Sealed proposals will be received by the Purchasing Agent of the City of Summit, Union County, New Jersey no
later than 11:00 A.M. EST prevailing time, Tuesday, May 24, 2016 in the Council Chamber, First Floor, City Hall,
512 Springfield Avenue, Summit, New Jersey for:
VALET PARKING CONCESSION-BROAD STREET EAST LOT
in accordance with the specifications and proposal forms for same which may be obtained at the office of the
Parking Services Agency, City Hall, 512 Springfield Ave., Summit, N. J. during regular business hours, 8:30 am
4:30 pm, Monday - Friday.
All proposals shall be addressed to PURCHASING AGENT, 512 SPRINGFIELD AVENUE, SUMMIT, NJ 07901.
Proposals must be enclosed in a properly SEALED envelope bearing on the outside the name of the bidder and the
NATURE OF THE PROPOSAL CONTAINED THEREIN.
A Proposal Security is required in the amount of ten percent (10%) of the total bid, not to exceed $20,000, in the
form of a bid bond, certified check or cashier's check, made payable to the City of Summit.
Contractors, when appropriate, shall comply with the provisions of the following laws of New Jersey: N.J.S.A.
34:11-56.25 et seq. (Prevailing Wage Act); N.J.S.A. 52:25-24.2 (Corporation and/or Partnership Owner
Information); and any subsequent amendments thereto. Contractors are also required to comply with the
requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 (Affirmative Action) and N.J.S.A. 52:32-44 (Business
Registration), and any and all other Federal, State and local laws, regulations and requirements.
The Common Council reserves the right to reject all proposals, waive any minor defects, and in the case of a tie,
award on the basis of reasonable grounds, or accept the proposal that in its judgment will be for the best interests
of the City of Summit, and consider proposals for sixty (60) days after their receipt.
No charge shall be made or recovery had for publishing any official advertising unaccompanied by such statement
of price.

The undersigned being familiar with the Specifications for:
VALET PARKING SERVICES
BROAD STREET EAST LOT
including the Notice to Responders, Instructions to Responders, all Proposal forms, and Addenda (if any) thereto,
as prepared by the Parking Services Agency hereby proposes to furnish, in compliance with the provisions thereof,
all labor, materials and services required to provide valet parking services.
In submitting this proposal, it is understood that the unrestricted right is reserved by the Common Council for the
City of Summit to reject any and all proposals. If written notice of the acceptance of this proposal is mailed,
telegraphed or delivered to the undersigned within sixty (60) days after the date of opening of the Proposals, the
undersigned will within ten (10) days after the date of such notice, execute and deliver the necessary Contract
Documents as provided herein.
We, the undersigned, propose to furnish and deliver for VALET PARKING SERVICES - BROAD STREET
EAST LOT pursuant to this proposal package for the prices entered below:
SCOPE OF SERVICES
The City of Summit owns a dual usage surface parking lot known as the Broad Street East Lot located adjacent to
the Broad Street Garage at 396 Broad Street, Summit, NJ, whereby 60 designated spaces are reserved for
permitted Summit Residents and Downtown Employees. The balance of the Broad Street East surface lot consists
of 120 surface spaces dedicated as follows:
Five spaces are reserved for NJ Transit emergency entrance to the rail tracks. These spaces must remain
accessible at all times.
There is a balance of 115 surface spaces to be used first and room to valet an additional 85+ non-resident
commuter vehicles totaling approximately 200 non-resident commuter vehicles.
As an example, listed below is an established breakdown of the first 115 surface spaces based on the current $10
per day non-resident parking fee which depicts that the City will be paid (monthly) $9 per vehicle parked each day
and the awarded contractor will keep a $1 for each of the 115 vehicles parked.

For those vehicles over 115 that are physically valeted, there will be a revenue split that cannot be less than 55% of
the total daily fee to the City of Summit and 45% of the total daily fee to the responder. If the City increases the
daily fee, the revenue split will be the same percentage (%) as agreed to at the time this contract is awarded.
The last rate increase was in 2008.

We acknowledge that the City may award a contract or reject all proposals at its sole discretion. We further
acknowledge that, if an award is to be made, the award shall be based on Scope of Services including the
calculation of a total price as derived from the sum of the base proposal and selection of alternate items, if any, as
may be chosen by the City, in a quantity and/or dollar amount not to exceed the individual quantities specified
above.

INSTRUCTIONS TO RESPONDERS
The City of Summit, Union County, New Jersey (hereinafter referred to as "Owner") invites sealed
proposals in accordance with the public advertisement as required by law, with a copy of said notice
being attached hereto and made a part of these specifications.
Sealed proposals will be received by the designated representative at the time and place stated in the
Notice to Responders, and at such time and place will be publicly opened and read aloud.

The proposal form shall be submitted, in a sealed envelope: (1) addressed to the OWNER, (2) bearing
the name and address of the bidder written on the face of the envelope, and (3) clearly marked
"PROPOSAL" with the contract title and/or proposal number being proposed. DO NOT STAPLE, BIND
OR OTHERWISE FASTEN ANY BID DOCUMENTS; USE ONLY EASILY REMOVABLE PAPER
CLIPS, BINDER CLIPS, ETC. ALL PAGES MUST BE 8 1½ X 11", DO NOT INCLUDE/FASTEN

It is the responder's responsibility to see that proposals are presented to the OWNER by the hour and
at the place designated. Proposals may be hand delivered or mailed; however, the OWNER disclaims
any responsibility for proposals forwarded by regular or overnight mail. If the proposal is sent by
express mail service, the designation in section C, above, must also appear on the outside of the
express mail envelope. Proposals received after the designated time and date will be returned
unopened.
Sealed proposals forwarded to the OWNER before the time of opening of proposals may be withdrawn
upon written application of the responder who shall be required to produce evidence showing that the
individual is or represents the principal or principals involved in the proposal. Once proposals have
been opened, they must remain firm for a period of sixty (60) calendar days, or for such longer period
as may be agreed pursuant to N.J.S.A. 40A:11-24.a.
All prices and amounts must be written in ink or preferably machine printed. Proposals containing any
conditions, omissions, unexplained erasures or alterations, items not called for in the proposal form,
attachment of additive information not required by the specifications, or irregularities of any kind, may
be rejected by the OWNER. Any changes, whiteouts, strikeouts, etc. in the proposal must be initialed
in ink by the person signing the proposal.
Each proposal form must give the full business address, mailing address if different, business phone,
fax, e-mail if available, the contact person of the responder and be signed by an authorized
representative as follows:
• Proposals by partnerships must furnish the full name of all partners and must be signed in the
partnership name by one of the members of the partnership or by an authorized representative,
followed by the signature and designation of the person signing.
• Proposals by corporations must be signed in the legal name of the corporation, followed by the name
of the State in which incorporated and must contain the signature and designation of the president,
secretary or other person authorized to bind the corporation in the matter.
• Proposals by sole-proprietorship shall be signed by the proprietor.
• When requested, satisfactory evidence of the authority of the officer signing shall be furnished.
Responder should be aware of the following statutes that represent "Truth in Contracting" laws:
• NJSA 2C:21-34, et seq. governs false claims and representations by responders. It is a serious crime
for the responder to knowingly submit a false claim and/or knowingly make material
misrepresentation.

• NJSA 2C:27-10 provides that a person commits a crime if said person offers a benefit to a public
servant for an official act performed or to be performed by a public servant, which is a violation of
official duty.
• NJSA 2C:27-11 provides that a responder commits a crime if said person, directly or indirectly, confers
or agrees to confer any benefit not allowed by law to a public servant.
• Responder should consult the statutes or legal counsel for further information.
Responders shall insert prices for furnishing all of the materials and/or labor required by these
specifications. Prices shall be net, including any charges for packing, crating, containers, etc. All

transportation charges shall be fully prepaid by the contractor F.O.B. destination and
placement at locations specified by the OWNER. As specified, placement may require inside
deliveries. No additional charges will be allowed for any transportation costs resulting from partial
shipments made for the contractor's convenience.

The vendor shall guarantee any or all materials and services supplied under these specifications.
Defective or inferior items shall be replaced at the expense of the vendor. In case of rejected
materials, the vendor will be responsible for return freight charges.
II. PROPOSAL SECURITY AND BONDING REQUIREMENTS
The following provisions if indicated by an (X), shall be applicable to this proposal and be made a part of the
proposal documents:
A. PROPOSAL GUARANTEE (mandatory for construction over $100K; becomes mandatory if
required for any other bid)
Responder shall submit with the proposal a certified check, cashier's check or bid bond in the amount of ten
percent (10%) of the total price proposal, not to exceed $20,000, payable unconditionally to the OWNER. When
submitting a Bid Bond, it shall contain Power of Attorney for full amount of Bid Bond from a surety company
authorized to do business in the State of New Jersey and acceptable to the OWNER. The check or bond of the
unsuccessful responder(s) shall be returned pursuant to NJSA 40A:11-24a. The check or bond of the responder to
whom the contract is awarded shall be retained until a contract is executed and the required performance bond or
other security is submitted. The check or bond of the successful responder shall be forfeited if the responder fails
to enter into a contract pursuant to N.J.S.A. 40A:11-21.
Failure to submit a proposal guarantee shall result in rejection of the proposal.
B. CONSENT OF SURETY (mandatory for construction over $100K; becomes mandatory if
required for any other proposal)
Responder shall submit with the proposal a Certificate (Consent of Surety) with Power of Attorney for full amount of
proposal price from a Surety Company authorized to do business in the State of New Jersey and acceptable to the
OWNER stating that it will provide said responder with a Performance Bond in the full amount of the awarded
contract. This certificate shall be obtained in order to confirm that the responder to whom the contract is awarded
will furnish Performance, and Labor and Material (Payment) and /or Maintenance Bonds, if applicable, from an
acceptable surety company on behalf of said responder, any or all subcontractors or by each respective
subcontractor or by any combination thereof which results in performance security equal to the total amount of the
contract, pursuant to N.J.S.A. 40A:11-22.
Failure to submit a consent of surety form shall result in rejection of the proposal.
C. PERFORMANCE BOND (mandatory for construction over $100K; becomes mandatory if
required for any other proposal)
Successful responder shall simultaneously with the delivery of the executed contract, submit an executed bond in
the amount of one hundred percent (100%) of the awarded contract as security for the faithful performance of
this contract.
The performance bond provided shall not be released until final acceptance of the whole work and then only if any
liens or claims have been satisfied.
Failure to submit this with the executed contract shall be cause for declaring the contract null and
void pursuant to NJSA 40A:11-22.
The surety on such bond or bonds shall be a duly authorized surety company authorized to do business in
the State of New Jersey N.J.S.A. 17:31-5.

III. INTERPRETATION AND ADDENDA
A. The responder understands and agrees that its proposal is submitted on the basis of the specifications
prepared by the OWNER. The responder accepts the obligation to become familiar with these specifications.
B. Responders are expected to examine the specifications and related documents with care and observe all their
requirements. Ambiguities, errors or omissions noted by responders should be promptly reported in writing to
the appropriate official. Any prospective responder who wishes to challenge a proposal specification shall file
such challenges in writing with the contracting agent no less than three business days prior to the opening of
the bids. Challenges filed after that time shall be considered void and having no impact on the contracting unit
or the award of a contract pursuant to NJSA 40A:11-13. In the event the responder fails to notify the OWNER
of such ambiguities, errors or omissions, the responder shall be bound by the requirements of the
specifications and the responder's submitted proposal.
C. No oral interpretation and or clarification of the meaning of the specifications for any goods and services will
be made to any responder. Such request shall be in writing, addressed to the OWNER'S representative
stipulated in the specification. In order to be given consideration, written requests for interpretation must be
