NOTICE TO BIDDERS
NOTICE is hereby given that sealed bids will be received by the Township of Freehold (hereinafter called
the "Owner") for:
RACEWAY MALL WATER STORAGE TANK REHABILITATION
CONTRACT NO. 24-12
Sealed bids for the above-named Contract within the Township of Freehold, Monmouth County, New
Jersey (“Owner”), will be received at the Administration Building, Room 214, 1 Municipal Plaza, Freehold,
New Jersey 07728 on Thursday, September 19, 2024 at 11:00 a.m. prevailing time, at which time they
will be publicly unsealed, and the contents publicly announced. The Township of Freehold is open to the
public and is fully operational.
The work includes the furnishing of all labor, materials, and equipment necessary to complete the work
as shown on the Drawings and as described in the Specifications. The work generally consists of tank
interior and exterior coating system removal and preparation for application of a high performance
coating, blasting, debris and lead hazard control and containment and disposal, minor tank repairs, tank
interior and exterior application of high performance coating systems, and all testing, restoration and
cleanup. The work is located at the Raceway Mall Water Storage Tank site located along Trotters Way in
Freehold Township, NJ. Work ultimately includes rehabilitation of the existing 3-million-gallon Raceway
Mall water storage tank inclusive of work necessary to complete the project. The work shall be completed
within 120 consecutive calendar days of the Contractor’s receipt of written Notice to Proceed. Substantial
completion of work shall be within 90 consecutive calendars days of the Contractor’s receipt of written
Notice to Proceed.
No bid will be received unless in writing on the forms furnished, and unless accompanied by bid security
in the form of a bid bond, cashier's check, or a certified check made payable to the Township of Freehold
in an amount equal to 10% of the amount of the total bid, but not exceeding $20,000.
The bid shall be accompanied by a Certificate of Surety on the form included in the Contract Documents,
from a surety company licensed to do business in the State of New Jersey, which shall represent that the
surety company will provide the Contractor with the required bonds in the sums required in the Contract
Documents and in a form satisfactory to the Owner’s Attorney and in compliance with the requirements
of law.
Bidders must use the prepared bid form which is contained in the Contract Documents. Each individual
proposal must be separately enclosed in a sealed envelope addressed to the Administration Building, 1

Municipal Plaza, Freehold, New Jersey 07728 marked on the outside with the number of the contract
and name of the project being bid upon.
No bids will be received after the time and date specified, and no bids will be received by mail. Bids shall
be received by courier service (date and time recorded) or shall be hand delivered. The Owner shall award
the Contract or reject all bids within 60 days of bid opening, except that the bids of any bidders who
consent thereto may, at the request of the Owner, be held for consideration for such longer period as
may be agreed.
The Owner will evaluate bids and any award will be made to the lowest, responsive, responsible bidder
in accordance with N.J.S.A. 40A:11-4. The Owner reserves the right to reject any or all bids and to waive
minor informalities or irregularities in bids received in accordance with public law.
The qualification and reclassification of bidders will be subject to the statutory provisions contained in
N.J.S.A. 40A:11-25 to 32 (“Local Public Contract Law”).
All bid security except the security of the three apparent lowest responsible bidders shall be returned,
unless otherwise requested by the bidder, within ten (10) days after the opening of the bids, Sundays and
holidays excepted, and the bids of the bidders whose bid security is returned shall be considered
withdrawn.
Each bidder must submit with his bid a signed certificate stating that they own, lease or control all the
necessary equipment required to accomplish the work shown and described in the Contract Documents.
Should the bidder not be the actual owner or lease of such equipment, his certificate shall state the source
from which the equipment will be obtained and, in addition, shaft be accompanied by a signed certificate
from the owner or person in control of the equipment definitely granting to the bidder the control of the
equipment required during such time as may be necessary for the completion of that portion of the Contract
for which it is necessary. The bidder shall comply with the documentation requirements set forth in the
Article of the Information for Bidders, entitled: “Bidder Submissions”.
The successful bidder will be required to submit bonds and proof of insurance on or before execution of
their respective Contracts as explained in the Contract Documents.
Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regulations including
but not limited to the applicable provisions of Title VI of the Civil Rights Act of 1964, as amended (42 USC
2000d-2000D-4A), the discrimination and affirmative action provisions of N.J.S.A. 10:2-1 through 10:2-4,
the New Jersey Law against Discrimination, N.J.S.A. 10:5-1, et seq., the rules and regulations promulgated
pursuant thereto, the State requirement for bidders to supply statements of ownership (N.J.S.A. 52:25-
24.2) and the State requirement for submission of the names and addresses of certain subcontractors
(N.J.S.A. 40A:11-16).
The Contract Documents may be obtained by any prospective bidder by sending a request via email to
Mr. Matthew Voelkel, PE, Project Manager, matthew.voelkel@fpaengineers.com requesting a PDF copy
of the specifications and drawings which will be sent to the perspective bidder via email. Alternatively,
perspective bidders may pick up hardcopies of the Contract Documents upon payment of a non-
refundable fee of $75.00 for each set of specifications and drawings at the Office of the Engineer, French
& Parrello Associates, 1800 Route 34, Suite 101, Wall Township, NJ 07719. Bid documents cannot be
obtained at the Township of Freehold Municipal Building.

Pursuant to N.J.S.A. 10:5-31 et seq., bidders are required to comply with the requirements of N.J.A.C.
17:27.
Each Bidder must submit with his/her bid an “Ownership Disclosure Statement” and is requested to
submit with his bid the “Non-Collusion Affidavit” on the forms included in the Contract Documents.
Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works
Contractor Registration Act (N.J.S.A. 34:11-56.48) and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-
56.25).
Pursuant to N.J.S.A. 52:32-44, all business organizations that conduct business with a New Jersey
government agency are required to be registered with the State of New Jersey. Bidders and their
subcontractors must submit proof that they are registered with the New Jersey Department of Treasury,
Division of Revenue by submitting a copy of their Business Registration Certificate prior to Contract award.
It is the purpose of this to summarize some of the more important provisions of the Contract Documents.
Prospective bidders are cautioned not to rely solely on this summary, but to read the Contract Documents
in their entirety.

advised that it is the Township’s policy not to respond to Questions and Comments which bidders can
readily resolve through reading the Contract Documents. Please note that the date for receipt of bids

SCOPE OF CONTRACT – ADDENDUM NO. 1
The project will rehabilitate the Freehold Township Raceway Mall Tank Water Storage Tank which is a 3-
million-gallon (MG) standpipe, constructed in 1988 with a diameter of 75-feet and height of 91-feet. The
work will include interior and exterior preparation, removal of existing coating systems including lead
paint removal, installation, protection and maintenance of proper containment system for paint and
debris, lead containment, and lead hazard mitigation as required. The work includes, replacing the
cathodic protection system. The work includes replacing the grout between the floor plate and
foundation. An OSHA approved flexible cable fall prevention device is included in the work.
Work includes all general construction work necessary to complete the water storage tank rehabilitation.
The work shall be completed within 120 consecutive calendar days of the Contractor's receipt of written
Notice to Proceed. Substantial completion of water storage tank rehabilitation work shall be within 90
consecutive calendars days of the Contractor’s receipt of written Notice to Proceed. Refer to Specification
Section 1130 “Special Conditions” Part 1.02 for the sequence of construction activities.
All work included on the Drawings and in the Specifications shall be completed in full without further
compensation than is provided for in the lump sum prices regardless of whether or not such work is
specifically mentioned in the Scope of Contract Items which follow. The Contractor shall exercise caution
in performing the Work and shall protect existing site features and facilities from damage.
Brief general descriptions of the various components of the work are set forth. All work included on the
Drawings and in the Specifications shall be completed in full without further compensation than is
provided for in the Lump Sum Price regardless of whether or not such work is specifically mentioned in
the Scope of Contract Items following.
Although the contract is a single overall construction contract, the Specifications describe construction
operations in various standard broad work categories. Site improvements shall include general work,
selective demolition, furnish and installation of tank repairs, soil erosion and sediment control measures,
vegetative stabilization, and final restoration.
Mobilization costs shall be payable in accordance with N.J.A.C. 7:14-2.9. The cost of mobilization will be
paid in equivalent monthly amounts over the entire project.
SC1.00 Work Included in Base Bid Items 1.00 For Complete Interior Tank Rehabilitation Including
Cleaning, Metal Preparation, and High Performance Coating
The work includes the furnishing of all labor, materials, and equipment necessary to complete the work
as shown on the Drawings and as described in the Specifications. The work generally consists of tank
interior preparation and cleaning, removal of debris and material from interior of tank, minor tank interior
repairs, tank interior application of a high performance coating system, disinfection, and testing. This
item shall also include replacement of the existing cathodic protection with a complete and operational

Work Included in Base Bid Item 2.00: For Complete Exterior Tank Rehabilitation Including
Repairs, Metal Preparation, Lead Hazard Control, and High Performance Coating
The work includes the furnishing of all labor, materials, and equipment necessary to complete the work
as shown on the Drawings and as described in the Specifications. The work generally consists of tank
exterior preparation, minor tank repairs, welding six (6) 6-inch diameter steel plates to the tank roof, and
tank exterior application of a high performance coating system. The work will include exterior
preparation, lead paint removal, lead containment, and lead hazard mitigation. The work includes
replacing the grout between the floor plate and foundation, furnishing and installing safety climb device
on all ladders, overflow pipe flap gate, valve vault ventilation pipe screen replacement, self-closing swing
gate at tank ladder transition to roof, standoffs for existing cables, and replacement of 24” shell manhole
with a 30” shell manhole.

Work Included in Base Bid Item 3.00: For Complete Valve Vault Piping Preparation and High
Performance Coating
The work includes the furnishing of all labor, materials, and equipment necessary to complete the work
as shown on the Drawing and as described in the Specifications. The work generally consist of valve
vault piping preparation and high performance coating application.

Work Included in Base Bid Item 4.00: Allowance for Unforeseen Conditions
In general, this allowance is reserved for unforeseen conditions that may be identified during the
construction or additional work required that has not been identified or specified in the base contract.
Should the Contractor encounter an unforeseen condition, he shall immediately notify the Engineer in
writing so that the Engineer and Owner can confirm that the encountered condition is unforeseen. Should
the Owner and Engineer agree that the encountered condition is unforeseen and determine that there is
a changed condition justifying changes in contract values, the Contractor shall provide the Owner and
Engineer with a cost breakdown of equipment, labor, and materials to evaluate the unforeseen condition
value and determine whether it is to be applied to this Item. The cost breakdown shall be of sufficient
detail for the Owner and Engineer to evaluate the value of the work. The Contractor shall cooperate in
full to provide detailed and back-up invoicing supporting any of his/her proposed pricing.

Work Included in Base Bid Item 5.00: Allowance for Antenna Relocation
This allowance includes the furnishing of all labor, materials, and equipment necessary to complete the
work as shown on the Drawings and as described in the Specifications. This allowance is reserved for the
temporary relocation of all existing three (3) antennas and appurtenances on the water storage tank to
the scaffolding, maintaining antenna systems operational during the rehabilitation work, and the
reinstallation, testing, and startup of existing antennas and appurtenances on the water storage tank after
tank rehabilitation work is complete.

The New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25 et seq.) requires that the Department of Labor and Workforce
Development establish and enforce a prevailing wage level for workers engaged in public works in order to safeguard
their efficiency and general well being and to protect them as well as their employers from the effects of serious and
unfair competition.
Prevailing wage rates are wage and fringe benefit rates based on the collective bargaining agreements established for a
particular craft or trade in the locality in which the public work is performed.
In New Jersey, these rates vary by county
and by the type of work performed.
Applicable prevailing wage rates are those wages and fringe benefits in effect on the date the contract is awarded.
All
pre-determined rate increases listed at the time the contract is awarded must also be paid, beginning on the dates specified.
Rates that have expired will remain in effect until new rates are posted.
Prevailing Wage Rate
The prevailing wage rate for each craft will list the effective date of the rate and the following information:

B = Fringe Benefit Rate per Hour*
T = Total Rate per Hour

Fringe benefits are an integral part of the prevailing wage rate.
Employers not providing such benefits must
pay the fringe benefit amount directly to the employee each payday.

Unless otherwise stated in the Prevailing Wage Rate Determination, the fringe benefit rate for overtime
hours remains at the straight time rate.

"inclusive of benefits," the benefit rate is increased by the same factor as the wage rate (i.e. multiplied by
1.5 for time and one-half, multiplied by 2 for double time, etc.).
Apprentice Rate Schedule
An “apprentice” is an individual who is registered with the United States Department of Labor - Office of Apprenticeship
and enrolled in a certified apprenticeship program during the period in which they are working on the public works
project.
The apprentice wage rate is a percentage of the journeyman wage rate, unless otherwise indicated.
The apprentice benefit
rate is the full journeyman benefit rate, unless otherwise indicated.
If there is no apprentice rate schedule listed, the individual must be paid at least the journeyman rate even if that
individual is in a certified apprentice program for that trade.
If there is no ratio of apprentices to journeymen listed for a particular craft, then the ratio shall be one (1) apprentice to
every four (4) journeymen.

- When a three shift schedule is established, all three shifts shall be established on an 8 hour basis, but the second and
third shifts shall receive an additional 113% of the wage rate.

The regular workday consists of 8 hours, Monday to Friday, between 6:00 AM and 5:30 PM.
SHIFT DIFFERENTIALS:
- Shift work must be established for 5 consecutive workdays.
- Any work started outside of the allowed start time, 6:00 AM to 9:00 AM, except for * tidal work, shall be considered an irregular shift
and paid at straight time, plus 15% for the first eight hours, inclusive of benefits.
- * FOR TIDAL WORK- a contractor can start their job according to tide schedules (tide schedules are the various high and low tides
related to this work), providing the eight hour shift is completed between the hours of 5:00 AM and 6:30 PM.
- All time worked in excess of an established shift (an established shift is a shift that is determined at the time of the bid) shall be paid at
the applicable overtime rate. When a portion of an established shift works into Saturday, Sunday or a holiday, that time worked shall be
paid at the established shift rate.
- When working with other trades who receive a higher irregular shift differential, these employees shall also receive the higher
differential rate.
OVERTIME:
- Hours in excess of 8 per day, or outside of the regular workday, Monday through Friday, that are not shift work, and all hours on
Saturday shall be paid at time and one-half the regular rate, inclusive of benefits. All hours on Sunday and holidays shall be paid at

Day, Thanksgiving Day, Christmas Day. Sunday holidays observed the following Monday. When all trades on a particular job site agree,
the day after Thanksgiving may be substituted for Veterans Day.
For projects bid after April 1, 2020, on hazardous waste removal work of any kind, including a state or federally designated site, where
the operating engineer is required to wear level A, B, or C personal protection, the operating engineer shall receive an hourly wage rate of
his regular hourly wage plus $5.00 per hour.
- An operating engineer working at a hazardous waste removal project or site at a task requiring hazardous waste related certification, but
who is not working in a zone requiring level A, B, or C personal protection, shall receive an hourly wage rate of his regular rate plus
$1.00 per hour.

ground water supply. The present methods of well drilling entailing as they do, many diverse job operations calling for drilling, pump
discharge, piping, and the operation of various types of related power equipment, shall all be within the job duties and functions of the
well driller and/or helper. In the event that an extension of work should occur beyond water well drilling functions, into the field of
general construction work, such extension of work would come under the appropriate rates listed elsewhere in this wage determination.

PIPELINE - MAINLINE TRANSMISSION

These rates apply to the following: welding on Transportation Mainline pipe lines (cross-country pipe lines, or any segments thereof,
transporting coal, gas, oil, water or other transportable materials, vapors or liquids, including portions of such pipe lines within private
property boundaries up to the final metering station or connection - the point where a valve, consumer connection, or town border station
divides mainline transmission lines or higher pressure lateral and branch lines from lower pressure distribution systems).
PER DIEM PAYMENT:
In addition to the total wage rate paid for each craft, the following per diem (per day) amounts must also be paid - Pipeline Journeyman:
$80.50; Pipeline Journeyman Welder: $140.50; and Pipeline Helper: $64.50. Note: in order to receive the per diem payment an employee
must work a minimum of 8 hours in a 24 hour period.
NOTES:
- Journeymen employed as "stringer bead" welders and journeymen who are regularly employed as "hot-pass" welders shall receive $1.00
per hour more than other journeymen.
- Welders running "stringer bead" or "hot-pass" on "cutouts" or "tie-ins" on a production basis shall be paid $1.00 per hour above the
journeymen rate.
- Whenever a welder helper is employed using a power buffer or power grinder immediately behind the stringer bead and/or hot-pass
welders, and the pipe gang is set on a production basis, the helper shall be paid $2.00 per hour above the helper rate.
- If back welding is performed inside a pipe under either or both of the following conditions, the welder engaged in the welding will
receive $3.00 per hour above the regular rate for the job only for the days on which such back welding is performed:
- The employer elects, as a regular procedure, to back weld each line-up. This condition is
not intended to apply to occasional back welding performed by the pipe gang to repair a
bead, to rectify a "high-lo" condition or wall thickness, etc.
- A welder is required to back weld a completed weld behind the firing line.

work where there are are more than twenty (20) employees on site.
A small job crew shall consist of five (5) or less employees, one (1) of the Journeyman Linemen in the crew shall be designated as a
Small Job Foreman.
Work performed from ladders and/or mechanical lift equipment shall be the work of Linemen and/or Apprentices.
On new construction, fitting and framing poles, towers or structures may be done by Journeymen and/or Apprentices. Groundmen may
assist, but may not perform any work which would be performed by Linemen if assembled in the air.
There shall be a Journeyman Lineman in each pole setting, erection, grounding, wire and cable-pulling crew of more than three (3) men.
