THIRD PARTY ADMINISTRATOR SERVICES

The City of East Orange, New Jersey, is soliciting competitive proposals from qualified firms and individuals to provide comprehensive Third-Party Administrator (TPA) Services for a three-year term, with an option for two one-year extensions. This critical engagement involves managing claims and litigation directed against the City, its officers, and employees, encompassing a broad spectrum of legal matters. The extensive scope of work includes handling cases under the Tort Claims Act (N.J.S.A. 59:1-1 et seq.), the Conscientious Employee Protection Act (CEPA, N.J.S.A. 34:19-1 et seq.), the Law Against Discrimination (LAD, N.J.S.A. 10:5-1 et seq.), 42 U.S.C. sec. 1983 actions, and various contract and governmental challenges. Furthermore, the selected TPA will be responsible for managing Workers’ Compensation claims and lawsuits (N.J.S.A. 34:15-1 et seq.), alongside robust Safety and Risk Management activities. Key deliverables also include client education, timely and thorough claim investigations, management of medical and legal/litigation issues, professional and general liability management, and providing risk and safety management reports to control costs and reduce exposure, including regulatory compliance and accident analysis. Prospective contractors must demonstrate substantial expertise in providing full-service Third-Party Administration, supported by a proven track record representing municipal entities. Respondents are required to comply with various New Jersey statutes, including N.J.S.A. 10:5-31 et seq. (Affirmative Action), N.J.A.C. 17:27 et seq. (Contract Compliance and Equal Employment Opportunities), and N.J.S.A. 52:25-24.2 (Disclosure of Ownership). Firms must possess appropriate federal and state licenses to perform the specified activities and provide references from at least three municipalities of comparable size and complexity to East Orange. Detailed resumes of key personnel and a description of the firm's overall experience in similar services are mandatory. A highly recommended pre-proposal conference is scheduled for Tuesday, June 25, 2024, at 11:00 AM, in the Municipal Council Chamber, located at 44 City Hall Plaza, East Orange, NJ 07018, providing an essential opportunity for clarification and engagement with City representatives. Sealed proposals must be submitted to the City of East Orange's Purchasing Agent no later than Tuesday, July 9, 2024, at 11:00 AM. Submissions must be delivered to the Municipal Council Chamber, Municipal Building, 44 City Hall Plaza, East Orange, NJ 07018. The submission package must include one (1) original, two (2) copies, and an additional copy provided on a USB. Envelopes must be clearly marked "THIRD PARTY ADMINISTRATOR SERVICES" and addressed to the Purchasing Agent. A non-refundable fee of $25.00 is required for RFP packets picked up on-site, payable to the City of East Orange. All proposals will remain firm for a period of sixty (60) days after the submission date. While no bid security is mentioned, respondents must commit to maintaining professional liability insurance with limits of $1,000,000 per occurrence and $3,000,000 aggregate.
