Print Bid Number: Project No: SCE-R15028.005 Bid Title: Project No: SCE-R15028.005 - Systemwide Water Meter Replacements Category: Newton Bid Opportunities Status: Open Description: NOTICE TO BIDDERS SYSTEMWIDE WATER METER REPLACEMENTS TOWN OF NEWTON , COUNTY OF SUSSEX , STATE OF NEW JERSEY FILE No.: SCE-R 15028.005 Sealed Bids for the Town of Newton Systemwide Water Meter Replacements will be received by the Town of Newton at the Municipal Building, 39 Trinity Street, Newton, NJ 07860 on May 21, 2026, at 10:00am , prevailing time, at which time and place they will be publicly opened and read aloud electronically sealed bids will be opened and conducted in electronic platform in accord with N.J.A.C. 5:34-1 et. Seq., on BidNet Direct at www.bidnetdirect.com//townofnewton at which time and place the sealed bids will be opened publicly and read for the following. No Bids will be accepted after said hour. The work will include but is not limited to the replacement and exit testing of 2,779 interior water meters of sizes ranging from 5/8X3/4 inch up to six inch. The Contractor shall procure water meters and cellular meter interface units as defined in the Contract Documents. The Contractor will abide by conditions and requirements for the scope of work and all coordination with property owners before and after installation activities. Complementary work to furnish and install accessory materials as may be necessary, are identified as if and where directed bid items. The project is located throughout the entirety of the Town of Newton. The contractor is responsible for providing all labor, supervision, trade skills, materials, and equipment required for this project as described in the Construction Documents. The Contract will allow 365 calendardays for completion of the work from the notice to proceed. Bids shall be electronically downloaded on or after April 21, 2026 at www.bidnetdirect.com//townofnewton and responded to by uploading, no physical bids shall be received, opened or honored. NOTE: It is the bidder’s responsibility to ensure that the bid package is delivered by the bid opening date and time. Any bid document received after the deadline established by the Department of Purchasing will not be accepted, regardless of the method of delivery. Bids shall be made on the forms provided and made part of the Contract Documents. If indicated, bid proposals must be accompanied by a certified check, cashier’s check, or bid bond in the amount of ten per centum (10%) of the total amount of the bid, but not in excess of twenty thousand ($20,000) dollars and made payable to the Town of Newton. If bids are to be submitted electronically in accord with this notice, then the bidder shall submit a copy of the bid guarantee with electronic submittal and mail PRIOR to bid opening the original (ONLY) to the Municipal Clerks office 39 Trinity Street, Newton, New Jersey 07860. The bid bond may also be provided in certified check and cashiers check in accord with provisions within general requirements of this bid. A Surety Consent evidencing that They can obtain the required Performance Bond shall be provided with the bid response. All applicable surety bonds required in connection with the advertisement and award of building contracts or sub agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570 – Surety Companies Acceptable on Federal bonds), incorporated herein by reference. Copies of this document may be obtained from the Department. The successful Bidder will be required to deliver to the Owner an executed Performance Bond of a responsible indemnity company authorized to do business in the State of New Jersey. Bidders are required to comply with the requirements of the New Jersey State Statutes: N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 Affirmative Action Section 1 of P.L.1977, c.33 Statement of Ownership (N.J.S.A. C.52:32-44) If awarded a contract, your company/firm is required to comply with requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. The Town of Newton reserves the right to consider bids for sixty (60) days after their receipt. The right is reserved to waive any informalities, to accept bids which it deems most favorable to the interest of the Town to make an award on each item separately or as a whole and to accept any Bid or to reject any or all Proposals in accordance with the Specifications and the Bid forms. This project is subject to both Davis Bacon wage rate requirements and New Jersey Prevailing wage rate requirements. The contractor shall utilize the higher of the two rates in each and every category of work on the project. This project is expected to be funded in part by New Jersey Department of Environmental Protection (NJDEP) and New Jersey Environmental Infrastructure Trust (NJEIT). Neither the State of New Jersey, the NJEIT nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3,-4,-5,-9 and -10. All federal prevailing wage regulations as well as the Federal Labor Standards Provisions will apply. Attention is called to the fact that the contractor must ensure that employees and applicants for employment are not discriminated against because of their race, creed, color, sex or national origin and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Small, Minority and Women’s Business Enterprises are encouraged to submit bids. Bids for proposals in excess of $100,000 must be accompanied by a written Affirmative Action Plan. Bidders are required to comply with the requirements of P.L. 1975, c. 127. The project or contract is funded in part by New Jersey wastewater/drinking water treatment financing programs and the successful bidder must comply with all the provisions of N.J.A.C. 7:22-9.1 for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The successful bidder for the project shall commit to the use of small business concerns owned and controlled by SEDs with a goal of ten percent (10%) of the work value under the contract. All contractors, including SED contractors, shall submit their own SED Utilization Plan to the NJDEP OEOPCA, with a copy to the Owner, within fourteen (14) days of the pre-construction meeting . The contractor’s plan shall contain provisions to meet the specific SED Utilization requirements of the contract. The contractor’s plan shall outline the entire project or contract work, the estimated time to complete the work, each significant segment of work on which SEDs will or may participate and a description of how SEDs will be contacted. The Contractor shall submit SED Participation Monthly Progress Reports (Form OEO-003) to the Project Compliance Officer and shall submit SED Participation Building Phase Quarterly Reports (Form OEO-002R) to the Project Compliance Officer and to the OEOPCA, in accordance with N.J.A.C. 7:22-9.12. N.J.A.C. 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be established for the award of contracts to small business concerns owned and controlled by one or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of all contracts for building, materials and equipment, or services (including planning, design and building related activities) for a construction project.” The project sponsor has identified that the SED utilization goal for this project is : 10 % The successful bidder must fulfill the SED utilization requirements by subcontracting portions or the work to SEDs; or establishing unrestricted bidding procedures to fulfill the SED utilization requirement for the project. Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses. This invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. If the successful Bidder’s Proposal does not meet the SED Utilization requirements, the successful bidder shall advertise and continue the search for SED participants for a minimum of 30 days after the Contract is awarded. --- Document: Privacy Policy (PDF) --- TOWN OF NEWTON PRIVACY POLICY The Town of Newton, hereinafter known as “Town”, recognizes and respects your right to privacy regarding personal identifying information revealed to the Town through your use of the Town's web site. This Privacy Policy explains the Town's practices for collecting personal identifying information from the Town's website, and the choices you can make that determine how your personal identifying information is collected and used by the Town. For the purpose of this Privacy Policy, the Town will use the term "identity information" to refer to your information which identifies you individually, including, but not limited to, your name, phone number, email address, physical address, access dates, IP addresses and pages accessed as well as other data. By accessing this web site, you agree to the terms of this Privacy Policy. The Town will not release identity information without either: (1) the consent of the person providing the information, or (2) a court order. However, it is important to understand that the Town has obligations to provide public access to "public records" under the Open Public Records Act. Thus, while the Town will make every effort to protect the privacy of your identity information consistent with the requirements of the NJ Public Records Act, there may be portions of your communications that the Town will be required to reveal to the public. For example, the Town may be required to provide access to the substance of your communication, with a deletion (or redaction) of your identity information. The Town receives identity information from customers through the Town website through a variety of online forms or modules and/or transactional applications. The primary reason that the Town collects and maintains citizen information is to serve you and administer your customer relationship with the Town. The Town values opinions and comments from citizens, so it may occasionally conduct online surveys. Participation in these surveys is entirely optional. Typically, the information is aggregated and used to record citizen opinions on important community issues. Survey participants are anonymous unless otherwise stated in the survey. The Town tracks web server log files in order to create aggregate statistical reports, detect errors, and maintain security. These reports do not contain any personally identifiable information of users outside the Town network. The Town may use identity information collected to distribute information about Town services. The Town of Newton provides users the opportunity to opt out of receiving communications from the Town and/or modify information previously provided by sending email to the Town Manager, Thomas S. Russo, Jr., at trusso@newtontownhall.com. If you have any questions about the Town of Newton's online privacy practices, please contact the Town Manager’s Office at 973-383-3521 ext. 224. This Privacy Policy (Version 2009-01) is effective as of September 1, 2009, concurrent with the establishment of the Town's updated website. The Town expects to update the website and this Privacy Policy on a regular basis in order to incorporate improvements over time. As updates to this policy are adopted, archived versions of older policies will be maintained by the Town Clerk in accordance with the Town's records retention policy.
