Fair Share Affordable Housing Obligations Fourth Round Resolution

The Township of Lyndhurst is addressing its present and prospective fair share affordable housing obligations for the Fourth Round (2025-2035) as per the Amended Fair Housing Act (FHA). The resolution acknowledges the New Jersey Department of Community Affairs (DCA) report, which estimates Lyndhurst's obligations as 91 for Present Need (Rehabilitation) and 366 for Prospective Need (New Construction). However, based on a review by the Township's affordable housing planner, the Prospective Need Obligation is revised to 357 to more accurately reflect developable lands. The resolution directs the Township's Affordable Housing Counsel to file a declaratory judgment action with the Superior Court of New Jersey, Bergen County, within 48 hours of the resolution's adoption, seeking compliance certification. The Township reserves the right to comply with future amendments to the FHA and to challenge the calculations if a third party contests them. The resolution was adopted on January 23, 2025, and the Township Clerk is authorized to post a copy on the Township's website.
