RESOLUTION AUTHORIZING A CONTRACT FOR EXTRAORDINARY
UNSPECIFIABLE SERVICES TO NATIONAL FITNESS CAMPAIGN LP, FOR THE
PURCHASE, DELIVERY, AND INSTALLATION OF A OF A FITNESS COURT AT
GLOUCESTER TOWNSHIP VETERANS PARK
WHEREAS, the Township of Gloucester has been awarded and has accepted the
Horizon Blue Cross Blue Shield of New Jersey's NFC State Sponsor Grant funding to
supplement the funds necessary to purchase a National Fitness Campaign Fitness Court®; and
WHEREAS, the Gloucester Township Administration has developed a plan to purchase
and implement the National Fitness Campaign Fitness Court®, within Gloucester Township; and
WHEREAS, National Fitness Campaign LP is the worldwide sole source vendor of
National Fitness Campaign Fitness Court®; and
WHEREAS, the NFC initiative provides design and planning services, a trademarked
outdoor infrastructure product, the Fitness Court®, an integrated digital ecosystem, the Fitness
Court mobile app and engagement wall, and integrated public art wall; and
WHEREAS, this program is highly specialized, and NFC is the only organization in the
world that delivers the aforementioned elements either individually, or as part of an integrated
program; and
WHEREAS, the Gloucester Township Administration has determined the appropriate
area to install the National Fitness Campaign Fitness Court®; and
WHEREAS, the anticipated term of this contract is upon the successful acquisition of the
desired asset; and
WHEREAS, N.J.S.A. 19:44A-20.4 et seq states "only a Governing Body, by resolution,
can award contracts awarded by any authorized process including formal quotations; and
contract that are exempt from the bidding process, or for professional or extraordinary
unspecifiable services, above seventeen thousand five hundred ($17,500.00) dollars."; and
WHEREAS, pursuant to NJAC 5:34-2.2(c.) This procurement meets the criteria of an
EUS (Extraordinary unspecifiable services) because products and services provided by National
Fitness Campaign LP are specialized and qualitative in nature requiring expertise, extensive
training and proven reputation in the field of endeavor.;
WHEREAS, pursuant to NJAC 5:34-2.3(b) The Township Administrator has filed a
certificate with the governing body describing in detail why the contract meets the provisions of
the aforementioned statute and these rules; and
WHEREAS, National Fitness Campaign LP has completed and submitted: 1. 2. 3.
Business Entity Disclosure Certification, which certifies that National Fitness Campaign LP has
not made any reportable contributions to a political or candidate committee in the Township of
Gloucester in the previous year and the contract will prohibit National Fitness Campaign LP
from making any reportable contributions through the term of the contract required Pursuant to
N.J.S.A. 19:44A-20.8 Political Contribution Disclosure Form from required under N.J.S.A.
19:44A-20.26 Valid New Jersey Business Registration Certification pursuant to P.L. 2004, с.57
WHEREAS, National Fitness Campaign LP has submitted a pricing proposal for a
National Fitness Campaign Fitness Court® in the amount of $310,000.00; and
WHEREAS, the expenditures for this purchase will be offset by $40,000 in grant
funding through the Horizon Blue Cross Blue Shield of New Jersey's NFC State Sponsor Grant,
leaving a remaining balance of $270,000 to be paid for this acquisition; and
WHEREAS, Christie Ehret, Chief Financial Officer, has confirmed that the funds have
been appropriated in the 2026 budget and funds are available for this purpose.
NOW THEREFORE BE IT RESOLVED, by the Township Council of the Township of
Gloucester, County of Camden, State of New Jersey, on this 13th day of April 2026, in open
public session that the governing body authorizes the purchase of a National Fitness Campaign
Fitness Court® system for a designated area in Gloucester Township as is consistent with this
resolution; and
BE IT FURTHER RESOLVED, a notice of this action shall be placed in an official
newspaper pursuant to N.J.S.A. 40A:11-5(1)(a) and 18A:18A-5(a)(2) and this Resolution and the
supporting documents shall be available for public inspection in the office of the Municipal
Clerk.
