TOWNSHIP OF FREEHOLD
NOTICE TO BIDDERS
A N O T I C E I S H E R E B Y G I V E N that sealed Bid Packets will be received by the Purchasing
Agent of the Township of Freehold, County of Monmouth, State of New Jersey on Thursday, May 1, 2025 at
11:00 am prevailing time at the Township of Freehold Municipal Building, One Municipal Plaza, Freehold,
New Jersey 07728, at which time and place the Bid Packets will be publicly unsealed and its contents
announced in public for the 2025 PAVEMENT OVERLAY PROGRAM.
The scope of Work contemplated for the above-named Project includes roadway rehabilitation as well as
all other Work of any type or description necessary for contemplation of the Project, whether or not
specifically described in these Contract Documents. All Work on this Contract shall be completed within
90 Calendar Days from Notice to Proceed.
Contract Documents and Plans for the proposed Work are available at the Purchasing Office of the
Township of Freehold at 1 Municipal Plaza, Freehold, New Jersey 07728 and may be inspected by prospective
Bidders during business hours. Bidders will be furnished with a copy of the Contract Documents upon proper
notice and payment of a non-refundable charge of One Hundred and Twenty- Six Dollars ($126.00) payable
to: “The Township of Freehold" at the offices of the Township of Freehold to defray the cost thereof.
The provided Bid Packet must be completed in the manner designated in the Contract Documents, must be
enclosed in a sealed envelope bearing the name and address of the Bidder and the name of the Project on the
outside and must be addressed to the Township of Freehold – c/o the Purchasing Agent. Also, Bid Packets
must be accompanied by a Statement of Consent of Surety from a surety company holding a Certificate of
Authorization to do business in the State of New Jersey and either a Bid Bond or a Certified Check drawn to
the order of The Township of Freehold for not less than ten percent (10%) of the total bid price amount, except
that the check shall not exceed $20,000.00. The successful Bidder is hereby notified that a Performance and for
the full amount of this Project is required.
The award of the Contract for this Project will not be made until the necessary funds have been provided
by the Township of Freehold in a lawful manner. Please be advised that this Project is being funded through
the Township of Freehold. By virtue of Executive Order #34 (1976), vendors currently suspended, debarred or
disqualified are excluded from participating on this Project.
The successful Bidder shall be required to comply with the applicable statutory requirements of the
Contract Documents and Plans which include all of the following: (i) N.J.A.C. 17:27; (ii) N.J.S.A. 10:5-31 et
seq.; (iii) Business Registrations (N.J.S.A. 52:32-44); (iv) Prevailing Wage Act (N.J.S.A. 34:11-56.25, et seq.); (v)
Public Work Contractor Registration (N.J.S.A. 34:11-56.48); and (vi) Affirmative Action Requirements (N.J.S.A.
10:5-1, et seq.); and any other legal requirements applicable to this Project.
The Township of Freehold intends to award this Project to the lowest Bidder whose Bid Packet is
responsive and complies with its requirements for the Project, provided that in the judgment of the Township
of Freehold is reasonable, within available funds and in the interest of the Township of Freehold. The
Township of Freehold reserves the right to reject any and all Bid Packets to the extent permitted by law. An
award will be made or Bid Packets will be rejected within sixty (60) Calendar Days after the opening of the
Bid Packets, during which time the Bid Packets shall be irrevocable and unavailable to withdraw by Bidders,
unless otherwise extended in the Contract Documents.
The contract shall not be approved until a favorable eligibility determination has been made by the New
Jersey Department of Transportation.
