--- Document: Lease of Parking Spaces Owned by Town of Morristown.pdf --- NOTICE OF LEASE OF PARKING SPACES OWNED BY THE TOWN OF MORRISTOWN Notice is hereby given that the Town of Morristown will offer the lease of parking spaces in blocks of 10 spaces up to a maximum of 140 spaces located at 200 South Street on a month to month basis for a period of two (2) years with one option to extend for an additional twelve (12) month period. The Town will accept bids at a public auction to be held at the Town of Morristown Town Hall, 200 South Street, Room 201, 2nd Floor, Morristown, New Jersey on Thursday, October 9, 2025 at 10:00 a.m., prevailing time. 1. The general terms and conditions of the bid shall be as follows: a) The parking spaces shall be bid in blocks of 10 spaces up to a maximum of 140 spaces. The spaces shall be leased on a month to month basis for a period of two (2) years with one option to extend for an additional twelve (12) month period. b) The minimum price is $100.00 per space per month. c) The lessee will be given the option of designated spaces or the issuance of permits for each parking space, and stickers to identify authorized permittees. If the lessee elects the permit option, then at the start of the lease, the lessee shall provide the Town of Morristown the name, telephone number, description of the automobile and license number for each permit holder, and said list shall be updated regularly. d) Use of the parking spaces will be limited to 6 a.m. to 9 p.m. on weekdays, and shall not include weekends and state or federal holidays. e) The Town, in its sole discretion, shall assign the blocks of parking spaces to the lessee. If during the term of the lease it is necessary to reassign blocks of parking spaces, the Town shall so advise the lessee and new block of spaces shall be assigned. f) The highest bidder at the conclusion of the public auction must deposit with the Town of Morristown one month’s rent for each parking spaces leased, which will be retained as a security deposit. The deposit shall be made by cash or certified check. g) The highest bidder will be required to sign a lease agreement that shall contain provisions requiring indemnification of the Town of Morristown, liability insurance of the lessee, a non-assignment and non-subletting clause, and other terms and conditions routinely contained in Lease Agreements. h) The Town of Morristown reserves the right to reject all bids made on parking spaces where the highest bid is not accepted. The Town of Morristown also reserves the right to waive any informality in any bid. i) In the events that there are two or more tied bids for parking spaces the Town reserves the right to award the lease or leases to the bidder(s) bidding on the highest number of spaces. j) In the event that the successful bidder on any of the parking spaces fails to execute a lease as a prepared by the Town of Morristown within thirty (30) days from the date of the bid award then, at the sole and exclusive option of the Town of Morristown, any such successful bidder may be rejected and the parking spaces may again be offered for lease and the bidder shall forfeit the security deposit. k) No lease between the Town of Morristown and any successful bidder shall contain any provisions which are inconsistent with the general terms and conditions set forth herein or as may otherwise be required by law. 2. All leases made pursuant to this auction shall be conducted in accordance with the provisions of applicable law, particularly N.J.S.A 40A:12-14 et seq., as well as other conditions set forth in the public advertisement. 3. The successful bidder will be required to execute the contract and file a bond within (10) ten days after award of the project and submit any other necessary documentation. Bids must be accompanied by a bid guarantee in the form of a certified check, bid bond, or cashier’s check in the amount of ten percent (10%) of the total amount bid, (bid bond amount not to exceed $20,000.00), and made payable to the order of the Town of Morristown, together with a “Consent of Surety” from a surety company authorized to do business in New Jersey stating that it will provide the contractor with a bond in such amount as requested in the advertisement or specifications. The guarantee of the successful bidder will be returned upon execution of the contract. All guarantees of the unsuccessful bidders will be returned upon award of contract to the successful bidder. Bidders (and Bidder’s subcontractors, if any) should submit a Business Registration Certificate issued by the New Jersey Department of the Treasury, Division of Revenue, in accordance with the requirements of P.L. 2009, c. 315. Bidders must be registered pursuant to The Public Works Contractor Registration Act, N.J.S.A. 34:11-56.48, et seq., (the “PWCRA”) at the time that the bid is made and must submit a copy of the certificate of registration with the bid form. All subcontractors listed in the bid must also be registered pursuant to the PWCRA at the time the bid is submitted.
