NOTICE OF RFP
The Township of East Brunswick is soliciting proposals through the competitive contracting process
in Accordance with N.J.S.A. 40A:11-4.1, et seq.
Sealed RFP responses will be received the Municipal Clerk on Friday, April 30, 2025 at 11 A.M. in
the1st Floor, Large Conference Room, 1 Civic Center Drive, East Brunswick, New Jersey 08816 at
which time responses will be opened and read for:
Providing on-site elevator inspections and elevator subcode official services for the Township of East
Brunswick.
RFP responses must be made on the standard proposal forms included with the specifications and
delivered in sealed envelopes, clearly marked on the outside with the RFP title name, bearing the
name and address of the respondent on the outside and addressed to the Township of East Brunswick
Municipal Clerk, at 1 Civic Center Drive, East Brunswick, New Jersey 08816.
Proposals may be hand delivered or mailed to the above address. Respondents bear all responsibility
for timely delivery of their Proposals.
Specifications and other RFP information may be obtained from the Municipal Clerk during the hours
of 8:00 a.m. to 4:30 p.m. Monday through Friday or by written request via email from
tlawful@eastbrunswick.org .
Questions regarding the RFP specifications must be submitted in writing by email to:
tlawful@eastbrunswick.org . Written questions and inquiries must be received no later than five (5)
business days prior to the RFP opening date.
Respondents are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C.
17:27, et seq., N.J.S.A. 52:32-44, and all other applicable statutes, laws or regulations.

GLOSSARY
The following definitions shall apply to and are used in this Request for Proposals (“RFP”):
"Due Date" - refers to the date and time by which Proposals must be received by the Township in order to
be considered for award of the contract.
"Proposal" - refers to a Proposer's response to this RFP.
"Proposer(s)” - refers to the interested individuals and firms that submit Proposals.
"Services" - refers to the services the Township seeks in this RFP process.
“Successful Proposer" - refers to the Proposer selected by the Township to perform the Services.
"Township” - refers to the Township of East Brunswick, its officers and elected and appointed officials,
employees and advisors and consultants.
SECTION 1
INTRODUCTION AND GENERAL INFORMATION
1.1 Introduction and Purpose
East Brunswick request for proposal for On-site Elevator Subcode and Elevator Inspection
Services.
East Brunswick Township will be accepting written qualifications and price proposals from
qualified firms to provide on-site elevator subcode and elevator inspection services.
.
1.2 Procurement Process and Schedule
The RFP process commences with the issuance of this RFP. The steps involved in the process and the
anticipated completion dates are stated in the Anticipated Procurement Schedule. The Township reserves
the right to, among other things, amend, modify or alter the Procurement Schedule upon notice to all
potential Proposers who have provided contact information to the Township's Designated Contact Person
upon receipt of this RFP.
Proposals must be received by the Township's Designated Contact Person, via mail or hand delivery,
by 11:00 A.M. prevailing time on the Due Date. Proposals received after 11:00 A.M. on the Due Date
will be returned unopened.
All communication concerning this RFP shall be directed to the Township's Designated Contact Person, in
writing. The Designated Contact Person is:

1.3
Conditions Applicable to RFP.
Upon submitting a Proposal in response to this RFP, the Proposer acknowledges and consents to the
following conditions:
1. This RFP does not commit the Township to select a Proposer and/or enter into a contract for the
services.
2. All costs incurred by the Proposer in connection with responding to this RFP shall be borne solely
by the Proposer. There shall be no claims whatsoever against the Township, its staff or consultants
for reimbursement or payment of costs or expenses incurred in the preparation of the Proposal or
other information required by the RFP.
3. The Township reserves the right to reject for any reason any and all responses and components
thereof.
4. The Township reserves the right to reject any Proposer that submits incomplete responses to this
RFP, or a Proposal that is not responsive to the requirements of this RFP.
5. The Township reserves the right, without prior notice, to supplement, amend, or modify this RFP,
or to request additional information.
6. All Proposals shall become the property of the Township and will not be returned.
7. All Proposals will be made available to the public at the appropriate time, as determined by the
Township in accordance with law.
8. Any Proposals not received by the Township by the due date will be rejected.
9. The Township shall not be liable for any claims or damages alleged to have been incurred as a
result of this RFP process, including the Township's review of Proposals and its award of contracts.

1.4
Rights of Township
1. The Township reserves the following rights with regard to this RFP and the procurement process
in accordance with the provisions of applicable law:
2. To determine that any Proposal received complies or fails to comply with the terms of this RFP.
3. To supplement, amend or otherwise modify the RFP through issuance of addenda to all prospective
Proposers who have received a copy of this RFP.
4. To waive any technical non-conformance with the terms of this RFP.
5. To change or alter the schedule for any events called for in this RFP upon the issuance of notice to
all prospective Proposers who have received a copy of this RFP.
6. To conduct investigations of any or all of the Proposers, as the Township deems necessary or
convenient, to clarify the information provided as part of a Proposal, and to request additional
information to support the information included in any Proposal.
7. To suspend or terminate the procurement process described in this RFP at any time, commence a
new procurement process, or exercise any other rights provided under applicable law without any
obligation to the Proposers.
8. The Township shall be under no obligation to complete all or any portion of the procurement
process described in this RFP.
9. Under no circumstance will the township be responsible for the costs incurred by the proposer in
connection with the response to this RFP.
1.5
Addenda or Amendments to RFP.
After the issuance of the RFP, but no later than five (5) business days prior to the Due Date, the
Township may issue addenda, amendments or answers to written inquiries. Addenda will be noticed by the
Township and will constitute a part of the RFP. All responses to the RFP shall be prepared with full
consideration of any addenda issued.

Proposal Format.
Responses should cover the information requested in Section 3 of this RFP. Responses that fail to
meet the requirements of the RFP or that are in any way conditional, incomplete, obscure, contain additions
or deletions from requested information, or contain errors, may be rejected.

SECTION 2
SCOPE OF SERVICES
SPECIFICATIONS FOR ELEVATOR SUBCODE/INSPECTIONS BY AN
ON-SITE AGENCY
TECHNICAL SPECIFICATIONS
All responses to the specifications shall be in the same sequence and order as listed.
Each of the specifications requires a narrative response. Failure to respond to each of the
specifications fully and completely in narrative form will be considered non-responsive and
cause for rejection.
In effort to show your agency's quality and legitimacy of work, typewritten response on
company letter head, signed by the owner of the company and attested to by a notary is
required for the following specifications. Hand-written responses to these proposal
specifications are unacceptable. Hand-written responses will be cause for rejection of the
agency's proposal.
The award shall be made to the agency whose response is most advantageous to the
municipality all factors considered N.J.S.A.40A: 11-6.1.
1. Provide the complete address of each agency office as defined in N.J.A.C. 5:23- 4.14 (e)
through (f).
2. List the name of the person who will serve as the agency's responsible official and
representative if the agency is awarded the contract.
3. List a full listing of all agency technical, field inspection and supervisory personnel,
grouped by job classification and title. The listing shall include the technical,
educational and licensure qualifications of each person.
4. Provide a resume of the educational and professional qualifications of the individual
who will serve as your agency's "Responsible Official” as described in NJ.AC. 5:23-
4.13(c).
5. List a full listing of the municipalities served by the agency. This list shall specifically
identify the subcodes enforced in each case and the number of permits supervised and
the number of inspections performed during an average month during the preceding
year in each municipality.
6. List the name(s) of the sub-code officials and inspectors; list cell numbers for sub-code
officials and inspectors who will be providing sub-code and inspection services to the
municipality.
7. With proposal, respondent shall supply resumes of key employees.
8. To maintain quality of work within our municipality as the respondent provides
services in other municipalities, the respondent shall have at least five (5) full time
staff members who are licensed to provide elevator subcode services and who will
satisfy a background check.

9. In what other municipalities is/are the above listed sub code official(s) and inspector(s)
performing sub code/or inspection services?
10. What are the anticipated numbers of inspections that will be required of each sub code
official(s) or inspector(s) in any and all other municipalities on annual basis during the
time of the contract with the municipality?
11. In addition to inspections performed by said sub code officials(s) or inspectors, to any
other municipalities, describe any additional duties or requirements of any such
municipality.
12. Describe in detail how said subcode official(s) or inspectors will service the
municipality in conjunction with any other services to other municipalities.
13. Provide a table of organization for the agency, which is correlated by job title to the
required personnel list.
14. Please state the manner in which each class of employee is compensated which shall
be one of the following: full-time hourly or part-time salaried, part-time salaried, full-
time hourly or full-time salaried, part-time salaried or part-time hourly.
15. Provide a narrative description of the arrangements of the agency plans to make for
discharging its plan review obligations;
16. State the time in which the agency can perform, or has performed, plan reviews upon
assignment by the construction official.
17. State any guarantees of time in responding to requests for required inspection or plan
review established in these regulations. If an agency does not guarantee response time
less than the maximum, the agency shall so state in its response to this question.
18. State the time in which the agency can respond, or has responded, to requests for
required inspections from the construction industry.
19. Provide a narrative description of the arrangements the agency plans to make for
providing emergency inspection services, including response time of your inspection
staff.

COMPANY HISTORY
The respondent shall submit responses to the following on company letterhead at time of
proposal:
1. Has the agency or any of its personnel, within the last ten years, been the subject of
or named as a defendant in any legal action involving death, dismemberment or trauma
as a result of elevator inspection services provided by your agency? Please indicate:
YES or NO
If yes, please provide all information including the names of the plaintiff(s), the address
of the accident, the municipality, a brief description of the accident and the injuries
sustained, in the case or cases. Was the Agency, or its insurance carrier, required to
make settlement or pay a fine in the resolution of these cases?
2. Is/are there any legal action(s), currently pending against the agency, or its personnel
involving death dismemberment or trauma as a result of elevator inspection services
provided by your agency or its personnel? If so, please list the address(s) of the
accident(s), the name(s) of the deceased, the municipality, and a brief description of
the accident(s) and current status of legal action if any.
3. Has the agency or any of Subcode Officials of the agency been the subject of complaint
or an investigation by the Department of Community Affairs with respect to improper
code enforcement, or fees charged for elevator inspection and permit applications in
any municipality, with which the agency was in contract? Please indicate:
YES or NO
If yes, please provide all information including copies of any complaints or findings
due to the investigations by the Department of Community Affairs.
4. Has the Agency been the subject of investigation by the D.C.A. with respect to False
and Misleading Statements in respect to staffing and/or quantity and/or quality of
inspections being performed?
QUESTIONS WHICH ARE NOT ANSWERED OR IF ANSWERS ARE INCOMPLETE,
THE AGENCY'S PROPSAL MAY BE CONSIDERED TO BE NON- RESPONSIVE AND
REJECTED BY THE MUNICIPALITY.

RESPONDENTS EXPERIENCE AND QUALIFICATIONS QUESTIONNAIRE
The answers to this questionnaire must be submitted as part of the Proposal.
In effort to show your agency's quality and legitimacy of work, a typewritten response to this
questionnaire must be on company letter head, signed by the owner of the company and attested
to by a notary is required. Hand-written responses are unacceptable. Hand- written responses
will be cause for rejection of the agency's proposal.
Failure to submit this document or to provide factually any of the requested information is
grounds for the rejection of the respondent’s proposal.
1. Number of years in business under present name & address. If less than five (5)
years, list previous names and addresses.
2. Within the last five (5) years has the business or any officer/ partner failed to
complete a contract awarded to them. If yes, provide the details in a separate letter.
3. Have any liens and lawsuits been filed against the company in the past five (5) years. If
yes, provide the details in a separate letter.
4. Provide references for five (5) similar work/services performed by the respondent in the
past three (3) years. The list shall include username and address.
5. The respondent shall list any pending violations and or claims against your Agency. The
Municipality reserves the right to review all claims.

SPECIFICATIONS FOR ELEVATOR SUBCODE INSPECTIONS BY AN ON-
SITE AGENCY
PROCEDURAL REQUIREMENTS
A written narrative response is required for the following specifications. Failure to respond in
narrative form to each of the specifications will be considered non-responsive and cause for
rejection.
In effort to show your agency's quality and legitimacy of work, a typewritten response to this
questionnaire must be on company letter head, signed by the owner of the company and
attested to by a notary is required. Hand-written responses are unacceptable. Hand- written
responses will be cause for rejection of the agency's proposal.
A.
The Agency's subcode official must deliver, in person, to our Building Department;
within (15) days of the inspection all Inspection reports U.C.C. F310-1, U.C.C. F310-
2 (rev. 3/96), completed Notices of Violation, and Certificate of Compliances for
signature of the Construction Official. All "Unsatisfactory Conditions" shall include
the proper code citation; code rule number and year code was adopted. We will only
accept, U.C.C. F310 forms; for quality purposes. Additionally, all reports must be
completed in triplicate and shall be typed, including the F310 form. Handwritten
forms will not be accepted. The F310 form shall indicate the installation year of the
device, and the code year the device is inspected to. In building locations with more
than one elevator car, we require the state-mandated F310 form, as required by the
U.C.C. Provide a copy of a typical inspection report, including an addressed envelope,
fully assembled and ready for disbursement to the appropriate parties. Provide
example of a completed form for multiple, at minimum, 2 elevator and 2 escalator
inspections, which your agency has performed.
B.
While it is understood that the Municipality through the Construction Official's office
shall be responsible for the collection of all elevator inspection fees we require the
agency to assist in preparing elevator fee notices for mailing to the owner/agent. The
information will include an addressed envelope to the owner/agent, a cover letter of
transmittal and invoice to the owner agent. All mailing will be done through the
Building Department. The cover letter will carry the logo of the municipality, the
Construction Official's name and phone number, the address of the owner I agent and
the address of the elevator(s) to be inspected. The letter will instruct the owner agent
and will cite the proper Uniform Construction Code regulations. The invoice shall
have the date of the next regularly scheduled inspection, the type of inspection, annual
or re-inspection, the proper U.C.C citation for the inspection fee(s) and administrative
charges. The proper fees for the elevator devices and associated Oil buffers,
Counterweight Governor Safeties and Auxiliary Power Generator and extended
showing the total fees to be paid to the municipality. Additionally, each invoice shall
have an invoice number and address of the municipality for proper mailing of the
payment. All invoices will be prepared and mailed (30) days prior to the scheduled
inspection. A duplicate copy of each invoice will be prepared by the agency for our
office records. Provide a sample of your cover letter and invoice, which will be for a
minimum of three (3} elevators and will include oil buffers and counterweight governor

safeties your agency plans to inspect.
C.
An agency licensed elevator inspector/subcode official will prepare all Notices of
Violation, and Notice of Penalty, if required, in triplicate, for review and signature(s) with
the Construction Official. The forms must be "U.C.C. F21 l" and U.C.C F212" and shall
reflect all the necessary information such as Name of Owner or Agent, Lot and Block
numbers, Control Number, the name and address of the Board of Appeals, and the fee for
application to the Board. All notice of violation forms F2l 1 and notice of violation forms
F212 shall be typed and must carry an original signature of the elevator Subcode Official.
Please provide examples of both completed forms, including addressed envelope, your
agency has issued.
D.
The subcode official/agency together with the control person and construction official,
will track all non-payment of fees by owner/agents and prepare, in triplicate, Notice of
Violation F2l l. If the inspection fees are not paid to the municipality after (30} days, the
agency shall prepare a Notice of Penalty F212 for non-payment and signing with the
Construction Official. After signing, the subcode official/ agency will separate the three
(3) copies and distribute as required. The agency will provide addressed envelopes, for
mailing to the owner agent, by the Building Department. Submit examples of your
agency's completed Notices of Violation and Notice of Penalty for non-payment, your
agency has issued.
E. Provide a fee schedule based on the Percentage your agency is proposing. The schedule
shall specify the total fee the owner / agent will pay, the amount to be retained by the
agency and the administrative fee due the municipality. We require an administrative fee
of 40 %.
F. The designated subcode official is to meet, in person, with the Construction Official every
Tuesday and Thursday between the hours of 1 P.M. and 3 P.M. Please list your agency's
subcode official.
G. The subcode official, after all signatures are complete, must separate and prepare all forms
for mailing to the Owner/ Agent and filing in the municipality and the office of the on-
site agency. The subcode official will enclose each report in an envelope, which will be
addressed by the on-site agency. All mailing will be done by the municipality
H. It should be understood that all of the services defined in these specifications, will be
performed at no additional cost to our municipality and we reserve the right to accept /
reject the services. which are in the best interest of our municipality.
I.
Provide a resume of the educational and professional qualifications of the individual who
will serve as your agency's '"Responsible Official" as described in N.J.A.C. 5:23-4.13(c).
J.
Provide Certificate(s) of insurance demonstrating current coverage including the
following required certificates of coverage: Worker's Compensation, Comprehensive
General Liability, Professional Liability - Errors and Omissions, Automobile Liability,
and Excess Liability of $5,000,000.00.

SECTION 3
SUBMISSION EQUIREMENTS
3.1
General Requirements.
The proposal submitted by the Respondent must meet or exceed the professional,
administrative and financial qualifications set forth in this Section herein below and shall
incorporate the information requested.
In addition to the information requested as described below, a Respondent may submit
supplemental information that it feels may be useful in evaluating its proposal with regards to
ability to provide services to the Township. Respondents are encouraged to be clear, factual, and
concise in their presentation of information.
Respondents must provide all responses and services specified in section 2 Scope of Services.
SECTION 4
INSTRUCTIONS TO PROPOSERS
4.1
Submission of Proposals.
Proposers must submit an original and two copies of its Proposal to the Designated Contact Person:

To be responsive, Proposals must provide all requested information, and must be in strict
conformance with the instructions set forth herein:
1.
Proposals must be received by the Township no later than the Due Date, and must
be mailed or hand-delivered. Proposals forwarded by facsimile or email will not be considered.
Proposals received after the designated time on the Due Date will be returned, unopened, to the
sender. The Proposer is solely responsible for delays in delivery.

2.
Proposals and all related information must be stapled or bound, and signed by the
Proposer. If Proposer is other than a natural person, the Proposal must be signed by an individual
with power to bind the Proposer.
3.
The name of the Proposer and the position or contract for which the submission is
being made must be printed on the outside of the package containing Proposer's submission.
4.
Proposers are reminded that the Exhibits attached to this RFP must be completed
and submitted with their Proposals. Proposers also must complete and return Exhibit I, even if no
addenda have been issued. In that event, Proposers should mark Exhibit I accordingly (i.e., “No
Addenda” or “N/A”) and return the form with their Proposals.

Proposer represents that it is authorized to submit its proposal.
4.2
Legislation Compliance
Proposers are reminded of the responsibility to file an annual disclosure statement on political
contributions with the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A.
19:44A20.13 (P.L. 2005, C. 271, S.3) if contractor receives contracts in excess of $50,000.00 from public
entities in a calendar year. It is the contractor's responsibility to determine if filing is necessary. Additional
information on this requirement is available from ELEC at 888-313-3532 or at http://www.elec.state.nj.us
SECTION 5
EVALUATION
The Township's objective in soliciting Proposals is to enable it to select the Qualified Respondent
that the Township determines, in its sole discretion, will best provide high quality and cost effective Services
to the taxpayers of the Township. The Township will consider all relevant factors, including, but not limited
to:
1.
Experience similar to the Services requested in the RFP
2.
Persons who will provide the Services
3
Familiarity with the Township
4.
The Cost Proposal
5.
Proposer’s concept of the Project
6.
Other factors determined to be in the best interest of the Township.

Dear Ms. Lawful
The undersigned, as Proposer, has (have) submitted the attached Proposal in response to a Request for Proposals (RFP),
issued by the Township of East Brunswick dated in connection with the “Project”. The undersigned
hereby states:
1. The Proposal contains accurate, factual and complete information to the best of our knowledge and belief.

EXHIBIT A - MANDATORY EQUAL EMPLOYMENT OPPORTUNITY LANGUAGE PER

GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS
Throughout the performance of the Services required under this Agreement, Respondent agrees as follows:
a) The Respondent, where applicable, will not discriminate against any employee or applicant for employment
because of age, race, creed, color, national origin, ancestry, marital status or sex. Respondent will take affirmative
action to ensure that such applicants are recruited and employed, and that employees are treated during
employment, without regard to the age, race, creed, color, national origin, ancestry, marital status or sex. Such
action shall include, but not be limited to the following: employment, upgrading, demotion, or transfer; recruitment
or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for

The RESPONDENT and the TOWNSHIP OF EAST BRUNSWICK (herein referred to as the TOWNSHIP) do
hereby agree that the provisions of Title 11 of the Americans With Disabilities Act of 1990 (the “Act”) (42 U.S.C. S12101
et seq.), which prohibits discrimination on the basis of disability by public entities in all services, programs and activities
provided or made available by public entities, and the rules and regulation promulgated pursuant thereunto, are made a part
of this contract. In providing any aid, benefit, or service on behalf of the TOWNSHIP pursuant to this contract, the
RESPONDENT agrees that the performance shall be in strict compliance with the Act. In the event the RESPONDENT,
its agents, servants, employees, or subcontractors violate or are alleged to have violated the Act during the performance of
this contract, the RESPONDENT shall defend the TOWNSHIP in any action or administrative proceeding commenced
pursuant to this Act. The RESPONDENT shall indemnify, protect, and save harmless the TOWNSHIP, its agents, servants,
and employees from and against any and all suits, claims, losses, demands, or damages of whatever kind or nature arising
out of the alleged violation. The RESPONDENT shall, at its own expense, appear, defend, and pay any and, all charges for
legal services and any and all costs and other expenses arising from such action or administrative proceeding or incurred in
connection therewith. In any and all complaints brought pursuant to the TOWNSHIP’S grievance procedure, the
RESPONDENT agrees to abide by any decision of the TOWNSHIP, which is rendered pursuant to, said grievance
procedure. If any action or administrative proceeding result in an award of damages against the TOWNSHIP or if the
TOWNSHIP incurs any expense to cure a violation of the ADA which has been brought pursuant to its grievance procedure
the RESPONDENT shall satisfy an discharge the same at its own expense.
The TOWNSHIP shall, as soon as practicable after a claim has been made against it, give written notice thereof to
the RESPONDENT along with full and complete particulars of the claim. If any action or administrative proceeding is
brought against the TOWNSHIP or any of its agents, servants, and employees, the TOWNSHIP shall expeditiously forward
or have forwarded to the RESPONDENT every demand, complaint, notice, summons, pleading, or other process received
by the TOWNSHIP or its representatives.
It is expressly agreed and understood that any approval by the TOWNSHIP of the services provided by the
RESPONDENT pursuant to this contract will not relieve the RESPONDENT of the obligation to comply with the Act and
to defend, indemnify, protect, and save harmless the TOWNSHIP pursuant to this paragraph.
It is further agreed and understood that the TOWNSHIP assumes no obligation to indemnify or save harmless the
RESPONDENT, its agents, servants, employees and subcontractors for any claim which may arise out of their performance
of this Agreement. Furthermore, the RESPONDENT expressly understands and agrees that the provisions of this
indemnification clause shall in no way limit the RESPONDENT’S obligations assumed in this Agreement, nor shall they be
construed to relieve the RESPONDENT from any liability, nor preclude the TOWNSHIP from taking any other actions
