It is the City’s intension to award a purchase order to the Vendor with the lowest overall price. All work done under this project shall be completed in a quality manner at the highest standard of the industry. 1.2 It is the intent of this request for proposals to describe tree removal services and related operations to remove limbs, branches, and stumps, along with chipping and other scraps, resulting in a clear worksite, without causing damage to public or private property within the City’s right of way or public property. 1.3 The list of tree removal locations is included in this request for proposal. Trees and quantities are listed for identification purposes and the successful vendor will be paid a lump sum. 1.4 Multiple stemmed and/or woodland trees are to be bid as one individual tree. 1.5 A City Map can be provided by request. TS02 GENERAL REQUIREMENTS 2.1 The items listed below shall be considered the minimum requirements for the Project, in addition to the normal services provided by custom in the trade. 2.2 The successful vendor shall be completely knowledgeable in the techniques and uses of equipment for safe and efficient tree removal. 2.3 No less than one crew, as described below, shall be used for each tree removal. 2.4 All tree or stump work shall be performed from within the public right-of-way or public property only. 2.5 A work crew shall be made up of a minimum of three (3) workers consisting of a supervisor/crew leader, a climber and a ground-worker. 2.6 Each crew shall have its own truck, with an aerial lift bucket (minimum 54’ working height), as well as a brush chipper and all saws and other incidental tools and signage required to complete the work. Request for Proposals – Various Tree Removals TS03 SCOPE OF WORK FOR TREE REMOVAL SERVICES 3.1 The Contract(s) awarded as a result of this request for proposal must be started prior to September 1, 2021. 3.2 The Contractor receiving an award will be responsible to complete work within the geographic and time limits established in this request for proposal. 3.3 The work to be performed under this Contract consists of Tree Removal. 3.4 DEBRIS DISPOSAL IS THE SOLE RESPONSIBILITY OF THE CONTRACTOR. 3.5 The Contractor shall remove all trunks, branches, limbs, rakings, woodchips, and other debris from the work site at the end of each workday. The work site includes the area surrounding the tree, whether inside or outside the public right-of-way. The Contractor is solely responsible for correcting any damage caused during the tree or stump removals. TS04 NOT IN CONTRACT TS05 SUPERVISION 5.1 The Director of Community Services, or his designee, shall be the City Representative responsible for supervising and evaluating the quality of work and to issue interpretations as needed. 5.2 All work done by the successful Contractor must be performed under the supervision of a New Jersey Licensed Tree Expert provided by the Contractor. TS06 NOT IN CONTRACT TS07 WORK SCHEDULE 7.1 The work shall not be commenced by the successful Contractor until notified to do so by the Director of Community Services and after such notification, weather permitting, the Contractor shall perform the specified work from start to finish without interruption commencing within ten (10) days of notification. The successful Contractor shall notify the Director of Community Services at least twenty-four (24) hours in advance prior to starting any work on this Project. 7.2 Work must be performed on Mondays through Saturdays in accordance with the City Ordinance 3-8-1 regulating noise as follows: > Weekdays from 8:00 a.m. to 6:00 p.m. > Saturdays from 9:00 a.m. to 6:00 p.m. 7.3 No work is to be scheduled on municipal holidays or Sundays. 7.4 Trees shall be removed on the basis of each crew completing one street at a time. Request for Proposals – Various Tree Removals TS08 PUBLIC SAFETY 8.1 The Contractor shall provide all necessary work zone safety and warning signs and devices, including but not limited to traffic cones, street barricades and “tree work ahead” signs; and provide a ground-worker on duty at all times work is being conducted on site. 8.2 The Contractor shall comply with all State ANSI and O.S.H.A. line clearance standards, and shall be responsible for direct communication with respective utility companies in regard to scheduling of assistance. 8.3 The Contractor shall request permission from the Police Department for all street closings. Provision shall be made for the passage of local residents and emergency vehicles at all times. TS09 DEBRIS AND DAMAGES 9.1 The Contractor shall remove all branches, limbs, wood, raking, and debris from the work site at the end of each workday and provide for their disposal. Sidewalks, streets, gutters and private driveways shall not be blocked with equipment or debris except temporarily in the immediate work area. 9.2 The Contractor is solely responsible for repair and restoration of any damages to public or private property to the satisfaction of the Director of Community Services. TS10 ADDITIONAL INSTRUCTIONS 10.1 Substitutions may be made for any tree not removed on a given street for another tree of similar size and growth characteristics on another street when approved by the Director of Community Services and agreed to by the Contractor. 10.2 The Contractor shall direct all questions regarding the location of trees within the right-of-way, or other questions relating to this Contract, to the Director of Community Services prior to performing any work on the trees in question. The Contractor will only be paid for removing trees growing within the right-of-way or on city property and included in this Contract. 10.3 All materials used in the work shall be of the best quality, and equipment shall be in safe operating condition. If the Contractor shall bring, or cause to be brought to the work, any material or equipment which is not satisfactory to the Director of Community Services, the Director shall have the right to order them to be removed from the vicinity of the work. In case of neglect, or refusal of the Contractor to do so, the Director of Community Services shall have the right to employ others to do so, and to deduct the expense thus incurred from any monies due or to become due to the Contractor. 10.4 The City of Summit may withhold 10% of the contract value until all corrections and the final inspection has been completed. 10.5 The Contractor shall notify the Director of Community Services when 33% of the job has been completed for a quality assurance inspection, then again when the job is 66% complete, and then when complete for final correction list. 10.6 At the completion of the job, the Contractor shall provide the Director of Community Services with a letter on company letterhead stating the quantity of recycled woodchips or wood waste in cubic yards. Request for Proposals – Various Tree Removals TS11 REMOVAL INSTRUCTIONS FOR TREES 11.1 All trees shall be cut to as close to ground level as possible. 11.2 All large branches shall be lowered to the ground to prevent damage to streets and private property. 11.3 Hooks and climbing spikes are permitted. 11.4 Permission must be secured at least 48 hours in advance through the Police Department at (908) 273-0051 prior to the closing of any street. Provision shall be made for the passage of local residents and emergency vehicles at all times. 11.5 The Contractor shall provide all necessary street barricades and “working in trees” signs, and provide a ground-worker on duty at all times work is being conducted on the site. 11.6 The Contractor shall comply with all State ANSI and O.S.H.A. line clearance standards, and shall be responsible for direct communication with respective utility companies in regard to scheduling of assistance. TS12 REMOVAL INSTRUCTIONS FOR STUMPS 12.1 Mechanically grind stumps and root flares to a minimum of eight inches (8”) below grade. 12.2 Stump removal shall include the removal of all obvious tree roots and, in the case of uplifted sidewalks, tree roots exposed for removal by the resident or by their masonry contractor within twelve feet (12’) of the center of the tree stump. TS-13 QUANTITY AND PAYMENT 13.1 Tree work performed by the Contractor for payment may be billed in three installments: One-third upon completion of one-third of the work assigned by the City, One-third upon completion of two-thirds of the work assigned, and The balance upon completion of the work assigned. 13.2 The proposed price for the removal of trees and stumps in the Proposal shall include the cost of labor, tools, equipment and materials, signage, and all else necessary therefore and incidental thereto. 13.3 The Contractor shall organize all work geographically in order to schedule full workdays. Uncompleted work from the Tree Removal List(s) will be held over to the next scheduled workday. 13.4 All trees and stumps are to be removed prior to October 22, 2021. 13.5 The Contractor shall fax a list of completed work at the end of each work week to the City Agent, John Linson, City Forester, and to the Director of Community Services at (908) 608-1214. Request for Proposals – Various Tree Removals INSURANCE: A. Types and Amounts of Required Insurance The Bidder shall maintain insurance of the types marked by below. The minimum amounts of insurance to be carried by the Bidder during the life of the contract shall be as listed. a. General Liability, including Premises Operations, Products/Completed Operations, Personal and Advertising Injury Liability, Contractual Liability and Property Damage Liability Combined Single Limit of $1,000,000.00 Each Occurrence and a $2,000,000.00 General Aggregate and a $2,000,000.00 Products-Completed Operations Aggregate, with City of Summit to be named as additional insured using Forms CG2010 and CG2037 or their equivalents (a blanket additional insured endorsement is not an equivalent). The General Liability Policy may not contain a “third-party over action” exclusion, therefore a copy of the vendor’s general liability policy may be requested for review. Property damage coverage shall be extended to cover damage to underground wires, ducts, pipes, conduits, etc. b. Workers' Compensation and Employer's Liability Insurance Statutory Limits of Workers’ Compensation insurance shall be maintained in full force during the life of the contract, covering all employees engaged in performance of the contract pursuant to N.J.S.A. 34:15-12(a) and N.J.A.C. 12:235-1.6. Each subcontractor shall provide Statutory Limits of Workers' Compensation and Employer's Liability Insurance for the latter's employees, unless such employees are covered by the protection afforded by Contractor's insurance. Employers Liability Insurance shall have limits not less than $500,000 per accident. c. Automobile Liability Insurance to include “Non-Owned and Hired Automobiles” with City of Summit to be named as additional insured by endorsement. One person in any one occurrence.....................................................................$500,000. Two or more persons in any one occurrence ....................................................$l,000,000. Property damage in any one occurrence ............................................................$250,000. OR Combined Single Limit......................................................................................$l,000,000. All policies shall remain in effect until all work has been completed. The Bidder shall ascertain the cost of all required insurance before preparing and submitting the bid. B. Certificates of the Required Insurance Certificates of Insurance for those policies required above shall be submitted to and accepted by the City of Summit before the contract can be fully executed. Such coverage shall be with an insurance company authorized to do business in the State of New Jersey and shall name the City of Summit as an additional insured. The certificate of General Liability insurance furnished by the vendor shall indicate that contractual liability is included. The certificate shall also state that the vendor’s insurance for general liability, public personal injury liability and property damage liability (in paragraph a. above) and automobile liability (in paragraph c. above) names the City of Summit as an additional insured. Request for Proposals – Various Tree Removals Self-insured contractors shall submit an affidavit attesting to their self-insured coverage and shall name the City of Summit as an additional insured. Insurance shall be issued on a primary and non-contributory basis; and a waiver of subrogation in favor of the City of Summit shall be included by endorsement. C. Indemnification Successful vendor shall indemnify and hold harmless the City of Summit, its officers, agents, volunteers and employees, from all claims, suits or actions and damages or costs of every name and description arising out of this Contract to which the City of Summit may be subjected or put by reason of the occurrence of incidents including but not limited to injury to the person or property of another, or the property of the City of Summit, resulting from negligent acts or omissions on the part of the contractor, its agents, servants or subcontractors in the delivery of goods and services, or in the performance of the work under this contract. The successful vendor shall indemnify and hold the City of Summit harmless from any liability to subcontractors/suppliers concerning payment for work performed or goods supplied arising out of this contract. Request for Proposals – Various Tree Removals In submitting this proposal, the Vendor understands that the CITY reserves the right to reject any and all proposals and does not give up any of its rights afforded by the State of New Jersey public bid laws.
