A. PROJECT BACKGROUND:
The Township of East Brunswick (“Township”) wishes to provide Inflatable Rides - Type 4 Air Supported
Structures (“Inflatable Rides”) in conjunction with the Township’s Independence Day and East Brunswick
Day Celebrations. The Independence Day Celebration shall occur on July 4, 2020 with a rain date of July
5, 2020 and East Brunswick Day shall occur on October 4, 2020 with a rain date of October 11, 2020.
This contract shall include the Contractor providing “Inflatable Rides” and qualified personnel to transport,
set up, supervise, and remove rides, provide appropriate safety equipment, provide proof of all required
insurances and state and federal licenses.
Proposals should include quantity, description, and item total per “Inflatable Ride”. Total amount of the
proposal shall be entered on page 11. The Township reserves the right to select all or any number of items
necessary. The successful vendor shall be awarded a contract for 2020 with the option to extend contract to
2021 and 2022 based upon mutual agreement between the Township and vendor.
Quotes must be received by the Township’s Designated Contact Person, via mail or hand delivery, by 10:00
a.m. prevailing time on February 20, 2020. Quotes received after 10:00 a.m. on the Due Date will be
returned unopened.

It is the Contractor’s obligation to examine and familiarize themselves with all the requirements of this
Request for Quotation prior to submitting a proposal. Contractor may contact the Director of Recreation,
Parks and Community Services at 732-390-6797, weekdays between the hours of 8:30 a.m. and 4:30 p.m.,
with questions regarding this request.
B. SCOPE OF WORK:
The Township is issuing this request for quotation via a fair and open process in accordance with N.J.S.A
19:44A-20.4 et seq.
1. Payment to Other Parties. The Contractor shall not obligate the Township to make any payments
to another party, not make any promises or representations to another party for, or in behalf of, the
Township without prior written approval of the Director of Recreation, Parks and Community
Services or his authorized representative.
2. Provision of Labor, Tools and Equipment. The Contractor agrees to furnish and pay all necessary
expenses for all labor, tools and equipment in connection with the providing of “Inflatable Rides”
pursuant to this contract.

4. Description of Work.
a. Contractor shall provide “Inflatable Rides” that are certified by the State of NJ and
approved by the Fire Marshall of East Brunswick.
b. Contractor shall deliver “Inflatable Rides” and required supplies and equipment to location
of each event (Community Arts Center, 721 Cranbury Road, East Brunswick).
c. Contractor shall erect “Inflatable Rides” in a safe manner approved by Fire Marshall at
least 30 minutes prior to beginning of each event.
d. Contractor shall staff each “Inflatable Ride” with at least one qualified employee per ride.
e. Each ride operator must have experience at operating the ride they are assigned to and if
they are inexperienced and “in training” they must have an experienced operator with them.
f. Ride operator must wear clothing/uniform that indicates they are a Ride Operator and
clothing must be in good, clean condition.
g. Ride operator must demonstrate professionalism in dealing with public guests and
Township employees. Contractor will replace any person in his/her employ that is
incompetent, abusive or disorderly.
h. “Crew Leader” must be available at all times during events and must be fluent in English.
i.
Contractor Staff must remain with Rides and Equipment through entire event until packed
onto transportation vehicles. No ride shall be left unattended to ensure safety of public.
j.
Township shall provide electricity for use by Contractor to use for Inflatables.
5. Specificity of Rides.
a. July 4, 2020. Provide 9 – 12 Rides that encompass all ages/sizes from toddlers to teens.
Include, but not limited to, “Slides”, “Obstacle Courses” and “Kiddie Play Centers” of
various sizes. Water Rides, Mechanical Rides, and “Bounce Houses” are not permitted at
this event and should not be included.
b. October 4, 2020. Provide 5 – 8 Rides that encompass all ages/sizes from toddlers to teens.
Include, but not limited to, “Slides”, “Obstacle Courses” and “Kiddie Play Centers” of
various sizes. Water Rides, Mechanical Rides, and “Bounce Houses” are not permitted at
this event and should not be included.
6. Schedule of Event.
a. July 4, 2020. Should the Fire Marshall, Director of Recreation, Parks and Community
Services or Contractor deem the weather unfit for a safe event on July 4, 2020 the
Contractor will honor contract show on July 5, 2020. Should July 5, 2020 also be deemed
unfit for a safe event by the Fire Marshall, Director of Recreation, Parks and Community
Services or Contractor, the Contractor agrees to perform the contracted event at a mutually
agreed upon date in 2020 with a minimum of 14 days’ notice between the Township and
Contractor.
b. October 4, 2020. Should the Fire Marshall, Director of Recreation, Parks and Community
Services or Contractor deem the weather unfit for a safe event on October 4, 2020 the
Contractor will honor contract show on October 11, 2020. Should October 11, 2020 also
be deemed unfit for a safe event by the Fire Marshall, Director of Recreation, Parks and
Community Services or Contractor, the Contractor agrees to perform the contracted event
at a mutually agreed upon date prior to June 15, 2021 with a minimum of 14 days’ notice
between the Township and Contractor.
7. Time of Event.
a. July 4, 2020. Inflatable Rides: 4:00pm – 9:00pm. Contractor must have rides set up and
inspected by Fire Marshall by 3:30pm. In the event the Contractor is not ready for
inspection by 3:30pm, a 5% penalty will be assessed for every 10 minutes in delay to the
start of the inspection.
b. October 4, 2020. Inflatable Rides: 12:00pm – 5:00pm. Contractor must have rides set up
and inspected by Fire Marshall by 11:30am. In the event the Contractor is not ready for

inspection by 11:30am, a 5% penalty will be assessed for every 10 minutes in delay to the
start of the inspection.
8. Weather Cancellation/Postponement.
a. July 4, 2020: Township shall make a decision by 12:00pm on July 4, 2020 to hold or
postpone event until July 5, 2020 with no penalty. Should the Township decide after
12:00pm to postpone the event from July 4, 2020, a 5% rescheduling fee shall be made to
Contractor.
b. October 4, 2020: Township shall make a decision by 9:00am on October 4, 2020 to hold
or postpone the event until October 11, 2020 with no penalty. Should the Township decide
after 9:00am to postpone the event from October 4, 2020, a 5% rescheduling fee shall be
made to Contractor.
9. Equipment and Supplies. Contractor is responsible for providing, maintaining and transporting all
equipment and supplies in connection with rides in a safe manner in compliance with all Local,
State, and Federal rules and regulations.
10. Personnel. Contractor shall provide qualified employees to perform work required in honoring this
contract. All Contractor employees shall dress in clothing that clearly states they are employees of
Contractor. Smoking, vaping, and consumption of alcohol are not permitted on Township property
– Contractor will ensure that all employees will refrain from these activities while on Township
property and any violator may be removed from facility and face legal charges deemed appropriate
by local law enforcement. Contractor must supply at least one employee who is fluent in English
and has the ability to communicate with other members of Contractor’s crew.
11. Supervision. Township Director of Recreation, Parks and Community Services shall have final
decision-making responsibility and shall oversee all activities related to event and ride. Director
of Recreation, Parks and Community Services shall consult with Contractor, Fire Marshall, and
Director of Emergency Services throughout the day of event to maintain and evaluate a safe setting
for event and rides. Fire Marshall will inspect all rides after initial setup and shall have authority
to close rides not to his satisfaction or up to code or certification.
12. Accident and Hazard Prevention. Contractor shall exercise precaution at all times and adhere to all
Federal, State, and Local rules and regulations concerning “Inflatable Rides” to maintain a safe
environment for all employees and celebration guests. Contractor is responsible to pay for any
damage to public property that result from “Inflatable Rides”. Contractor will safely remove all
Rides, Supplies, and Equipment from facility upon the completion of the event.
13. Termination of Contract. The Township has cause to terminate contract if Contractor fails to
perform its obligations under the terms of the contract in a timely and proper manner.
14. Payment for Services. Contractor shall submit an invoice and will be paid in the following manner:
a. Upon satisfactory performance of services, the Contractor shall be paid in full following
the complete execution of services required.
b. Invoice must include all fees for supplies, equipment and personnel and be net of any and
all discounts and penalties assigned or incurred by Township.
c. Invoice must be submitted to Director of Recreation, Parks and Community Services and
shall be paid within 30 days of completion of event and accurate submittal of paperwork,
whichever is later.
C. QUALIFICATIONS:
1. Contractor shall meet all Federal, State, and Local certifications and requirements to provide
equipment and personnel for “Inflatable Rides - Type 4 Air Supported Structures”. All
requirements of the Joint Insurance Fund shall be adhered to as required, including, but not limited
to, a Hold Harmless Agreement and proof of insurance.

2. Contractor shall have a minimum of five (5) years of experience in the “Inflatable Rides - Type 4
Air Supported Structures” field and provide documentation indicating this experience.
3. Contractor must have a 100% accident-free history in “Inflatable Rides - Type 4 Air Supported
Structures” during the past five (5) years and provide documentation indicating this safety record.
4. Contractor must have a 100% performance rating in honoring contracts for events during the past
five (5) years and shall provide documentation indicating the successful completion of all events
during this time period.
5. Contractor shall provide references of past events within the past two (2) years.
D. FAIR AND OPEN CRITERIA:
STANDARDIZED SUBMISSION REQUIREMENTS & SELECTION CRITERIA
1. The solicitation of qualifications for any contract to be determined in excess of $17,500, and for
which a bid solicitation shall not be required under the Local Public Contracts Law shall be
advertised by the Township on the Township website at least ten (10) days prior to the date set for
the receipt of said quote. The published notice shall set forth a description of the requested goods
or services, the time, date and place that proposals must be submitted, the contact information for
obtaining a proposal document, and a statement that the proposals are being solicited through the
fair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq.
2. The Township shall review the responses to the request for quotes and appoint or award a contract
to a business entity for the goods or services advertised subsequent to such review. Contracts
awarded under this process shall be publicly announced and awarded. The resolution awarding the
contract shall state that the contract was awarded after a fair and open process and shall state the
number of responses received.
3. Contracts subject to the fair and open process delineated herein are subject to additional
Requirements and any other applicable laws including, but not limited to, the Local Public
Contracts Law.
E. SELECTION CRITERIA:
Quotations will be evaluated by the on the basis of the most advantageous, price and other factors
considered. The evaluation will consider:
a. Experience and reputation in the field;
b. Knowledge of the Township of East Brunswick and the subject matter to be addressed under the
contract;
c. Availability to accommodate any required meetings of the Township;
d. Compensation proposal;
e. Other factors if demonstrated to be in the best interest of the Township of East Brunswick.

F.
INSURANCE REQUIREMENTS:
1. Indemnification
The contractor agrees to indemnify and save harmless the Township, its officers, agents and employees,
hereinafter referred to as indemnitees, from all suits, including attorney’s fees and costs of litigation,
actions, loss damage, expense, cost of claims, of any character or on account of any act, claim or amount
arising or recovered under Worker’s Compensation law, or arising out of failure of the Contractor or those
acting under Contractor to conform to any statutes, ordinances, regulations, law or court decree. It is the
intent of the parties to this contract that the indemnities shall, in all instances, except for loss or damage
resulting from the sole negligence of the indemnitee, be indemnified against all liability, loss or damage of
any nature whatsoever.
2. Insurance Requirements:
A. Worker’s Compensation and Employer’s Liability Insurance
This insurance shall be maintained in full force during the life of this contract by the contractor covering
all employees engaged in performance of this contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C.
12:235-1.6. Minimum Employer’s Liability $1,000,000.00.
B. General Liability Insurance
This insurance shall have limits of not less than $3,000,000.00 any one person and $3,000,000.00 any
one accident for bodily injury and $3,000,000.00 aggregate for property damage, and shall be
maintained in force during the life of the contract.
C. Automobile Liability Insurance
This insurance covering contractor for claims arising from owned, hired and non-owned vehicles with
limits of not less than $3,000,000.00 any one person and $3,000,000.00 any one accident for bodily
injury and $3,000,000.00 each accident for property damage, shall be maintained in force during the
life of this contract by the contractor.
D. Professional Liability/Malpractice Insurance Policy (if applicable)
Coverage in the amount of $2,000,000.00/occurrence, $4,000,000.00 aggregate and assurance that each
such policy for each staff member remains full and in effect while providing services for Township.
The contractor shall provide the Township with a Certificate of Insurance naming the Township of East
Brunswick as additionally insured, evidencing the existence of required insurance prior to the
commission of work. Said insurance must include coverage for complete operations, contractual
insurance and independent contractor or subcontractor insurance, where and if applicable.
E. Errors and Omissions Insurance
a. The contractor shall purchase and maintain during the entire period of this contract, errors and
omissions insurance that shall protect the contractor and the Township from any and all claims
that may arise out of or result from the contractor’s performance of this contract. Specifically,

the errors and omissions insurance shall have limits of not less than $2,000,000.00 dollars per
occurrence and $4,000,000.00 dollars in the aggregate.
b. Certificates of the Required Insurance
Certificates as listed above shall be submitted along with the contract as evidence covering
Errors and Omissions insurance. Such coverage shall be with acceptable insurance companies
operating on an admitted basis in the State of New Jersey.
The contractor shall provide the Township with a Certificate of Insurance naming the
Township, its employees, officers, and agents as additionally insured, and evidencing the
existence of required insurance prior to the commission of work.
The Township will not accept Mutual Limitation of Liability terms.
F. OTHER REQUIREMENTS:
1. Proof of N.J. Business Registration Certificate N.J.S.A. 52:32-44
Pursuant to N.J.S.A. 52:32-44, the Township is prohibited from entering into a contract with an entity unless
the bidder/respondent/contractor, and each subcontractor that is required by law to be named in a
bid/proposal/contract has a valid Business Registration Certificate on file with the Division of Revenue and
Enterprise Services within the Department of the Treasury.
Prior to contract award or authorization, the contractor shall provide the Contracting Agency with its proof
of business registration and that of any named subcontractor(s).
Subcontractors named in a bid or proposal shall provide proof of business registration to the bidder, who in
turn, shall provide it to the Contracting Agency prior to the time of contract, purchase order, or other
contracting document is awarded or authorized.
During the course of contract performance:
(1) The contractor shall not enter into a contract with a subcontractor unless the subcontractor first
provides the contractor with a valid proof of business registration.
(2) The contractor shall maintain and submit to the Contracting Agency a list of subcontractors and
their addresses that may be updated from time to time.
(3) The contractor and any subcontractor providing goods or performing services under the
contract, and each of their affiliates, shall collect and remit to the Director of the Division of
Taxation in the
Department of Treasury, the use tax due pursuant to the Sales and Use Tax Act, (N.J.S.A. 54:32B-
1 et seq.) on all sales of tangible personal property delivered in the State. Any questions in this

Before final payment is made under the contract, the contractor shall submit to the Contracting Agency a
complete and accurate list of all subcontractors used and their addresses. Pursuant to N.J.S.A. 54:49-4.1, a
business organization that fails to provide a copy of a business registration as required, or that provides
false business registration information, shall be liable for a penalty of $25.00 for each day of violation, not

to exceed $50,000, for each proof of business registration not properly provided under a contract with a
contracting agency.
2. Form W-9
Successful contractor shall complete W-9 Form and submit to the Municipal Clerk prior to contract award.

3. Certification Of Political Contributions - Pay to Play – Notice of Disclosure Requirement
Township Ordinance No. 06-13 Establishing Restrictions on the Award of Contracts to Professional Entities
and Certain Other Entities Who Make Certain Political Contributions, and pursuant to Section 3 (a) thereof,
requires that Respondents confirm that they have not made any contributions in violation of Section 1 of
Ordinance No. 06-13.
Business entities are advised of their responsibility to file an annual disclosure statement of political
contributions with the New Jersey Election Law Enforcement Commission (ELEC) pursuant to N.J.S.A.
19:44A-20.27 if they receive contracts in excess of $50,000 from public entities in a calendar year.
Business entities are responsible for determining if filing is necessary. Additional information on this
requirement is available from ELEC at 888-313-3532 or at www.elec.state.nj.us.
H. PAYMENTS
The Contractor shall invoice the Department Recreation, Parks and Community Services of the Township
and payment will be processed in a timely manner upon receipt of accurate and complete paperwork.

GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS
During the performance of this contract, the contractor agrees as follows:

The contractor or subcontractor, where applicable will, in all solicitations or advertisements for
employees placed by or on behalf of the contractor, state that all qualified applicants will receive

status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex.
The contractor or subcontractor, where applicable, will send to each labor union or representative or
workers with which it has a collective bargaining agreement or other contract or understanding, a notice, to
be provided by the agency contracting officer advising the labor union or workers' representative of the
contractor's commitments under this act and shall post copies of the notice in conspicuous places available
to employees and applicants for employment.
The contractor or subcontractor, where applicable, agrees to comply with any regulations promulgated by
the Treasurer pursuant to N.J.S.A. 10:5-31 et seq., as amended and supplemented from time to time and the
Americans with Disabilities Act.
The contractor or subcontractor agrees to make good faith efforts to employ minority and women
workers consistent with the applicable county employment goals established in accordance with N.J.A.C.
l7:27-5.2, or a binding determination of the applicable county employment goals determined by the
Division, pursuant to N.J.A.C. 17:27-5.2.
The contractor or subcontractor agrees to inform in writing its appropriate recruitment agencies
including, but not limited to, employment agencies, placement bureaus, colleges, universities, labor unions,
that it does not discriminate on the basis of age, creed, color, national origin, ancestry, marital status,
affectional or sexual orientation, gender identity or expression, disability, nationality or sex, and that it will
discontinue the use of any recruitment agency which engages in direct or indirect discriminatory practices.
The contractor or subcontractor agrees to revise any of its testing procedures, if necessary, to assure
that all personnel testing conforms with the principles of job-related testing, as established by the statutes
and court decisions of the State of New Jersey and as established by applicable Federal law and applicable

review all procedures relating to transfer, upgrading, downgrading and layoff to ensure that all such actions

AMERICANS WITH DISABLITIES ACT OF 1990
EQUAL OPPORTUNITY FOR INDIVIDUALS WITH DISABLITY
The RESPONDENT and the TOWNSHIP OF EAST BRUNSWICK (herein referred to as the
TOWNSHIP) do hereby agree that the provisions of Title 11 of the Americans With Disabilities Act of
1990 (the “Act”) (42 U.S.C. S12101 et seq.), which prohibits discrimination on the basis of disability by
public entities in all services, programs and activities provided or made available by public entities, and the
rules and regulation promulgated pursuant thereunto, are made a part of this contract. In providing any aid,
benefit, or service on behalf of the TOWNSHIP pursuant to this contract, the RESPONDENT agrees that
the performance shall be in strict compliance with the Act. In the event the RESPONDENT, its agents,
servants, employees, or subcontractors violate or are alleged to have violated the Act during the
performance of this contract, the RESPONDENT shall defend the TOWNSHIP in any action or
administrative proceeding commenced pursuant to this Act. The RESPONDENT shall indemnify, protect,
and save harmless the TOWNSHIP, its agents, servants, and employees from and against any and all suits,
claims, losses, demands, or damages of whatever kind or nature arising out of the alleged violation. The
RESPONDENT shall, at its own expense, appear, defend, and pay any and, all charges for legal services
and any and all costs and other expenses arising from such action or administrative proceeding or incurred
in connection therewith. In any and all complaints brought pursuant to the TOWNSHIP’S grievance
procedure, the RESPONDENT agrees to abide by any decision of the TOWNSHIP, which is rendered
pursuant to, said grievance procedure. If any action or administrative proceeding result in an award of
damages against the TOWNSHIP or if the TOWNSHIP incurs any expense to cure a violation of the ADA
which has been brought pursuant to its grievance procedure the RESPONDENT shall satisfy an discharge
the same at its own expense.
The TOWNSHIP shall, as soon as practicable after a claim has been made against it, give written
notice thereof to the RESPONDENT along with full and complete particulars of the claim. If any action or
administrative proceeding is brought against the TOWNSHIP or any of its agents, servants, and employees,
the TOWNSHIP shall expeditiously forward or have forwarded to the RESPONDENT every demand,
complaint, notice, summons, pleading, or other process received by the TOWNSHIP or its representatives.
It is expressly agreed and understood that any approval by the TOWNSHIP of the services provided
by the RESPONDENT pursuant to this contract will not relieve the RESPONDENT of the obligation to
comply with the Act and to defend, indemnify, protect, and save harmless the TOWNSHIP pursuant to this
paragraph.
It is further agreed and understood that the TOWNSHIP assumes no obligation to indemnify or
save harmless the RESPONDENT, its agents, servants, employees and subcontractors for any claim which
may arise out of their performance of this Agreement. Furthermore, the RESPONDENT expressly
understands and agrees that the provisions of this indemnification clause shall in no way limit the
RESPONDENT’S obligations assumed in this Agreement, nor shall they be construed to relieve the
RESPONDENT from any liability, nor preclude the TOWNSHIP from taking any other actions available
to it under any other provisions of this Agreement or otherwise at law.
