NOTICE TO BIDDERS
TOWNSHIP OF JEFFERSON
COUNTY OF MORRIS
NEW JERSEY
Notice is hereby given that sealed bids will be received by the Township of Jefferson, for MOOSEPAC WELL PFAS TREATMENT, Contract No. UTL-23-3, and will be opened and read in public at Jefferson Township Municipal Building, 1033 Weldon Road, Lake Hopatcong, New Jersey (physical address is 1033 Weldon Rd, Oak Ridge, NJ 07438), on Wednesday, May 27, 2026 at 11:00 a.m. prevailing time.
The work includes the furnishing of all labor, material and equipment necessary or required to complete all work set forth in these Specifications. In general, Work consists of constructing a new PFAS treatment facility the Moosepac Wells which will include the following: construction of a new approximately 43’ x 28’ building and associated appurtenances, furnishing and installing PFAS treatment vessels, furnishing and installing interior process piping, furnishing and installing caustic soda system, furnishing and installing chlorination system, furnishing and constructing underground process wastewater holding tank, furnishing and installing exterior standby generator, furnishing and constructing underground yard piping, construction of fence, and replacement of existing well pumps and motors.
The Source of Funding for this Project is either wholly or partially funded by the State loan program under the N.J. Environmental Infrastructure Financing Program (NJEIFP) and adherence to all applicable federal, state and local laws is required.
The Bid Documents for the proposed work prepared by H2M Architects & Engineers, Inc. and approved by the Township of Jefferson have been filed in the office of said PURCHASING DEPARTMENT, at 1033 Weldon Road, Lake Hopatcong, New Jersey, and may be inspected by prospective bidders during the regular business hours. Bidders will be furnished with a copy of the Specifications and Proposal by the PURCHASING DEPARTMENT at the cost of $50.00, non-refundable; plus $15.00 postage and handling if mailed via USPS. Bidder may provide their FedEx account number if FedEx is preferred. Or you may email CFett@jeffersontownship.net and request the bid package to be emailed at no cost. Please include company name, address, telephone number, fax number and person’s name to contact in the body of the email. All bid notices will be posted on the Township of Jefferson website at: https://www.jeffersontownship.net/bids.aspx.
Bids must be made on the standard Proposal form in the manner designated therein and must be enclosed in a sealed envelope bearing the name and address of the bidder and the name of the project on the outside, addressed to the Purchasing Department, Township of Jefferson, at 1033 Weldon Road, Lake Hopatcong, New Jersey 07849, and must be accompanied by a Certified Check, Bid Bond or Cashier's Check drawn to the order of the Township of Jefferson for ten percent (10%) of the total amount bid, provided said security need not be more than $20,000.00. All bid guarantees shall be accompanied by an executed consent on the enclosed Bid Bond and Consent of Surety Forms from an approved surety company, licensed to conduct business in the State of New Jersey, agreeing to furnish the required Performance and Maintenance Bond upon the award of contract.
The signed Proposal forms and bid security must be delivered to the place on or before the hour named above. The accepted bidder must sign the contract within ten (10) days after the Notice of Award or forfeit the bid security. Bid securities will be returned to all but the three apparent lowest responsible bidders. All other bid securities will be returned within three days after awarding and signing of the contract and approval of the Contractor's Performance Bond, Saturdays, Sundays, and Holidays excepted.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and P.L. 1975, c. 127 (N.J.A.C. 17:27), Affirmative Action Regulations and P.L. 1977, Chapter 33 Stockholder’s Disclosure Regulations.
The right is reserved to reject any or all Proposals, in whole or in part, or to make awards to such bidder or bidders who, in the judgment of the Township of Jefferson makes the most advantageous bid and to waive such informalities as may be permitted by law.
This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 6, 9 and 10 and N.J.A.C. 7:22A-6 and 7.
The contract is funded in part by New Jersey Environmental Infrastructure Trust and the successful bidder must comply with all the provision of N.J.A.C. 7:22-9.1 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The Contractor and all subcontractors will be required to comply with the SED Utilization Plan developed by the Township of Jefferson for fulfilling SED requirements.
N.J.A.C. 7:22-9.1(a)
N.J.A.C 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be established for the award of contracts to small business concerns owned and controlled by one or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of all contracts for building, materials and equipment, or services (including planning, design, and building related activities) for a construction project. The project sponsor has identified that the SED utilization goal for this project is 10 percent.
The 10 percent SED utilization requirement shall be accomplished by the following:
Bids shall be solicited on an unrestricted basis. The successful bidder must fulfill the SED utilization requirements by subcontracting portions of the work to SEDs.
Contractors also have the option of establishing unrestricted bidding procedures to fulfill the 10 percent SED utilization requirement for the project.
Project sponsor, at least 10 days prior to public advertisement for bids, shall notify the NJDEP Office of Equal Opportunity and Public Contract Assistance via H2Loans, of the availability of opportunities for SEDs to provide services, to bid on unrestricted contracts or subcontracts, or to provide any other necessary purchase or procurement.
Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses.
The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements.
The advertisement for bids shall be published at least 30 days prior to the date fixed for receiving bids on the purchase or contract.
Lowest bid resulting in payment of unreasonable price:
If the contracting agency determines that the acceptance of the lowest responsible bid will result either in the payment of an unreasonable price or in a contract otherwise unacceptable pursuant to the statutes and rules governing public contracts, the contracting agency shall reject all bids.
Bidders and the office shall be notified of the rejection of all bids, the reasons for the rejection, and the contracting agency’s intent to solicit bids for a second time.
If the contracting agency determines a second time that the acceptance of the lowest responsible bid will result either in the payment of an unreasonable price or in a contract otherwise unacceptable pursuant to the statutes and rules governing public contracts, the contracting agency shall reject all bids and notify the NJDEP Office of Equal Opportunity and Public Contract Assistance and, after receipt of the NJDEP Office of Equal Opportunity and Public Contract Assistance’s approval, shall amend the project plan accordingly.
Bidders shall be notified of the cancellation, the reasons for the cancellation and the contracting agency’s intent to resolicit bids on an unrestricted basis. SEDs may participate in the bidding on an unrestricted basis.
All applicable surety bonds required in connection with the advertisement and award of building contracts or sub agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570—Surety Companies Acceptable on Federal Bonds), incorporated herein by reference.
