THIRD PARTY ADMINISTRATOR SERVICES COMPETITIVE CONTRACT RFP

The City of East Orange, through its Department of Business Administration, Division of Procurement, is soliciting proposals for comprehensive Third-Party Administrator (TPA) Services. This competitive contract (RFP) seeks qualified individuals or firms to manage and administer claims and litigation filed against the City, its officers, and employees. The extensive scope of work encompasses handling claims under the Tort Claims Act (N.J.S.A. 59:1-1 et seq.), the Conscientious Employee Protection Act (CEPA, N.J.S.A. 34:19-1 et seq.), the Laws Against Discrimination (LAD, N.J.S.A. 10:5-1 et seq.), 42 U.S.C. sec. 1983 actions, contract disputes, challenges to governmental actions, and Workers' Compensation claims (N.J.S.A. 34:15-1 et seq.). The selected TPA will also be responsible for critical Safety and Risk Management activities, including client education, timely and comprehensive investigation of claims, management of medical and legal/litigation issues, and professional and general liability oversight. Key deliverables include analyzing claims experience, providing reports to City representatives, and implementing proven programs to aggressively manage healthcare costs associated with workers' compensation. Prospective contractors must demonstrate substantial expertise in providing full-service TPA services, meeting stringent professional, administrative, and financial qualifications. Mandatory compliance requirements include N.J.S.A. 10:5-33 et seq. (Affirmative Action), N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq. (Contract Compliance and Equal Employment Opportunities), and N.J.S.A. 52:25-24.2 (Disclosure of Ownership). Contractors are required to maintain Professional Liability insurance with minimum limits of $1,000,000 per occurrence and $3,000,000 aggregate. Respondents must provide a detailed qualification statement outlining their overall experience, including references from at least three municipalities of similar size and complexity to East Orange, resumes of key personnel, and confirmation of appropriate federal and state licenses. A highly recommended pre-proposal conference is scheduled for Thursday, April 11, 2019, at 1:00 PM, to be held in the Municipal Council Chamber at 44 City Hall Plaza, East Orange, NJ 07018. Sealed RFP responses must be submitted by Thursday, April 25, 2019, at 1:00 PM. Submissions require one (1) original and four (4) copies, enclosed in a sealed envelope clearly marked "THIRD PARTY ADMINISTRATOR SERVICES," and addressed to the Purchasing Agent at the City of East Orange, Division of Procurement, 44 City Hall Plaza, East Orange, NJ 07018. Proposals are to remain firm for a period of sixty (60) days after the submission deadline. The resulting contract term is for three (3) years, with the option for two (2) additional one-year extensions, with adjustments based on the New Jersey "Index Rate."
