--- Document: Notice to Bidders --- BOROUGH OF MOUNT ARLINGTON MORRIS COUNTY, NEW JERSEY NOTICE TO BIDDERS SOLID WASTE DESIGNATED RECYCLABLE MATERIALS AND VEGETATIVE WASTE COLLECTION AND DISPOSAL SERVICES NOTICE IS HEREBY GIVEN that sealed Bids will be received by the Borough of Mount Arlington, County of Morris, State of New Jersey on July 25, 2024 at 11:00 am prevailing time at the Borough's Municipal Building, 419 Howard Boulevard, Mount Arlington, New Jersey 07856, at which time and place all Bids will be opened and read in public. No Bid Proposal submitted after the date and time specified will be opened or considered. Specifications and Bid forms are on file in the office of the Borough Clerk and may be obtained by prospective bidders at a cost of $50.00 per copy, which must be fully paid prior to receipt of the Bid Specifications and Bid forms, during regular business hours (8:30 am to 4:30 p.m.) Monday through Friday, excluding holidays, beginning May 23, 2024. All Bids must be accompanied by a certified check or Bid bond in the amount of ten (10%) percent of the total annual Bid, not to exceed $20,000.00. Bids must be enclosed in a sealed envelope addressed to the Ashley Todd, Acting Borough Clerk and clearly marked on the outside "Solid Waste, Recycling and Vegetative Waste Collection Contract". The successful Bidder shall furnish and deliver to the Borough a Performance and Payment Bond in the amount of 100 percent of the accepted annual Bid amount as security for the faithful performance and payment of the Contract. Further, the successful Bidder must furnish the policies or Certificates of Insurance required by the Bid Specifications. The deadline for questions, clarifications, and request for information (“RFI") regarding the Bid Specifications is on July 9, 2024, at 4:00 PM prevailing time. Questions and RFIs must be in writing. Send all questions and RFIs by email to: Ashley Todd at atodd@mtarlingtonboro.com, with a copy to Borough Counsel Matthew D. Jessup at mjessup@msbnj.com. Responses to all questions, clarifications and RFI will be by Addendum, which shall be published in the official newspaper of the Borough and one newspaper of general circulation published in the State no later than seven (7) days, Saturdays, Sundays, and holidays excepted, prior to the date for acceptance of Bids. A copy of the Addendum will also be posted on the Borough's website. All Bids shall be irrevocable, not subject to withdrawal and shall stand available for a period of sixty (60) days after the due date for submission of the Bids. The Borough of Mount Arlington reserves the right to reject any and all Bids and to waive informalities or irregularities in the Bids received in accordance with applicable law. 4882-1143-3890, v. 5 1 Bidders are required to comply, where applicable, with requirements of N.J.S.A. 10:5-31 et seq., N.J.A.C. 17:27 1 et seq., as amended, regarding equal employment opportunity. CONSENT OF SURETY CONSENT OF SURETY AS TO PERFORMANCE AND PAYMENT BOND In consideration of the promises (in the Bid Proposal to which this is attached), the undersigned consents and agrees that if the contract for which the preceding Bid Proposal is made be awarded to the corporation, person or persons making the same, it shall become bound as surety and a guarantor for its faithful performance, and shall execute a bond in the form required by the New Jersey R.S. 2A:44-147, said bond to be in an amount equal to one hundred percent (100%) of the contract price and to be conditioned so as to indemnify the Borough of Mount Arlington, Morris County, New Jersey, against loss due to the failure of the Contractor to meet the stipulation of the contract, contract documents, and the bond, and to guarantee payment to all persons performing or furnishing labor or materials for performance of said contract and if the said corporation, person or persons shall omit or refuse to execute such contract if so awarded, it will pay, on demand to the said Borough of Mount Arlington, the difference between the sum to which said corporation, person or persons would have been entitled upon the completion of such contract and the sum which the said Borough may hereafter be obliged to pay the corporation, person or persons to whom a substitute contract may be afterwards awarded, the amount of the difference to be determined by the bids.
