PUBLIC NOTICE
Notice to Bidders
Bids received on May 24, 2017 Borough of Elmer
Notice is hereby given that sealed bids will be received
by Borough of Elmer, for the "REPAINTING AND REPAIR OF THE
ELMER BOROUGH WATER STORAGE TOWER", in the Borough of
Elmer, County of Salem, opened and read in public at the El-
mer Borough Clerk's Office located at 120 South Main Street,
Elmer, New Jersey 08318, on May 24, 2017 at 11:00 AM, pre-
vailing time. Specifications and forms of bids for the proposed
work, prepared by Carl R. Gaskill, PE, PLS, PP & CME of
Fralinger Engineering PA and have been filed in said Engi-
neer's office at 629 Shiloh Pike, Bridgeton NJ 08302 and may
be inspected by prospective bidders during business hours.
Bidders will be furnished with a copy of the specifications by
the Engineer on proper notice and prepayment of a non-
refundable fee of $150.00 for cost of reproduction. Bids must
be made on standard proposal forms in the manner designat-
ed therein required by the Specifications, must be enclosed in
sealed envelopes bearing the name and address of bidder and
name of project on outside and addressed to the Borough of
Elmer and must be accompanied by a Non-Collusion Affidavit
and a Certified Check or Bid Bond for not less than ten percent
(10%) of the total amount bid, provided said check need not
be more than $20,000 nor shall not be less than $500 and be
delivered at the place on or before the hour named above.
Consent of Surety from an approved Surety Company
must also be submitted with the Bid. Please be advised that
any bidder who fails to submit a "Consent of Surety" with the
bid can anticipate that the bid submitted will be automatically
rejected.
No exception to this policy will be made. The standard
proposal form and the Non-Collusion Affidavit are attached to
the supplementary specifications; copies of which will be fur-
nished on application to Engineer.
All applicable surety bonds required in connection with
the advertisement and award of building contracts or
subagreements must be written by a surety company listed on
the Federal Treasury List (Department Circular 57 0 - Surety
Companies Acceptable on Federal Bonds), incorporated herein
by reference.
This contract or subcontract is expected to be funded in
part with funds from the New Jersey Department of Environ-
mental Protection and the New Jersey Environmental Infra-
structure Trust. Neither the State of New Jersey, the New Jer-
sey Environmental Infrastructure Trust nor any of their depart-
ments, agencies or employees is, or will be, a party to this con-
tract or subcontract or any lower tier contract or subcontract.
This contract or subcontract is subject to the provisions of
N.J.A.C. 7:22-3, 4, 5, 9 and 10.
This project or contract is funded in part by New Jersey
environmental infrastructure financing programs and the suc-
cessful bidder must comply with the provisions of N.J.A.C.
7:22-9 for the participation of small business enterprises
owned and controlled by socially and economically disadvan-
taged individuals.
The Borough of Elmer reserves the right to reject any or
all bids either in whole or in part and also to waive any infor-
mality in any bid or bids so received.
The award of Contract shall be made subject to the nec-
essary monies to do the work being provided by the Borough
in a lawful manner. The award shall further be subject to the
securing of any necessary State, Federal or Local permits gov-
erning the work.
The Contractor must comply with the provisions of the
New Jersey Public Contracts Law 1975, Chapter 127, Affirma-
tive Action NJAC 17:27 and New Jersey Public Law 1977, Chap-
ter 33, Ownership Statement and must submit an Affirmative
Action plan approved by the State Treasurer before a Contract
may be awarded and proof of such plan to be submitted with
bid, if required. If awarded a contract, your company/firm will
be required to comply with the requirements of N.J.S.A. 10:5-
31 et seq. and N.J.A.C. 17:27.
The Contractor is further notified that he must comply
with requirements of P.L. 1977, Chapter 33 and submit a Dis-
closure Statement listing stockholders with his bid.
The Contractor must comply with the bid Proof of Busi-
ness Registration pursuant to P.L. 2009, c.315. Please be ad-
vised any bidder who fails to comply with the Contractors
Proof of Business Registration requirement can anticipate that
the bid submitted will be rejected.
The Contractor must be a Registered New Jersey Public
Works Contractor.
