Pressure Mitigation Project
INVITATION TO BID - BID NO: 25-05
Sealed Bids for the Pressure Mitigation Project will be received by the representative of the City of Hoboken, County of Hudson, State of New Jersey, Office of Administration, Division of Purchasing, on May 28, 2025 at 2:00 PM prevailing time at City Hall, Office of the City Clerk, 94 Washington Street, Hoboken, New Jersey 07030, and then publicly opened and read aloud.
Scope and Purpose Statement:
The work generally consists of the installation of two below grades concrete vaults (one on Newark Street and Harrison Street and the other on Henderson Street near Observer Highway) including pressure control valves, flow meters, piping, isolation valves, electrical services, instrumentation, control system, and associated appurtenances, and includes restoration of pavement, striping, curbs, and sidewalks as needed. The work shall take 210 calendar days for completion unless otherwise discussed and approved with the Owner and Engineer.
Bidding Documents may be examined and/or obtained at the offices of CDM Smith Inc., 110 Fieldcrest Avenue, Edison, NJ 08837, between the normal business hours of 8:30 AM and 4:30 PM. An electronic set of Bidding Documents (on CD) will be provided at no charge at CDM Smith’s Edison office or by phone at (518) 782-4520 or via email at stuartgr@cdmsmith.com. Hard copies of the Contract Documents will not be available for purchase. Bidding Documents will be available starting on Tuesday, April 8, 2025.
Bidders are encouraged to attend a non-mandatory pre-bid conference and walk-through to be held at the intersection of Newark Street and Harrison Street, Hoboken, New Jersey 07030. The date and time of the non-mandatory pre-bid conference is Tuesday, April 22, 2025 at 10:00 AM.
The Successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond with a surety company acceptable to the Owner. The Successful Bidder must furnish the Performance and Payment Bonds with a surety company licensed in the State of New Jersey, and in compliance with N.J.A.C. 7:22-3.17(g). Surety company shall be listed on latest version of the U.S. Department of Treasury Circular 570.
Bidder shall submit with the bid a certified check, cashier's check or bid bond in the amount of ten percent (10%) of the total price bid, but not in excess of $20,000, payable unconditionally to the City. When submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bond from a surety company authorized to do business in the State of New Jersey and acceptable to the City. The check or bond of the unsuccessful bidder(s) shall be returned as prescribed by law. The check or bond of the bidders to whom the contract is awarded shall be retained until a contract is executed and the required performance bond or other security is submitted. The check or bond of the successful bidder shall be forfeited if the bidder fails to enter into a contract pursuant to N.J.S.A. 40A:11-21.
Bidders may not withdraw their Bids for a period of sixty (60) days after the actual date of the opening of the Bids. Complete instructions for filing Bids are included in the Instructions to Bidders, which is included in the Project Manual.
If the bidder is a corporation or a partnership, the bidder, in conformance with Chapter 33, P.L. 1977, shall submit with its Bid, a statement setting forth the names and addresses of all stockholders who own a ten percent (10%) or greater interest in the firm.
The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in its best interest.
The Owner is seeking financing for this project through the New Jersey Environmental Infrastructure Trust, now known as the New Jersey Infrastructure Bank (i-Bank) and the New Jersey Department of Environmental Protection. The successful bidder must comply with all the provisions of N.J.A.C. 7:22-9 et. seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The successful bidder must comply with the Project Plan provided in Section 00800 for fulfilling SED utilization requirements.
This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust, nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. Wage rates for this Project are also subject to the Davis Bacon Act Wage Determinations as amended.
Bidders are required to comply, where applicable, with the requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27-1 et seq., New Jersey Statutes Title 19 Fair and Open Process, the City of Hoboken Chapter 20A Fair and Open Process, and all other applicable laws.
Bidders are required to comply with the current requirements of N.J.S.A.10:5-31 et. seq. P.L. 1975, c.127 (Affirmative Action); N.J.S.A. 52:25-24.2 P.L. 1977, c.33 (Disclosure of Ownership) and N.J.S.A. 52:32-44P.L. 1999, c. 39, as amended by P.L. 2004, c. 57, (NJ Contractor Business Registration Act).
The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq Chapter 150 of the Laws of 1963, effective January 1, 1964 and the Public Works Contractor Registration Act (NJSA 34:11-56.48).
SED Language Statements:
In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9.
The project sponsor has identified that the SED utilization goal for this project is: 10% o The 10 percent SED utilization requirement shall be accomplished by the following:
Bids shall be solicited on an unrestricted basis. The bid documents, however, shall include a statement to the effect that the successful bidder must fulfill the SED utilization requirements by subcontracting portions or the work to SEDs; or
Contractors also have the option of establishing unrestricted bidding procedures to fulfill the 10 percent SED utilization requirement for the project.
SED Funding Award Statement: N.J.A.C. 7:22-9.7(b): Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses. The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements.
