specifically described in N.J.S.A. 40A: 11-16
governing the submission of bids for construction contracts, the law requires that, for single prime
contracting bids, bidders that propose using more than one (1) subcontractor for any of the specialized
“sub-prime” contractors set forth in this statute, must submit a Certificate with their bids listing each
subcontractor named in the bid for that category.
The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage
Act, N.J.S.A. 34:11-56.25 et seq. The contract shall be required to comply with Davis Bacon and Related
Acts with respect to minimum wage rates.
Pursuant to the Public Works Contractor Registration Act, N.J.S.A. 34:11-56.48 et seq., Bidders shall
provide their Public Works Contractor Registration prior to award of the contract. Likewise, all
Subcontractors required to be listed shall provide a Public Works Contractor Registration prior to award
of the contract. Further, in accordance with N.J.S.A. 52:32 44(b), a Bidder and its named Subcontractors
must have a valid Business Registration Certificate issued by the Department of Treasury, Division of
Revenue and Enterprise Servies prior to award of contract. Submit to the Borough the certificates of
registration for all subcontractors listed in the bid proposal. Applications for registration shall not be
accepted as a substitute for the certificate of registration.
All Bidders are expected to comply with all provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1
et seq.) and all regulations promulgated in connection therewith by the Division of Local Government

Build America Buy America Act (BABA)
Pursuant to the Build America, Buy America Act (BABA), enacted as part of the Infrastructure Investment
and Jobs Act (IIJA). Pub. L. 117-58, 41 U.S.A. § 8301 note, the Federal Financial Assistance used to fund
this infrastructure project is required to apply a domestic content procurement preference (the “Buy
American Preference” of “BAP”) for all construction, alteration, maintenance, or repair of infrastructure,
including building and real property, unless application of the BAP has been waived by HUD. Additional
details on fulfilling the BABA requirements can be found at

As a result of the partial Federal funding involved with the project, bidders and their subcontractors must
also be able to provide a Unique Entity ID (“UEI) from SAM.gov (the System of Award Management) and
must maintain an active SAM registration through final completion of the project. Please consult
