A. PROJECT BACKGROUND:
The Township of East Brunswick (“Township”) wishes to use coach bus services for day trips as part of
the Summer Day Camp Program outlined in this specification for a period of two (2) years, 2020 and 2021.
The contract may be renewed for up to two, one year extensions upon mutual agreement of the Township
and Provider.
This contract includes coach bus services for Summer 2020 and 2021 for approximately 12 trips all
originating from camp locations (schools) in East Brunswick. Departure locations for each trip will be
provided at a later date. On page 10, the Provider should submit a breakdown which should include price
per bus and price per trip. Provider is also required to return a completed Quotation Form on page 11 and
other forms found on pages 12 - 18. The Township of East Brunswick reserves the right to
increase/decrease this schedule as necessary.
Quotes must be received by the Township’s Designated Contact Person, via mail or hand delivery,
by 11:00 A.M. prevailing time on February 20, 2020. Quotes received after 11:00 A.M. on the Due
Date will be returned unopened.

It is the Providers obligation to examine and familiarize themselves with all the requirements of this Request
for Quotation prior to submitting a proposal. Providers may contact the Director of Recreation & Parks at
732-390-6797, weekdays between the hours of 8:30am and 4:30pm with questions.
B. SCOPE OF WORK:
The Township is issuing this request for quotation via a fair and open process in accordance with N.J.S.A
19:44A-20.4 et seq.
1. GENERAL / INSTRUCTIONS
Each Provider shall carefully examine the ‘sample’ bus schedules before submitting his quote.
For the purpose of this contract, the entire ‘sample’ bus schedule (as attached) must be acted
upon in total. Tentative dates for the Township’s Summer Day Camp program and in regards
to this contact are: June 29, 2020 to August 21, 2020 and June 28, 2021 to August 20, 2021.
Total Quote Price will be the overall cost of each trip price and/or the unit price of each trip
outlined in the schedule.

2. REGULATIONS
a. All buses to be used MUST be certified by the Interstate Commerce Commission and
MUST display the ICC Charter Authority number issued. All motor carriers must have an
IFTA (International Fuel Tax Agreement) License and decal displayed on each vehicle
used on trips outside the state of New Jersey.
b. Intrastate: All buses MUST be certified by the NJ Department of Transportation Charter
Authority and MUST display the Authority number issued.
c. All trips must fully comply with all sections of U.S. DOT Federal Highway Administration
383, 390-399 as applying to bus companies and Federal Motor Carrier Safety Regulation.
d. All bus drivers must possess a valid New Jersey bus operator’s license (and when issued,
a federal operator’s license) and an ICC medical certificate. All “P” endorsement drivers
must be subject to any applicable State and Federal regulations pertaining to drug and
alcohol tests and/or background investigations that includes fingerprinting and the Drug &
Alcohol Clearinghouse Law.
e. All buses must possess other state permits as necessary and comply with the State of New
Jersey Motor Vehicle Commission requirements. All bidders shall comply with the current
applicable NJ statues and regulations pertaining to transportation as they now exist or may
become effective during the term of the contract.
f. The Provider shall have a qualified person in their office or reachable by mobile phone to
receive phone calls and answer questions from the Department of Recreation at least one-
half hour before the scheduled departure of the trip and one-half hour after the completion
of the trip, and during the hours in which the campers are being transported in case of
emergencies. The Township MUST be provided with an emergency office/cell phone
number for after hours.
g. Provider’s facilities shall be open for safety inspection and driver’s abstracts must be made
available for possible inspection. Township reserves the right to reject a driver if it finds
driver’s abstracts unacceptable. The Township shall have the right to determine whether
any particular driver employed by the said carrier is a satisfactory employee. If the
Township finds any person to be unsatisfactory it may require the said carrier to
remove such persons from service related to this contract.
3.
AWARDING OF CONTRACT
a. Contract will be awarded on basis of the overall cost of each trip and/or unit price of each
trip outlined in the schedule. Tentative dates for the Summer Day Camp Program in regards
to this contact are: June 29, 2020 to August 21, 2020 and June 28, 2021 to August 20,
2021.
b. Changes to schedule may be made at the discretion of the Township with appropriate
notification. If awarded company cannot accommodate the change of schedule, then the
Township reserves the right to use the services of the company of the next successful
vendor.
c. Trip rate commences at required time of arrival at specific site. Total hours are to be
defined as time of departure from designated site to time of arrival back at designated site;

as indicated on bus schedule. Buses are required to be at specified site 15 minutes prior
to required time of departure.
d. Total price for each trip is to include all costs. All prices should include all taxes, parking
fees and tolls and any travel time for the driver. Bus carriers are responsible for all tolls
and parking fees.
e. There shall be no charge for non-customer initiated overtime due to breakdowns, traffic,
etc. Any overtime costs must be so stipulated.
4.
COMPUTATION OF COST OF TRIPS NOT DEFINED ON ATTACHED
SCHEDULE
The total cost of any not shown on the attached schedule shall be furnished within 24 hours
of a request by the Township. Said cost shall be based on:
a. Total hours for trip. Total hours are to be defined as time of departure from designated
site to time of arrival back at designated site as indicated on schedule.
b. Prices should include tolls, parking fees and applicable taxes
c. There shall be no charge for non-customer initiated overtime due to breakdowns,
traffic, etc.
d. Any overtime costs must be so stipulated.
5.
SCHEDULING AND ROUTING OF TRIPS
a. Trips shall be scheduled by the Township of East Brunswick Department of Recreation
& Parks as required. The carrier shall be given as much advance notice as possible in
scheduling said trips. All trips originate from Public Schools within the Township of
East Brunswick. No deposits shall be required.
b. The carrier shall be responsible for insuring that drivers are familiar with the best and
most efficient routes to trip destinations and departures. Maps and directions shall be
provided, by said carrier, on all trips.
c. Buses must be at point of departure a minimum of fifteen (15) minutes before
scheduled trip. Bus schedule has built in adequate travel time to reach destination in
time for event or reservation.
d. Buses are to remain in the general vicinity of the group/site on long distance, outdoor
trips in the case of inclement weather, emergency or should the group need to leave
early.
e. In the case of a bus breakdown, the said carrier shall send an additional bus immediately
to replace the impaired bus.
f. In the case when more than one coach bus is assigned to a trip; the buses shall travel in
convoy fashion, taking the same route to and from the public school and trip
destination.
g. Carrier will ensure that every bus driver will immediately inform the Recreation
Coordinator or Director of Recreation following an accident, which involves injury,

death, or property damage. The driver must complete and file a motor vehicle accident
report in accordance with N.J.S.A. 39-4:130.
h. In the case of an emergency situation, the chosen bus carrier shall provide emergency
busing to the Township’s programs where applicable and based upon availability of
buses.
i. Carrier must supply written confirmation for all scheduled trips.
j. Carrier must have available up to, and including, seven (7) buses on any given day. No
subcontracting of buses shall be permitted under any condition.
6.
CANCELLATION
a. No fee shall be charged for cancellation on the day of a trip if the Township cancels
because of weather-related reasons.
b. No cancellation fee shall be assessed if buses have not departed from garage.
c. If event management (baseball games, tennis matches, etc.) cancel events - notification
of cancellation may be given up to one hour before departure time.
7.
CANCELLATION OF CONTRACT
a. Failure to abide by any of the aforementioned requirements shall be ground for
cancellation of this contract by the Township.
b. Bus company must be given one written notice before contract can be canceled. Any
notices given to the bus company shall be made a permanent part of their file.
C. QUALIFICATIONS:
1. BUS REQUIREMENTS
a. All buses shall not be more than 10 years old.
b. Buses must have minimum capacity of 55 passengers with seat belts.
c. Buses must have operating two-way radio capable of placing the driver in communication
with the base and any other buses that might be part of the trip.
d. Buses must have operating public address system with working speakers throughout the
bus.
e. All buses must have a working restroom.
f. All buses shall include a working dvd player to display movies.
g. Buses must be mechanically sound, clean and in good condition.
h. Buses must come equipped with an automatic step, a step stool, or a kneeling bus.
i. Drivers must not transport individuals or other passengers than those who are part of the
scheduled program staff or participants.
j. Bus Drivers are not to smoke in the bus or on School Grounds
k. Buses are to be air-conditioned due to the extreme heat in the summer
l. Buses must travel in convoy fashion and may not separate from the other buses during a
trip
m. Company must provide driver with uniform and ID Card or Badge
n. For routes that require travel on toll roads, all buses shall be equipped with EZ-Pass.

D. FAIR AND OPEN CRITERIA:
STANDARDIZED SUBMISSION REQUIREMENTS & SELECTION CRITERIA
1. The solicitation of qualifications for any contract to be determined in excess of $17,500, and for
which a bid solicitation shall not be required under the Local Public Contracts Law shall be
advertised by the Township on the Township website at least ten (10) days prior to the date set for
the receipt of said quote. The published notice shall set forth a description of the requested goods
or services, the time, date and place that proposals must be submitted, the contact information for
obtaining a proposal document, and a statement that the proposals are being solicited through the
fair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq.
2. The Township shall review the responses to the request for quotes and appoint or award a
contract to a business entity for the goods or services advertised subsequent to such review.
Contracts awarded under this process shall be publicly announced and awarded. The resolution
awarding the contract shall state that the contract was awarded after a fair and open process and
shall state the number of responses received.
3. Contracts subject to the fair and open process delineated herein are subject to additional
Requirements and any other applicable laws including, but not limited to, the Local Public
Contracts Law.
E. SELECTION CRITERIA:
Quotations will be evaluated by the on the basis of the most advantageous, price and other factors
considered. The evaluation will consider:
a. Experience and reputation in the field;
b. Knowledge of the Township of East Brunswick and the subject matter to be addressed under the
contract;
c. Availability to accommodate any required meetings of the Township;
d. Compensation proposal;
e. Other factors if demonstrated to be in the best interest of the Township of East Brunswick;
f. Safety record and customer service to previous contracts.
F.
INSURANCE REQUIREMENTS:
1. Indemnification
The contractor agrees to indemnify and save harmless the Township, its officers, agents and employees,
hereinafter referred to as indemnitees, from all suits, including attorney’s fees and costs of litigation,
actions, loss damage, expense, cost of claims, of any character or on account of any act, claim or amount
arising or recovered under Worker’s Compensation law, or arising out of failure of the Contractor or
those acting under Contractor to conform to any statutes, ordinances, regulations, law or court decree.

It is the intent of the parties to this contract that the indemnities shall, in all instances, except for loss
or damage resulting from the sole negligence of the indemnitee, be indemnified against all liability,
loss or damage of any nature whatsoever.
2. Insurance Requirements:
A. Worker’s Compensation and Employer’s Liability Insurance
This insurance shall be maintained in full force during the life of this contract by the contractor covering
all employees engaged in performance of this contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C.
12:235-1.6. Minimum Employer’s Liability $1,000,000.00.
B. General Liability Insurance
This insurance shall have limits of not less than $3,000,000.00 any one person and $3,000,000.00 any
one accident for bodily injury and $3,000,000.00 aggregate for property damage, and shall be
maintained in force during the life of the contract.
C. Automobile Liability Insurance
This insurance covering contractor for claims arising from owned, hired and non-owned vehicles with
limits of not less than $3,000,000.00 any one person and $3,000,000.00 any one accident for bodily
injury and $3,000,000.00 each accident for property damage, shall be maintained in force during the
life of this contract by the contractor.
D. Professional Liability/Malpractice Insurance Policy (if applicable)
Coverage in the amount of $2,000,000.00/occurrence, $4,000,000.00 aggregate and assurance that each
such policy for each staff member remains full and in effect while providing services for Township.
The contractor shall provide the Township with a Certificate of Insurance naming the Township of East
Brunswick as additionally insured, evidencing the existence of required insurance prior to the
commission of work. Said insurance must include coverage for complete operations, contractual
insurance and independent contractor or subcontractor insurance, where and if applicable.
E. Errors and Omissions Insurance
a. The contractor shall purchase and maintain during the entire period of this contract, errors and
omissions insurance that shall protect the contractor and the Township from any and all claims
that may arise out of or result from the contractor’s performance of this contract. Specifically,
the errors and omissions insurance shall have limits of not less than $2,000,000.00 dollars per
occurrence and $4,000,000.00 dollars in the aggregate.
b. Certificates of the Required Insurance
Certificates as listed above shall be submitted along with the contract as evidence covering
Errors and Omissions insurance. Such coverage shall be with acceptable insurance companies
operating on an admitted basis in the State of New Jersey.
The contractor shall provide the Township with a Certificate of Insurance naming the
Township, its employees, officers, and agents as additionally insured, and evidencing the
existence of required insurance prior to the commission of work.

The Township will not accept Mutual Limitation of Liability terms.
G. OTHER REQUIREMENTS:
1. Proof of N.J. Business Registration Certificate N.J.S.A. 52:32-44
Pursuant to N.J.S.A. 52:32-44, the Township is prohibited from entering into a contract with an entity unless
the bidder/respondent/contractor, and each subcontractor that is required by law to be named in a
bid/proposal/contract has a valid Business Registration Certificate on file with the Division of Revenue and
Enterprise Services within the Department of the Treasury.
Prior to contract award or authorization, the contractor shall provide the Contracting Agency with its proof
of business registration and that of any named subcontractor(s).
Subcontractors named in a bid or proposal shall provide proof of business registration to the bidder, who in
turn, shall provide it to the Contracting Agency prior to the time of contract, purchase order, or other
contracting document is awarded or authorized.
During the course of contract performance:
(1) The contractor shall not enter into a contract with a subcontractor unless the subcontractor first
provides the contractor with a valid proof of business registration.
(2) The contractor shall maintain and submit to the Contracting Agency a list of subcontractors and
their addresses that may be updated from time to time.
(3) The contractor and any subcontractor providing goods or performing services under the
contract, and each of their affiliates, shall collect and remit to the Director of the Division of
Taxation in the
Department of Treasury, the use tax due pursuant to the Sales and Use Tax Act, (N.J.S.A. 54:32B-
1 et seq.) on all sales of tangible personal property delivered in the State. Any questions in this

Before final payment is made under the contract, the contractor shall submit to the Contracting Agency a
complete and accurate list of all subcontractors used and their addresses. Pursuant to N.J.S.A. 54:49-4.1, a
business organization that fails to provide a copy of a business registration as required, or that provides
false business registration information, shall be liable for a penalty of $25.00 for each day of violation, not
to exceed $50,000, for each proof of business registration not properly provided under a contract with a
contracting agency.
2. Form W-9
Successful contractor shall complete W-9 Form and submit to the Municipal Clerk prior to contract award.

3. Certification Of Political Contributions - Pay to Play – Notice of Disclosure Requirement
Township Ordinance No. 06-13 Establishing Restrictions on the Award of Contracts to Professional Entities
and Certain Other Entities Who Make Certain Political Contributions, and pursuant to Section 3 (a) thereof,

requires that Respondents confirm that they have not made any contributions in violation of Section 1 of
Ordinance No. 06-13.
Business entities are advised of their responsibility to file an annual disclosure statement of political
contributions with the New Jersey Election Law Enforcement Commission (ELEC) pursuant to N.J.S.A.
19:44A-20.27 if they receive contracts in excess of $50,000 from public entities in a calendar year.
Business entities are responsible for determining if filing is necessary. Additional information on this

H. PAYMENTS
The Contractor shall invoice the Department of the Township after each trip and payment will be
processed in a timely manner.

AMERICANS WITH DISABLITIES ACT OF 1990
EQUAL OPPORTUNITY FOR INDIVIDUALS WITH DISABLITY
The RESPONDENT and the TOWNSHIP OF EAST BRUNSWICK (herein referred to as the
TOWNSHIP) do hereby agree that the provisions of Title 11 of the Americans With Disabilities Act of
1990 (the “Act”) (42 U.S.C. S12101 et seq.), which prohibits discrimination on the basis of disability by
public entities in all services, programs and activities provided or made available by public entities, and the
rules and regulation promulgated pursuant thereunto, are made a part of this contract. In providing any aid,
benefit, or service on behalf of the TOWNSHIP pursuant to this contract, the RESPONDENT agrees that
the performance shall be in strict compliance with the Act. In the event the RESPONDENT, its agents,
servants, employees, or subcontractors violate or are alleged to have violated the Act during the
performance of this contract, the RESPONDENT shall defend the TOWNSHIP in any action or
administrative proceeding commenced pursuant to this Act. The RESPONDENT shall indemnify, protect,
and save harmless the TOWNSHIP, its agents, servants, and employees from and against any and all suits,
claims, losses, demands, or damages of whatever kind or nature arising out of the alleged violation. The
RESPONDENT shall, at its own expense, appear, defend, and pay any and, all charges for legal services
and any and all costs and other expenses arising from such action or administrative proceeding or incurred
in connection therewith. In any and all complaints brought pursuant to the TOWNSHIP’S grievance
procedure, the RESPONDENT agrees to abide by any decision of the TOWNSHIP, which is rendered
pursuant to, said grievance procedure. If any action or administrative proceeding result in an award of
damages against the TOWNSHIP or if the TOWNSHIP incurs any expense to cure a violation of the ADA
which has been brought pursuant to its grievance procedure the RESPONDENT shall satisfy an discharge
the same at its own expense.
The TOWNSHIP shall, as soon as practicable after a claim has been made against it, give written
notice thereof to the RESPONDENT along with full and complete particulars of the claim. If any action or
administrative proceeding is brought against the TOWNSHIP or any of its agents, servants, and employees,
the TOWNSHIP shall expeditiously forward or have forwarded to the RESPONDENT every demand,
complaint, notice, summons, pleading, or other process received by the TOWNSHIP or its representatives.
It is expressly agreed and understood that any approval by the TOWNSHIP of the services provided
by the RESPONDENT pursuant to this contract will not relieve the RESPONDENT of the obligation to
comply with the Act and to defend, indemnify, protect, and save harmless the TOWNSHIP pursuant to this
paragraph.
It is further agreed and understood that the TOWNSHIP assumes no obligation to indemnify or
save harmless the RESPONDENT, its agents, servants, employees and subcontractors for any claim which
may arise out of their performance of this Agreement. Furthermore, the RESPONDENT expressly
understands and agrees that the provisions of this indemnification clause shall in no way limit the
RESPONDENT’S obligations assumed in this Agreement, nor shall they be construed to relieve the
RESPONDENT from any liability, nor preclude the TOWNSHIP from taking any other actions available
to it under any other provisions of this Agreement or otherwise at law.
