A. PROJECT BACKGROUND:
The Township of East Brunswick is accepting quotations for mowing services outlined in this specification
for a period of two (2) years, 2020 and 2021. The contract may be renewed for up to two, one year
extensions upon mutual agreement of the Township and Contractor.
This contract includes mowing services of the site areas listed on Pages 5 - 7 of this Request For
Quotation document. The Contractor shall furnish a minimum of three (3) references on Page 17,
including the contact person, phone number and email address for each reference upon submission
of their bid. The Contractor shall have a minimum of five (5) years of experience in the field of
contract mowing and may provide documentation to substantiate the required experience. On
page 15, the Contractor should submit a cost per cut for each individual site in addition to
providing a Total Price for one overall cut of all sites included.
The Township of East Brunswick reserves the right to select which sites to include or remove in
the recommendation of awarding a contract.
It is the Contractor’s obligation to examine and familiarize themselves with all mowing sites. To
request a site visit to any area included in the contract, the Contractor shall contact the Director of
Recreation, Parks and Community Services at 732-390-6797 weekdays between the hours of 8:00
am – 4:30 pm.
Quotes must be received by the Township’s Designated Contact Person, via mail or hand delivery, by 11:00
a.m. prevailing time on March 18, 2020. Quotes received after 11:00 a.m. on the Due Date will be returned
unopened.

B. SCOPE OF WORK:
The Township is issuing this request for quotation via a fair and open process in accordance with N.J.S.A
19:44A-20.4 et seq.
Scope of Service
1.
Provision of Labor, Tools and Equipment. The Contractor agrees to furnish and pay all
necessary expenses for all labor, tools and equipment in connection with the program of mowing
and trimming as designated by the Township.
2.
Payment to Other Parties. The Contractor shall not obligate the Township to make any payments
to another party, not make any promises or representations to another party for, or in behalf of, the
Township without prior written approval of the Director of Recreation, Parks and Community
Services or his authorized representative. No work shall be done on any grass or brush involved in
such payments, promises or representations until such approval of the Director of Recreation, Parks
and Community Services or his authorized representative has been obtained.
3.
Description of Work. The Contractor agrees to trim, edge mow and blow the grass on certain
areas in the manner specified in this Agreement. The specific areas involved are listed in these
Specifications which is incorporated herein and shall be construed as part of this Agreement. A
map depicting the location of each site is available for review at the Department of Recreation,
Parks and Community Services, 334 Dunhams Corner Road, East Brunswick. Specifications for
the work to be performed by the Contract will be as follows:
a.
Mowing. The Contractor will mow the areas listed within Pages 5 - 7 per the cutting
schedule. To avoid damaging the grass, the Contractor will not mow to a height of less
than two (2) inches.
b.
Trimming. The Contractor will trim the grass around the curbs, trees, bushes, planting
beds, utility poles, sign posts, fences and other objects as required to provide uniform
appearance. The trimming must be done on the same day as the mowing.
c.
Litter and Debris. It is the Contractor’s responsibility to maintain the areas in a neat and
attractive condition. Litter, debris and branches must be collected and placed in trash cans
or dumpsters prior to mowing. When finished mowing, the Contractor will sweep and
remove any dirt and grass clippings from curbs, sidewalks or streets adjoining the areas.
Storm drains are to be kept free and clear of grass clippings.
d.
Reporting of Damage. Any vandalism or storm damage to the areas, or to any of the trees,
bushes or objects located in the park area will be reported to the Director of Recreation,
Parks and Community Services, 334 Dunhams Corner road, East Brunswick, NJ (732-390-
6797) as soon as possible by the Contractor.
4.
Work Schedule. The work performed by the Contractor as described in the Agreement shall begin
at the Township’s request, (approx. April 15). Each area awarded, once begun, shall be for a
continuous period through November 14 subject to the provisions of this Agreement. All work
areas will be maintained weekly, or twice per month, according to area, rate of growth and
frequency of rainfall. Contractor shall submit a schedule for mowing to be approved by the Director
of Recreation, Parks and Community Services for approval by the Township. The Township may
add or drop areas and regulate the number of mowings during the contract period.

5.
Hours of Work. The Contractor may perform the work on weekdays, Monday thru Friday,
between the hours of 7:00 A.M. and 7:00 P.M. The Contractor shall not perform mowings on days
when organized programs (Soccer, Football, etc.) or Special Events are scheduled. The Contractor
shall not perform mowing when turf may be damaged by mowing equipment because of rainfall.
The Township will supply the Contractor with a schedule of events and time of programs and events

Equipment. The Contractor is responsible for providing, maintaining and transporting all
necessary equipment, and fuel for its use, in connection with the program of mowing and trimming
described in this Agreement. All lawn and grass mower blades must be kept sufficiently sharp to
provide a clean and even cut. All other tools and supplies necessary for performing the work
required by this Agreement will be provided by the Contractor.
All areas must be cut with fine quality finish mowers.
7.
Addition / Deletion of Acres. The Township reserves the right to reduce the frequency of an area
to be cut or eliminate an area entirely or add additional acreage; therefore, charges shall be adjusted
accordingly.
8.
Personnel. The Contractor’s personnel shall, at all times, present a neat appearance, and all work
shall be performed and all complaints handled with due regard to the Township public relations.
The Contractor shall utilize competent employees in performing the work specified in this contract.
At the request of the Township, the Contractor will replace any person in his or her employ that is
incompetent, abusive or disorderly. The Crew Leader must be available at all times when work is
being performed and be fluent in the English language.
9.
Supervision, Consultation and Reporting. It is agreed that the Director of Recreation, Parks and
Community Services or his authorized representative and the Contractor must mutually understand
work priorities, maintenance methods and management techniques. Upon request and/or necessity,
an authorized municipal representative will accompany the Contractor to work areas to further
clarify or describe maintenance methods and procedures. All work described in this Agreement
shall be performed under the guidance of the Director of Recreation, Parks and Community
Services or his authorized representative and subject to his approval. The Contractor will consult
with the Director of Recreation, Parks and Community Services or his authorized representative
regarding the details, scheduling the performance of the mowing and trimming work, and will
provide upon the Township’s request, weekly or monthly reports of work performed.
10.
Obstruction of Streets and Right-of-Ways. The Contractor will arrange to keep sidewalks open
for traffic whenever possible and will block portions of streets only when deemed necessary to
protect private property. Warning signs and barricades shall be furnished and erected by the
Contractor when warranted. It is the Contractor’s responsibility to remove all surplus material and
debris from streets as work progresses in order that the public will have adequate use of the affected
streets.
11.
Accident Prevention. The Contractor shall exercise precaution at all times for the protection of
persons and property. Safety provision of all applicable laws and ordinances shall be strictly
observed. The Director of Recreation, Parks and Community Services or his authorized
representative may require the Contractor to discontinue hazardous work practices upon written
notice. It is required that the Contractor keep the necessary guards and protective devices on
mowing equipment at locations where work is being performed to prevent injury to the public or

damage to public or private property. The Contractor is responsible to pay for any damage to public
property, buildings, etc. as a result of mowing activities.
12.
Payment for Services. The Contractor will submit monthly invoices and shall be paid according
to the following:
a.
Upon satisfactory performance of services, the Contractor shall be paid in monthly
installments following full execution of services required. All invoices must stipulate the
site(s) and date(s) mowing was performed and submitted to the Director of Recreation,
Parks and Community Services at 334 Dunhams Corner Road, East Brunswick, NJ.
Payment will be made within 30 days.
14.
Liquidated Damages. If the Contractor fails to perform the work in the manner specified by this
Agreement, the Township may, at its option, assess the Contractor for each day that the work is not
performed. Before assessing liquidated damages, the Township will notify the Contractor of the
problem and allow the Contractor twenty-four (24) hours to take corrective action. The assessment
will be two hundred fifty dollars ($250) per day. If, after further written notice, the Contractor fails
to take corrective action, the Township may terminate this Agreement and enter into an agreement
with another Contractor, or may perform the work itself. The cost of performing the work will be
deducted from any amount due under the Payment for Service schedule.

C. QUALIFICATIONS:
1. Contractor shall meet and submit all necessary documents to satisfy all Federal, State, and Local
certifications and requirements. All requirements of the Central Jersey Joint Insurance Fund shall
be adhered to as required.
2. Contractor shall have a minimum of five (5) years of experience and provide documentation
indicating this experience and any award recipients.
3. Contractor shall provide references within the past 5 years.
D. FAIR AND OPEN CRITERIA:
STANDARDIZED SUBMISSION REQUIREMENTS & SELECTION CRITERIA
1. The solicitation of qualifications for any contract to be determined in excess of $17,500, and for
which a bid solicitation shall not be required under the Local Public Contracts Law shall be
advertised by the Township on the Township website at least ten (10) days prior to the date set for
the receipt of said quote. The published notice shall set forth a description of the requested goods
or services, the time, date and place that proposals must be submitted, the contact information for
obtaining a proposal document, and a statement that the proposals are being solicited through the
fair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq.
2. The Township shall review the responses to the request for quotes and appoint or award a contract
to a business entity for the goods or services advertised subsequent to such review. Contracts
awarded under this process shall be publicly announced and awarded. The resolution awarding the
contract shall state that the contract was awarded after a fair and open process and shall state the
number of responses received.
3. Contracts subject to the fair and open process delineated herein are subject to additional
Requirements and any other applicable laws including, but not limited to, the Local Public
Contracts Law.
E. SELECTION CRITERIA:
Quotations will be evaluated on the basis of the most advantageous, price and other factors considered. The
evaluation will consider:
a. Experience, technical expertise, professional execution and reputation in the field;
b. Knowledge of the Township of East Brunswick and the subject matter to be addressed under the
contract;
c. Availability to accommodate any required meetings of the Township and the ability to work well
with the Township;
d. Compensation proposal;
e. Other factors if demonstrated to be in the best interest of the Township of East Brunswick;

F.
INSURANCE REQUIREMENTS:
1. Indemnification
The contractor agrees to indemnify and save harmless the Township, its officers, agents and employees,
hereinafter referred to as indemnitees, from all suits, including attorney’s fees and costs of litigation,
actions, loss damage, expense, cost of claims, of any character or on account of any act, claim or amount
arising or recovered under Worker’s Compensation law, or arising out of failure of the Contractor or those
acting under Contractor to conform to any statutes, ordinances, regulations, law or court decree. It is the
intent of the parties to this contract that the indemnities shall, in all instances, except for loss or damage
resulting from the sole negligence of the indemnitee, be indemnified against all liability, loss or damage of
any nature whatsoever.
2. Insurance Requirements:
A. Worker’s Compensation and Employer’s Liability Insurance
This insurance shall be maintained in full force during the life of this contract by the contractor covering
all employees engaged in performance of this contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C.
12:235-1.6. Minimum Employer’s Liability $1,000,000.00.
B. General Liability Insurance
This insurance shall have limits of not less than $3,000,000.00 any one person and $3,000,000.00 any
one accident for bodily injury and $3,000,000.00 aggregate for property damage, and shall be
maintained in force during the life of the contract.
C. Automobile Liability Insurance
This insurance covering contractor for claims arising from owned, hired and non-owned vehicles with
limits of not less than $3,000,000.00 any one person and $3,000,000.00 any one accident for bodily
injury and $3,000,000.00 each accident for property damage, shall be maintained in force during the
life of this contract by the contractor.
D. Professional Liability/Malpractice Insurance Policy (if applicable)
Coverage in the amount of $2,000,000.00/occurrence, $4,000,000.00 aggregate and assurance that each
such policy for each staff member remains full and in effect while providing services for Township.
The contractor shall provide the Township with a Certificate of Insurance naming the Township of East
Brunswick as additionally insured, evidencing the existence of required insurance prior to the
commission of work. Rain Date shall also be shown on the description section of the Certificate of
Insurance. Said insurance must include coverage for complete operations, contractual insurance and
independent contractor or subcontractor insurance, where and if applicable.

E. Errors and Omissions Insurance
a. The contractor shall purchase and maintain during the entire period of this contract, errors and
omissions insurance that shall protect the contractor and the Township from any and all claims
that may arise out of or result from the contractor’s performance of this contract. Specifically,
the errors and omissions insurance shall have limits of not less than $2,000,000.00 dollars per
occurrence and $4,000,000.00 dollars in the aggregate.
b. Certificates of the Required Insurance
Certificates as listed above shall be submitted along with the contract as evidence covering
Errors and Omissions insurance. Such coverage shall be with acceptable insurance companies
operating on an admitted basis in the State of New Jersey.
The contractor shall provide the Township with a Certificate of Insurance naming the
Township, its employees, officers, and agents as additionally insured, and evidencing the
existence of required insurance prior to the commission of work.
The Township will not accept Mutual Limitation of Liability terms.
F. OTHER REQUIREMENTS:
1. Proof of N.J. Business Registration Certificate N.J.S.A. 52:32-44
Pursuant to N.J.S.A. 52:32-44, the Township is prohibited from entering into a contract with an entity unless
the bidder/respondent/contractor, and each subcontractor that is required by law to be named in a
bid/proposal/contract has a valid Business Registration Certificate on file with the Division of Revenue and
Enterprise Services within the Department of the Treasury.
Prior to contract award or authorization, the contractor shall provide the Contracting Agency with its proof
of business registration and that of any named subcontractor(s).
Subcontractors named in a bid or proposal shall provide proof of business registration to the bidder, who in
turn, shall provide it to the Contracting Agency prior to the time of contract, purchase order, or other
contracting document is awarded or authorized.
During the course of contract performance:
(1) The contractor shall not enter into a contract with a subcontractor unless the subcontractor first
provides the contractor with a valid proof of business registration.
(2) The contractor shall maintain and submit to the Contracting Agency a list of subcontractors and
their addresses that may be updated from time to time.
(3) The contractor and any subcontractor providing goods or performing services under the
contract, and each of their affiliates, shall collect and remit to the Director of the Division of
Taxation in the
Department of Treasury, the use tax due pursuant to the Sales and Use Tax Act, (N.J.S.A. 54:32B-
1 et seq.) on all sales of tangible personal property delivered in the State. Any questions in this

Before final payment is made under the contract, the contractor shall submit to the Contracting Agency a
complete and accurate list of all subcontractors used and their addresses. Pursuant to N.J.S.A. 54:49-4.1, a
business organization that fails to provide a copy of a business registration as required, or that provides
false business registration information, shall be liable for a penalty of $25.00 for each day of violation, not
to exceed $50,000, for each proof of business registration not properly provided under a contract with a
contracting agency.
2. Form W-9
Successful contractor shall complete W-9 Form and submit to the Municipal Clerk prior to contract award.

3. Certification Of Political Contributions - Pay to Play – Notice of Disclosure Requirement
Township Ordinance No. 06-13 Establishing Restrictions on the Award of Contracts to Professional Entities
and Certain Other Entities Who Make Certain Political Contributions, and pursuant to Section 3 (a) thereof,
requires that Respondents confirm that they have not made any contributions in violation of Section 1 of
Ordinance No. 06-13.
Business entities are advised of their responsibility to file an annual disclosure statement of political
contributions with the New Jersey Election Law Enforcement Commission (ELEC) pursuant to N.J.S.A.
19:44A-20.27 if they receive contracts in excess of $50,000 from public entities in a calendar year.
Business entities are responsible for determining if filing is necessary. Additional information on this
requirement is available from ELEC at 888-313-3532 or at www.elec.state.nj.us.
H. PAYMENTS
The Contractor shall invoice the Department Recreation, Parks and Community Services of the Township
and payment will be processed in a timely manner upon receipt of accurate and complete paperwork.

EXHIBIT A - MANDATORY EQUAL EMPLOYMENT OPPORTUNITY LANGUAGE PER
N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1.1 et seq.
GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS
During the performance of this contract, the contractor agrees as follows:
The contractor or subcontractor, where applicable, will not discriminate against any employee or
applicant for employment because of age, race, creed, color, national origin, ancestry, marital status,
affectional or sexual orientation, gender identity or expression, disability, nationality or sex. Except with
respect to affectional or sexual orientation and gender identity or expression, the contractor will take
affirmative action to ensure that such applicants are recruited and employed, and that employees are treated
during employment, without regard to their age, race, creed, color, national origin, ancestry, marital status,
affectional or sexual orientation, gender identity or expression, disability, nationality or sex. Such action
shall include, but not be limited to the following: employment, upgrading, demotion, or transfer;
recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation;
and selection for training, including apprenticeship. The contractor agrees to post in conspicuous places,
available to employees and applicants for employment, notices to be provided by the Public Agency
Compliance Officer setting forth provisions of this nondiscrimination clause.
The contractor or subcontractor, where applicable will, in all solicitations or advertisements for
employees placed by or on behalf of the contractor, state that all qualified applicants will receive
consideration for employment without regard to age, race, creed, color, national origin, ancestry, marital
status, affectional or sexual orientation, gender identity or expression, disability, nationality or sex.
The contractor or subcontractor, where applicable, will send to each labor union or representative or
workers with which it has a collective bargaining agreement or other contract or understanding, a notice, to
be provided by the agency contracting officer advising the labor union or workers' representative of the
contractor's commitments under this act and shall post copies of the notice in conspicuous places available
to employees and applicants for employment.
The contractor or subcontractor, where applicable, agrees to comply with any regulations promulgated by
the Treasurer pursuant to N.J.S.A. 10:5-31 et seq., as amended and supplemented from time to time and the
Americans with Disabilities Act.
The contractor or subcontractor agrees to make good faith efforts to employ minority and women
workers consistent with the applicable county employment goals established in accordance with N.J.A.C.
l7:27-5.2, or a binding determination of the applicable county employment goals determined by the
Division, pursuant to N.J.A.C. 17:27-5.2.
The contractor or subcontractor agrees to inform in writing its appropriate recruitment agencies
including, but not limited to, employment agencies, placement bureaus, colleges, universities, labor unions,
that it does not discriminate on the basis of age, creed, color, national origin, ancestry, marital status,
affectional or sexual orientation, gender identity or expression, disability, nationality or sex, and that it will
discontinue the use of any recruitment agency which engages in direct or indirect discriminatory practices.
The contractor or subcontractor agrees to revise any of its testing procedures, if necessary, to assure
that all personnel testing conforms with the principles of job-related testing, as established by the statutes

AMERICANS WITH DISABLITIES ACT OF 1990

The RESPONDENT and the TOWNSHIP OF EAST BRUNSWICK (herein referred to as the
TOWNSHIP) do hereby agree that the provisions of Title 11 of the Americans With Disabilities Act of
1990 (the “Act”) (42 U.S.C. S12101 et seq.), which prohibits discrimination on the basis of disability by
public entities in all services, programs and activities provided or made available by public entities, and the
rules and regulation promulgated pursuant thereunto, are made a part of this contract. In providing any aid,
benefit, or service on behalf of the TOWNSHIP pursuant to this contract, the RESPONDENT agrees that
the performance shall be in strict compliance with the Act. In the event the RESPONDENT, its agents,
servants, employees, or subcontractors violate or are alleged to have violated the Act during the
performance of this contract, the RESPONDENT shall defend the TOWNSHIP in any action or
administrative proceeding commenced pursuant to this Act. The RESPONDENT shall indemnify, protect,
and save harmless the TOWNSHIP, its agents, servants, and employees from and against any and all suits,
claims, losses, demands, or damages of whatever kind or nature arising out of the alleged violation. The
RESPONDENT shall, at its own expense, appear, defend, and pay any and, all charges for legal services
and any and all costs and other expenses arising from such action or administrative proceeding or incurred
in connection therewith. In any and all complaints brought pursuant to the TOWNSHIP’S grievance
procedure, the RESPONDENT agrees to abide by any decision of the TOWNSHIP, which is rendered
pursuant to, said grievance procedure. If any action or administrative proceeding result in an award of
damages against the TOWNSHIP or if the TOWNSHIP incurs any expense to cure a violation of the ADA
which has been brought pursuant to its grievance procedure the RESPONDENT shall satisfy an discharge
the same at its own expense.
The TOWNSHIP shall, as soon as practicable after a claim has been made against it, give written
notice thereof to the RESPONDENT along with full and complete particulars of the claim. If any action or
administrative proceeding is brought against the TOWNSHIP or any of its agents, servants, and employees,
the TOWNSHIP shall expeditiously forward or have forwarded to the RESPONDENT every demand,
complaint, notice, summons, pleading, or other process received by the TOWNSHIP or its representatives.
It is expressly agreed and understood that any approval by the TOWNSHIP of the services provided
by the RESPONDENT pursuant to this contract will not relieve the RESPONDENT of the obligation to
comply with the Act and to defend, indemnify, protect, and save harmless the TOWNSHIP pursuant to this
paragraph.
It is further agreed and understood that the TOWNSHIP assumes no obligation to indemnify or
save harmless the RESPONDENT, its agents, servants, employees and subcontractors for any claim which
may arise out of their performance of this Agreement. Furthermore, the RESPONDENT expressly
understands and agrees that the provisions of this indemnification clause shall in no way limit the
RESPONDENT’S obligations assumed in this Agreement, nor shall they be construed to relieve the
RESPONDENT from any liability, nor preclude the TOWNSHIP from taking any other actions available
to it under any other provisions of this Agreement or otherwise at law.
