26-138 Resolution Approving an Agreement with Affordable Cartage LLC (239 KB)

The Borough of River Edge, along with the Borough of New Milford, had previously entered into a joint purchasing agreement for solid waste collection and disposal services, resulting in contracts with Joseph Smenkowski, Inc., which were later assigned to Affordable Cartage LLC. A dispute arose between Joseph Smenkowski, Inc. and Affordable Cartage LLC, leading to the Boroughs withholding payments due to Affordable Cartage LLC and holding them in escrow. This resolution approves an agreement with Affordable Cartage LLC to release the escrowed funds in exchange for Affordable Cartage LLC indemnifying the Borough of River Edge against any claims arising from the release of these funds. The amount to be released to Affordable Cartage, LLC is $312,397.82. The goal is to release all monies owed pursuant to the Contracts, as identified above, by Friday, May 15, 2026.
