NOTICE TO BIDDERS
Notice is hereby given that on Wednesday, June 3, 2026, sealed proposals will be received by the TOWNSHIP
OF MIDDLE at 33 Mechanic Street, Cape May Court House, New Jersey, at the hour of 10:00 AM prevailing
time, for the REAR PARKING ADA IMPROVEMENTS TO CLARENCE AND GEORGIANA DAVIES
COMPLEX (GOSHEN COMPLEX) FOR THE TOWNSHIP OF MIDDLE, CAPE MAY COUNTY, NJ at
which time and place the said bids will be publicly opened and read. Late bids will be returned unopened.
Specifications and plans must be obtained from Engineering Design Associates, 5 Cambridge Drive, Ocean
View, NJ for the price of $150.00 starting on Wednesday, May 13, 2026. They are available for viewing
only at the Clerk’s office at 33 Mechanic Street, Cape May Court House, New Jersey.
Bids must be enclosed in a sealed envelope and plainly marked in the lower quadrant: “REAR PARKING
ADA IMPROVEMENTS TO CLARENCE AND GEORGIANA DAVIES COMPLEX (GOSHEN
COMPLEX) FOR THE TOWNSHIP OF MIDDLE, CAPE MAY COUNTY, NJ”. The name and address of
the bidder shall be on the envelope.
The form of bid supplied by the Specifications must be used in bidding.
Bids must be submitted prior to the time designated above for receipt and opening of bids, and must be
submitted either by mail or in person by the bidder or his agent. No bids will be received after the time
designated above for their receipt.
Bids must be addressed to Kimberly Osmundsen, Township Clerk, Township of Middle, 33 Mechanic Street,
Cape May Court House, NJ 08210. Each bidder must deposit with his bid a certified check, cashier’s check,
or bid bond in the amount of ten (10) percent of the total lump sum bid no to exceed $20,000.00. The right is
reserved to reject any or all bids or to waive minor irregularities in any bid presented. Award, if any, will be
made to the lowest and most responsible bidder at a formal meeting of Township of Middle Committee.
No bidder may withdraw his bond within 60 days after the actual date of opening.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 (P.L. 1975, C.127, as amended, Law
Against Discrimination Affirmative Action Supplement) and N.J.A.C. 17:27.
Bidders are required to submit a statement of ownership with the bid, in compliance with N.J.S.A. 52:25-24.2
(P.L. 1977, C.33).
Bidder attention is called to the requirements of P.L. 2004, C.57 concerning registration with the State of New
Jersey in order to do business with local contracting agencies. Proof of registration in the form of a copy of
the Business Registration Certificate must be submitted at time of bid submission by all bidders and named or
listed subcontractors. Failure to comply will result in mandatory bid rejection.

Minority and women owned businesses are welcome to bid this project. Federal and State wage
rates must be adhered to. The highest of the two wage rates and fringe benefits are applicable.
All bids must be accompanied by a copy of the Contractors and all subcontractors’ registration
certificates or applications for registration through the Federal System for Award Management
(SAM). Upon approval of any pending applications for registration, the successful contractor
and any subcontractors must submit copies of the approved registration certificates to the
owner. SAM registration must be renewed and kept current during the course of the contract.

This federally funded infrastructure project is subject to the FY2024 (SFY2025) requirements of
the Build America, Buy America (BABA) Act (Pub. L. No. 117-58, 70901-70953, and 2 CFR
Part 184), requiring all iron, steel, and specifically listed construction materials (non-ferrous
metals; lumber; and plastic- and polymer-based composite building materials, pipe, and tube) be
produced in the United States unless these materials are otherwise exempt or subject to an
approved waiver. This requirement, known as the “Build America Preference (BAP),” applies to
all federal financial assistance as defined in 2 CFR 200.1 in which funds are appropriated or
otherwise made available and used for an infrastructure project, regardless of whether or not the
project is funded through the infrastructure investment and Jobs Act (IIJA).
By submitting a bid, the Contractor certifies understanding and compliance with BABA
requirements. Contractors and subcontractors shall provide necessary certifications,
documentation, and verified information to support compliance or waiver requests throughout
the project.
