A. PROJECT BACKGROUND:
The Township of East Brunswick (“Township”) wishes to secure janitorial services at the Neilson
Parking Plaza and the Transportation and Commerce Center parking facilities.
Quotes must be received by the Township’s Designated Contact Person, via email, mail, or hand
delivery, by 11:00 a.m. prevailing time on April 8, 2026. Quotes received after 11:00 a.m. on the
Deadline Date will not be considered.

It is the Contractor’s obligation to examine and familiarize themselves with all the requirements
of this Request for Quotation prior to submitting a proposal.
B. SCOPE OF WORK:
The Township is issuing this request for quotation via a fair and open process in accordance with N.J.S.A.
19:44A-20.4 et seq.
Location: Neilson Parking Plaza [Parking Utility] – 7 days a week
7 Tower Center Boulevard
•
Dust seats, counters, and ledges nightly
•
Shake out area carpets and vacuum nightly
•
Sweep, wash, rinse, and dry lobby, elevator, and bathroom floors nightly
•
Wax floors – first Friday or Saturday of each month (after 10:00 p.m.)
•
Strip old wax from floor in January, March, June, and September, with prior notification
to the Parking Utility Supervisor
•
Wipe down edge trim to remove debris
•
All windows are to be cleaned inside and out every Tuesday
•
All glass doors that provide ingress and egress are to be cleaned nightly
•
Elevator walls and doors are to be cleaned and sanitized nightly with stainless steel
cleaner
•
Stairwell is to be walked from bottom to top, and all debris picked up and swept nightly
•
Base of stairwell is to be washed and deodorized nightly
•
Water fountain must be cleaned and sanitized nightly
•
Restrooms to be maintained twice a day as follows:
o
Once daily between 10:30 a.m. and 11:30 a.m. and again nightly after
9:00 p.m.
o
Clean toilets and urinals inside and outside
o
Clean mirrors, sinks, and counters
o
Sweep, wash, rinse, and dry floors nightly
o
Clean partitions with proper cleaners nightly

ADDITIONAL INFORMATION
1. Payment to Other Parties. The Contractor shall not obligate the Township to make any payments
to another party, nor make any promises or representations to another party for, or on behalf of the
Township, without prior written approval of the Parking Supervisor or his authorized
representative.
2. Provision of Labor, Tools, and Equipment. The Contractor agrees to furnish and pay all
necessary expenses for all labor, tools, and equipment in connection with providing Janitorial
Services pursuant to this contract.
3. Equipment and Supplies. Contractor is responsible for providing, maintaining, and transporting
all equipment and supplies in connection with rides in a safe manner in compliance with all Local,
State, and Federal rules and regulations.
4. Personnel. Contractor shall provide qualified employees to perform work required to comply
with the contractual agreement. All Contractor employees shall dress in clothing that clearly states
they are employees of the Contractor. Smoking, vaping, and consumption of alcohol are not
permitted on Township property. The contractor will ensure that all employees will refrain from
these activities while on Township property, and any violator may be removed from the facility
and face legal charges deemed appropriate by local law enforcement. The contractor must supply
at least one employee who is fluent in English and can communicate with other members of the
contractor’s crew.

5. Supervision. The Township Parking Supervisor shall have final decision-making responsibility
and shall oversee all activities.
7. Accident and Hazard Prevention. Contractor shall exercise precaution at all times and adhere to
all Federal, State, and Local rules and regulations concerning “Janitorial Services” to maintain a
safe environment for all employees and commuters. The Contractor is responsible for paying for
any damages caused to public property resulting from “Janitorial Services.”
8. Termination of Contract. The Township has cause to terminate its contract for janitorial services
if the Contractor fails to perform its obligations under the terms of this contract in a timely and
proper manner.
9. Payment for Services. Contractor shall submit an invoice and will be paid in the following
manner:
a. Upon satisfactory performance of services, the Contractor shall be paid in full following the
complete execution of services required.
b. Invoice must include all fees for supplies, equipment, and personnel and be net of all discounts
and penalties assigned or incurred by the Township.
c. Invoice must be submitted to the Parking Supervisor and shall be paid within 30 days of
completion of the event and accurate submittal of paperwork, whichever is later.
C. QUALIFICATIONS:
1. Contractor shall meet all Federal, State, and Local certifications and requirements to provide
equipment and personnel for “janitorial services.” All requirements of the Joint Insurance Fund
shall be adhered to as required, including, but not limited to, a Hold Harmless Agreement and proof
of insurance.
2. Contractor shall have a minimum of five (5) years of experience in the “Janitorial Services” field
and provide documentation indicating this experience.
3. Contractor must have 100% accident-free history in “Janitorial Services” during the past five (5)
years and provide documentation indicating this safety record.
4. Contractor must have a 100% performance rating in honoring contracts for events during the past
five (5) years and shall provide documentation indicating the successful completion of all events
during this time period.

D. FAIR AND OPEN CRITERIA:
STANDARDIZED SUBMISSION REQUIREMENTS & SELECTION CRITERIA
1. The solicitation of qualifications for any contract to be determined in excess of $17,500, and for
which a bid solicitation shall not be required under the Local Public Contracts Law shall be
advertised by the Township on the Township website at least ten (10) days prior to the date set for
the receipt of said quote. The published notice shall set forth a description of the requested goods
or services, the time, date and place that proposals must be submitted, the contact information for
obtaining a proposal document, and a statement that the proposals are being solicited through the
fair and open process, in accordance with N.J.S.A. 19:44A-20.4 et seq.
2. The Township shall review the responses to the request for quotes and appoint or award a contract
to a business entity for the goods or services advertised subsequent to such review. Contracts
awarded under this process shall be publicly announced and awarded. The resolution awarding the
contract shall state that the contract was awarded after a fair and open process and shall state the
number of responses received.
3. Contracts subject to the fair and open process delineated herein are subject to additional
Requirements and any other applicable laws including, but not limited to, the Local Public
Contracts Law.
E. SELECTION CRITERIA:
Quotations will be evaluated on the basis of the most advantageous, price and other factors considered. The
evaluation will consider:
a. Experience, technical expertise, professional execution and reputation in the field;
b. Knowledge of the Township of East Brunswick and the subject matter to be addressed under the
contract;
c. Availability to accommodate any required meetings of the Township and the ability to work well
with the Township;
d. Compensation proposal;
e. Other factors if demonstrated to be in the best interest of the Township of East Brunswick;
F.
INSURANCE REQUIREMENTS:
1. Indemnification
The contractor agrees to indemnify and save harmless the Township, its officers, agents and employees,
hereinafter referred to as indemnitees, from all suits, including attorney’s fees and costs of litigation,
actions, loss damage, expense, cost of claims, of any character or on account of any act, claim or amount
arising or recovered under Worker’s Compensation law, or arising out of failure of the Contractor or those
acting under Contractor to conform to any statutes, ordinances, regulations, law or court decree. It is the
intent of the parties to this contract that the indemnities shall, in all instances, except for loss or damage
resulting from the sole negligence of the indemnitee, be indemnified against all liability, loss or damage of
any nature whatsoever.

2. Insurance Requirements:
A. Worker’s Compensation and Employer’s Liability Insurance
This insurance shall be maintained in full force during the life of this contract by the contractor covering
all employees engaged in performance of this contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C.
12:235-1.6. Minimum Employer’s Liability $1,000,000.00.
B. General Liability Insurance
This insurance shall have limits of not less than $3,000,000.00 any one person and $3,000,000.00 any
one accident for bodily injury and $3,000,000.00 aggregate for property damage and shall be
maintained in force during the life of the contract.
C. Automobile Liability Insurance
This insurance covering contractor for claims arising from owned, hired and non-owned vehicles with
limits of not less than $3,000,000.00 any one person and $3,000,000.00 any one accident for bodily
injury and $3,000,000.00 each accident for property damage, shall be maintained in force during the
life of this contract by the contractor.
D. Professional Liability/Malpractice Insurance Policy (if applicable)
Coverage in the amount of $2,000,000.00/occurrence, $4,000,000.00 aggregate and assurance that each
such policy for each staff member remains full and in effect while providing services for Township.
The contractor shall provide the Township with a Certificate of Insurance naming the Township of East
Brunswick as additionally insured, evidencing the existence of required insurance prior to the
commission of work. Rain Date shall also be shown on the description section of the Certificate of
Insurance. Said insurance must include coverage for complete operations, contractual insurance and
independent contractor or subcontractor insurance, where and if applicable.
E. Errors and Omissions Insurance
a. The contractor shall purchase and maintain during the entire period of this contract, errors and
omissions insurance that shall protect the contractor and the Township from any and all claims
that may arise out of or result from the contractor’s performance of this contract. Specifically,
the errors and omissions insurance shall have limits of not less than $2,000,000.00 dollars per
occurrence and $4,000,000.00 dollars in the aggregate.
b. Certificates of the Required Insurance
Certificates as listed above shall be submitted along with the contract as evidence covering
Errors and Omissions insurance. Such coverage shall be with acceptable insurance companies
operating on an admitted basis in the State of New Jersey.
The contractor shall provide the Township with a Certificate of Insurance naming the
Township, its employees, officers, and agents as additionally insured, and evidencing the
existence of required insurance prior to the commission of work.
The Township will not accept Mutual Limitation of Liability terms.

F. OTHER REQUIREMENTS:
Proof of N.J. Business Registration Certificate N.J.S.A. 52:32-44
Pursuant to N.J.S.A. 52:32-44, the Township is prohibited from entering into a contract with an entity unless
the bidder/respondent/contractor, and each subcontractor that is required by law to be named in a
bid/proposal/contract has a valid Business Registration Certificate on file with the Division of Revenue and
Enterprise Services within the Department of the Treasury.
Prior to contract award or authorization, the contractor shall provide the Contracting Agency with its proof
of business registration and that of any named subcontractor(s).
Subcontractors named in a bid or proposal shall provide proof of business registration to the bidder, who in
turn, shall provide it to the Contracting Agency prior to the time of contract, purchase order, or other
contracting document is awarded or authorized.
During the course of contract performance:
(1) The contractor shall not enter into a contract with a subcontractor unless the subcontractor first
provides the contractor with a valid proof of business registration.
(2) The contractor shall maintain and submit to the Contracting Agency a list of subcontractors and
their addresses that may be updated from time to time.
(3) The contractor and any subcontractor providing goods or performing services under the
contract, and each of their affiliates, shall collect and remit to the Director of the Division of
Taxation in the
Department of Treasury, the use tax due pursuant to the Sales and Use Tax Act, (N.J.S.A. 54:32B-
1 et seq.) on all sales of tangible personal property delivered in the State. Any questions in this

Before final payment is made under the contract, the contractor shall submit to the Contracting Agency a
complete and accurate list of all subcontractors used and their addresses. Pursuant to N.J.S.A. 54:49-4.1, a
business organization that fails to provide a copy of a business registration as required, or that provides
false business registration information, shall be liable for a penalty of $25.00 for each day of violation, not
to exceed $50,000, for each proof of business registration not properly provided under a contract with a
contracting agency.

Notice of Disclosure Requirement
Township Ordinance No. 06-13 Establishing Restrictions on the Award of Contracts to Professional Entities
and Certain Other Entities Who Make Certain Political Contributions, and pursuant to Section 3 (a) thereof,
requires that Respondents that provide quotations in excess of $17,500 confirm that they have not made
any contributions in violation of Section 1 of Ordinance No. 06-13.

H. PAYMENT AND CONTRACT TERM
The Contractor shall invoice the Township’s Clerk’s Office annually for the services provided. The
contract period shall be for two (2) years, commencing from the date the contract was awarded, with the
option of two (2) one-year contract renewals, considering mutual agreement by both parties, expiring
April 1,2028. The renewal of the contract must be approved by resolution.
EXHIBIT A
MANDATORY EQUAL EMPLOYMENT OPPORTUNITY LANGUAGE PER
N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1.1 et seq.
GOODS, PROFESSIONAL SERVICE AND GENERAL SERVICE CONTRACTS
During the performance of this contract, the contractor agrees as follows:
The contractor or subcontractor, where applicable, will not discriminate against any
employee or applicant for employment because of age, race, creed, color, national origin, ancestry,
marital status, affectional or sexual orientation, gender identity or expression, disability,
nationality or sex. Except with respect to affectional or sexual orientation and gender identity or
expression, the contractor will take affirmative action to ensure that such applicants are recruited
and employed, and that employees are treated during employment, without regard to their age,
race, creed, color, national origin, ancestry, marital status, affectional or sexual orientation, gender
identity or expression, disability, nationality or sex. Such action shall include, but not be limited
to the following: employment, upgrading, demotion, or transfer; recruitment or recruitment
advertising; layoff or termination; rates of pay or other forms of compensation; and selection for
training, including apprenticeship. The contractor agrees to post in conspicuous places, available
to employees and applicants for employment, notices to be provided by the Public Agency
Compliance Officer setting forth provisions of this nondiscrimination clause.
The contractor or subcontractor, where applicable will, in all solicitations or advertisements
for employees placed by or on behalf of the contractor, state that all qualified applicants will
receive consideration for employment without regard to age, race, creed, color, national origin,
ancestry, marital status, affectional or sexual orientation, gender identity or expression, disability,
nationality or sex.
The contractor or subcontractor, where applicable, will send to each labor union or
representative or workers with which it has a collective bargaining agreement or other contract or
understanding, a notice, to be provided by the agency contracting officer advising the labor union
or workers' representative of the contractor's commitments under this act and shall post copies of
the notice in conspicuous places available to employees and applicants for employment.
The contractor or subcontractor, where applicable, agrees to comply with any regulations
promulgated by the Treasurer pursuant to N.J.S.A. 10:5-31 et seq., as amended and supplemented
from time to time and the Americans with Disabilities Act.

The contractor or subcontractor agrees to make good faith efforts to employ minority and
women workers consistent with the applicable county employment goals established in accordance
with N.J.A.C. l7:27-5.2, or a binding determination of the applicable county employment goals
determined by the Division, pursuant to N.J.A.C. 17:27-5.2.
The contractor or subcontractor agrees to inform in writing its appropriate recruitment
agencies including, but not limited to, employment agencies, placement bureaus, colleges,
universities, labor unions, that it does not discriminate on the basis of age, creed, color, national
origin, ancestry, marital status, affectional or sexual orientation, gender identity or expression,
disability, nationality or sex, and that it will discontinue the use of any recruitment agency which
engages in direct or indirect discriminatory practices.
The contractor or subcontractor agrees to revise any of its testing procedures, if necessary,
to assure that all personnel testing conforms with the principles of job-related testing, as
established by the statutes and court decisions of the State of New Jersey and as established by
applicable Federal law and applicable Federal court decisions.
In conforming with the applicable employment goals, the contractor or subcontractor agrees
to review all procedures relating to transfer, upgrading, downgrading and layoff to ensure that all
such actions are taken without regard to age, creed, color, national origin, ancestry, marital status,
affectional or sexual orientation, gender identity or expression, disability, nationality or sex,
consistent with the statutes and court decisions of the State of New Jersey, and applicable Federal
law and applicable Federal court decisions.
The contractor shall submit to the public agency, after notification of award but prior to
execution of a goods and services contract, one of the following three documents:

The contractor and its subcontractors shall furnish such reports or other documents to the

investigation pursuant to Subchapter 10 of the Administrative Code at N.J.A.C. 17:27-1.1 et

AMERICANS WITH DISABILITIES ACT OF 1990
EQUAL OPPORTUNITY FOR INDIVIDUALS WITH DISABILITIES
The RESPONDENT and the TOWNSHIP OF EAST BRUNSWICK (herein referred to as
the TOWNSHIP) do hereby agree that the provisions of Title 11 of the Americans With Disabilities
Act of 1990 (the “Act”) (42 U.S.C. S12101 et seq.), which prohibits discrimination on the basis of
disability by public entities in all services, programs and activities provided or made available by
public entities, and the rules and regulation promulgated pursuant thereunto, are made a part of
this contract. In providing any aid, benefit, or service on behalf of the TOWNSHIP pursuant to
this contract, the RESPONDENT agrees that the performance shall be in strict compliance with
the Act. In the event the RESPONDENT, its agents, servants, employees, or subcontractors violate
or are alleged to have violated the Act during the performance of this contract, the RESPONDENT
shall defend the TOWNSHIP in any action or administrative proceeding commenced pursuant to
this Act. The RESPONDENT shall indemnify, protect, and save harmless the TOWNSHIP, its
agents, servants, and employees from and against any and all suits, claims, losses, demands, or
damages of whatever kind or nature arising out of the alleged violation. The RESPONDENT shall,
at its own expense, appear, defend, and pay any and, all charges for legal services and any and all
costs and other expenses arising from such action or administrative proceeding or incurred in
connection therewith. In any and all complaints brought pursuant to the TOWNSHIP’S grievance
procedure, the RESPONDENT agrees to abide by any decision of the TOWNSHIP, which is
rendered pursuant to, said grievance procedure. If any action or administrative proceeding result
in an award of damages against the TOWNSHIP or if the TOWNSHIP incurs any expense to cure
a violation of the ADA which has been brought pursuant to its grievance procedure the
RESPONDENT shall satisfy and discharge the same at its own expense.
The TOWNSHIP shall, as soon as practicable after a claim has been made against it, give
written notice thereof to the RESPONDENT along with full and complete particulars of the claim.
If any action or administrative proceeding is brought against the TOWNSHIP or any of its agents,
servants, and employees, the TOWNSHIP shall expeditiously forward or have forwarded to the
RESPONDENT every demand, complaint, notice, summons, pleading, or other process received
by the TOWNSHIP or its representatives.
It is expressly agreed and understood that any approval by the TOWNSHIP of the services
provided by the RESPONDENT pursuant to this contract will not relieve the RESPONDENT of
the obligation to comply with the Act and to defend, indemnify, protect, and save harmless the
TOWNSHIP pursuant to this paragraph.

It is further agreed and understood that the TOWNSHIP assumes no obligation to
indemnify or save harmless the RESPONDENT, its agents, servants, employees and
subcontractors for any claim which may arise out of their performance of this Agreement.
Furthermore, the RESPONDENT expressly understands and agrees that the provisions of this
indemnification clause shall in no way limit the RESPONDENT’S obligations assumed in this
Agreement, nor shall they be construed to relieve the RESPONDENT from any liability, nor
preclude the TOWNSHIP from taking any other actions available to it under any other provisions
of this Agreement or otherwise at law.
