This RFA is limited to applicants seeking a resolution of local support for proposed Cannabis Cultivation or proposed Cannabis Manufacturing as defined under the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq. Annexed hereto as Exhibit “A” is a copy of the Application for the Submission of an Application to the New Jersey Cannabis Regulatory Commission which contains the required information and documents to be provided to the Township. Annexed hereto as Exhibit “B” is a copy an excerpt of the Township’s Municipal Code containing the provisions that govern the: (i) Zoning and Lang Use requirements and conditions for Licensed Cannabis Entities; and (ii) the procedures and requirements for application for a final Local License from the Township. Please note that a Resolution of Local Support does not constitute an approval of a final Local License. Introduction
New Jersey, and West Orange in particular, enjoys the
benefits of an excellent public transportation system.
West Orange On The Go! has developed Your Guide
to Public Transportation to help West Orange’s senior
citizens understand available transportation resources.
Public transportation is a safe and economical way to
visit family and friends and to travel to stores,
restaurants, doctors’ offices and many other
destinations. Riding the bus and train can be much
easier than fighting traffic and searching for a parking
space. Public transportation helps us maintain our
independence. We can make our own travel decisions
without having to rely on other people.
For people who drive there are many services available
to help us do so safely and comfortably. Cars have
changed and so have traffic rules, driving conditions,
and the roads we travel every day. Some common
age- related changes can affect driving as well.
We wish to thank the Township and local organizations
who helped develop this Guide. Organizations include
Jewish Federation of Greater MetroWest NJ, JCC
MetroWest & the Jewish Community Housing
Corporation. Major funding for West Orange On The

Local Bus Service in West Orange
Two local NJ TRANSIT bus routes travel through
West Orange. Transfers can be made to other
bus lines on Main St. in West Orange and Orange
and at the Livingston Mall. They operate seven
days a week, but schedules are different on
weekends.
The #73 travels from Livingston Mall through
Livingston, West Orange, Orange, East Orange
and into Newark Penn Station.
The #71 travels from West Caldwell through
Caldwell, Essex Fells, Roseland, Livingston,
West Orange, Orange, East Orange and into
Newark Penn Station.
NJ TRANSIT buses are accessible: they “kneel” to
lower the height of the first step and have lifts for
any riders who cannot use steps. Passengers must
ask the driver to kneel the bus or use the lift.
NJ TRANSIT “mybus”
The mybus service tells customers when the next
buses are scheduled to arrive at local bus stops.
To Use “mybus”
Call (973) 275-5555 and follow the prompt to dial
the mybus stop ID #. Mybus will then tell you when
the next bus is scheduled to arrive at your stop.

NJ TRANSIT Reduced Fare Program
Individuals age 62 and over as well as people with
disabilities can save at least 50% on NJ TRANSIT
by using the Reduced Fare Program.
To receive the reduced fare there are two options:
Show the bus operator or train conductor an ID
that is proof of your age (driver’s license or
Medicare card) and ask for “the reduced fare.”
You may also apply for a Reduced Fare ID
Card by calling NJ TRANSIT at (973) 491-7112.
What are “Fare Zones”?
Your bus fare is determined by zones, which are
the distances that you travel. Zones are shown on
the bus schedules with a special line and notation
so you know your fare in advance. You may also
call (973) 275-5555 to confirm bus fares and other
travel information. The bus operator will tell you
how much your fare is when boarding.

Access Link
NJ TRANSIT operates Access Link for customers with
disabilities who cannot use the regular NJ TRANSIT
bus. Some seniors may be eligible for Access Link.
Access Link operates on the same days and hours as
the regular NJ TRANSIT bus and “shadows” the local
bus routes.
Access Link has special
features:
Small buses and cars
provide “curb-to-curb”
service.
Appointments for trips must
be made by the rider or other designee at least 24
hours in advance.
Access Link can be used for any type of trip -
medical, social, shopping, etc.
Please request if you want to ride with a
companion who will pay regular fare or a Personal
Care Attendant (PCA) who can ride for free.
The Access Link Assessment Process
Potential riders must have an in-person
transportation assessment interview.
To arrange an assessment interview at local office,
call (800) 955-2321.
A certification specialist will explain the
assessment process over the phone.
Bring an advocate (family, friend or professional)
to the interview to help you describe your situation.
If you need transportation to the interview, Access
Link will pick you up for a round-trip fare of $4.00.

Plan your trip in advance using a trip planner at
njtransit.com or googlemaps.com/transit or
speak to a live operator at customer service.
Keep copies of the schedules for the lines you
use. You can order schedules or plan your trip
with NJ TRANSIT Customer Service by calling
(973) 275-5555. You can look at schedules
online at njtransit.com, coachusa.com.
Bring exact fare and extra change with you.
Also bring any medications you may need
during a trip, your ID Card, the address of your
destination, and emergency phone numbers.
Always get to the bus stop early. It is better to
be 15 minutes early than 15 seconds late!
Sit near the bus operator, if possible, so you
can easily communicate, see the road ahead
and hear any announcements.
Keep aisles clear of bags and packages.
Tell a friend or family member where you are
going and when you plan to return.
Never plan to take the last bus home.

The West Orange Senior Citizen Transportation
Program is a curb-to-curb paratransit program that
provides paratransit service within West Orange. This
service is available to residents 60 years of age and
older who are able to board the vehicle independently
or with the help of their own aide.
Guidelines
This service can help you get to dialysis, medical/
health center appointments, nutrition programs,
club meetings, food shopping and other outings.
Rides are available starting at 8:45 AM with return
pickup by 3:30 PM on weekdays.
There is no charge for the service, however,
donations are requested.
Note: Service is limited to West Orange Township with
the exception of St. Barnabas Medical Center and
Barnabas Health Ambulatory Care Center for dialysis.
To schedule a home pickup:
Call (973) 325-4134 three to four days in advance.
Allow for a 15 minute waiting period for pickups to
and from appointments.
Please make sure to mention if you use a
wheelchair or other mobility device.

Essex County Special Transportation
Free transportation to medical, shopping,
programs and other destinations is available
from Essex County Special Transportation.
New riders must provide personal information
by telephone prior to scheduling a ride.
Individuals may apply if they are over 60 years
of age or have a disability.
Service to medical, shopping, programs and
other destinations within Essex County.
Trip reservations must be made at least two
days or up to one month in advance.
Riders are asked to be ready one hour before
the pickup & drop-off times.
This is a busy service, so passengers may have
to be flexible about pick-up days and times.

Membership is $15 per year.

$0.57 per mile for trips within 10 miles.
$1.14 per mile for trips beyond 10 miles.
No money is exchanged with drivers.

West Orange has many train stations in close
proximity. South Orange Rail Station is accessible
with frequent service. South Orange Rail Station is
located near the South Orange town center and is
served by the Morris-Essex rail line with daily
service into Hoboken and New York. Orange Rail
Station is also close to West Orange but it is not
accessible to people with disabilities.
South Orange Rail Station
Time to/from NYC: 30-50 minutes.
One-way reduced fare to NYC: $3.
Seniors over age 62 may purchase reduced
fare tickets on the train with no surcharge.
South Orange Rail Station has elevators and
mini high-level platforms for customers who
cannot climb stairs. There are bridge plates to
help bridge the gap between the platform and
the train car. Orange Rail Station does not have
such features and requires riders to walk up
steps

Two bus routes with service to Port Authority Bus
Terminal in New York serve West Orange. Travel
time from West Orange to New York City is about
one hour. Buses run once an hour during off peak
times. Individuals over age 62 with ID or Reduced
Fare Card are eligible for Reduced Fare. Fares can
be paid to the bus operator in NJ. Tickets must be
purchased before boarding in New York City.
Community Coach #77 Bus to New York
Reduced Fare Round Trip to New York - $8.40
Departure: Gates 305/306 at Port Authority
The #77 bus picks up/drops off at NJ TRANSIT
bus stops on Northfield Ave in West Orange.
DeCamp’s #66/66R Bus to New York
Reduced Fare Round Trip to New York - $7.65
Departure: Gate 412 at Port Authority
66 service originates at the corner of Eagle
Rock Ave. and Harrison Ave. The bus follows
Harrison Ave. North through West Orange
toward Montclair and then into Port Authority.
66R service originates in West Caldwell and
travels from Passaic Ave. to Eagle Rock Ave.
and then follows the rest of the 66 route.

Book. With each passing edition the Seniors Blue
Book continues to grow in size, accessibility, and
information. I want to offer you my heart felt thanks

Book as your primary go to source for anything and
everything that is related to seniors, caregivers and
their well being.
It is our mission to provide you with all possible
options and opportunities that are available in an easy
to read format. The guide is broken down into three
main sections; Community Resources and Services,
Home Health Care & Non-Medical Home Care Agen-
cies and Senior Housing. We include definitions of
these services and indicate which companies offer these
in the appropriate Home Health and Housing Grids.

ADULT DAY SERVICES
Adult day programs are for elders who need a place to stay during daytime
hours because they have difficulty functioning alone (i.e. dementia or physical
limitations). The programs offer purpose and stimulation. Most facilities place
participants into groups with specific limitations. For more information call

EMERGENCY RESPONSE SYSTEMS
A Personal Emergency Response System (PERS) is an electronic device
designed to let you summon help in an emergency. A PERS has three
components: a small radio transmitter (a help button carried or worn by the
user); a console connected to the user’s telephone; and an emergency response
center that monitors calls. When emergency help (medical, fire, or police) is
needed, the PERS user presses the transmitter’s help button. It sends a radio
signal to the console. The console automatically dials an emergency response
center where the caller is identified. The center will try to determine the nature

DIABETIC CARE – Refers to services including patient assessment specific diet
information, management of the disease process, medication management and
education on all the above. Services are provided by Registered Nurse under the
supervision of a M.D. Some agencies may have certified diabetic nurse instructors or
cardiac care specialty RN’s in their employ.
ENTERAL FEEDING – Enteral feeding, or tube feeding, is a way to deliver
nutrients through a tube if you cannot take food or drink through your mouth.

HOUR MINIMUM – The least number of hours a Non-Medical Home Care
Agency will be available for hire. Medicare certified Home Health Agencies are not on
a specified time frame.
HOSPICE – Refers to a comprehensive program of care to patients and families
facing a life threatening illness. Hospice emphasizes palliative rather than curative
treatment. The dying are comforted. Professional medical care is given, and
sophisticated symptom relief provided.
INTRAVENOUS THERAPY (IV) – Refers to any medical treatments/
medications that need to be introduced into the body via a patient’s veins. Numerous
IV Therapies can be provided in a patient’s home under supervision of a MD.
Some of these include: inter-infective/antibiotic therapies, hydration therapy, pain
management, chemotherapy and central line care and maintenance.
MED-ALERT SYSTEMS – Personal medical alert products activated by pushing
a button.
PRIVATE DUTY PERSONAL CARE – Assistance with Activities of Daily Living
(ADL’s), homemaking, companionship and other non-medical in home care. These
services are available for hire after, or in conjunction with, Medicare certified services.
Private payment, Medicaid and Veterans Benefits are a few of the ways personal care
can be paid for.
PSYCHIATRIC CARE – Refers to the agencies’ ability to offer services related to
psychiatric support with the prevention, diagnosis, and treatment of mental illness.
Services may include counseling or administering of medications.
SOCIAL WORKER – A clinical social worker whose purpose in health care is
to enhance, promote, maintain, and restore the best possible social abilities of the
patient or family. Services provided may be preventive, developmental, or remedial
in nature.
THERAPY SERVICES (ST, PT, OT, RT) –
Speech Therapy – Refers to services to assess and treat speech and swallowing
disorders. Speech therapy can treat speech, language, cognitive skills or swallowing.
Physical Therapy – Refers to services for the treatment and the rehabilitation
process where a physical therapist will often stretch, strengthen, facilitate muscles,
challenge balance, test coordination abilities, teach home exercise programs and
enhance basic mobility skills.

Occupational Therapy – Refers to services to assess and treat patients to
improve their ability to perform tasks in their daily living and working environments.
Patients may have mental, physical, developmental, or emotional disabilities.
Therapists also help them to develop, recover, or maintain daily living and work
skills. Occupational therapists help clients not only to improve their basic motor
functions and reasoning abilities, but also to compensate for permanent loss
of function.
Respiratory Therapy – Refers to services for care of patients with deficiencies
and abnormalities associated with the cardiopulmonary system. It may include
the therapeutic use of medical gases and their equipment, environmental control
systems, humidification, aerosols, ventilator support, bronchi pulmonary
drainage and exercise, respiratory rehabilitation, assistance with cardiopulmonary
resuscitation, and maintenance of natural, artificial, and mechanical airways.
TRACH CARE – Refers to care administered to patients who have undergone
a tracheotomy. A tracheotomy is a surgical procedure in which a cut or opening is
made in the windpipe (trachea). The surgeon inserts a tube into the opening to
bypass an obstruction, allow air to get to the lungs, or remove secretions.

ADLs – ACTIVITIES OF DAILY LIVING – Assistance with bathing,
toileting, dressing, getting in and out of a bed or chair, walking and eating
otherwise know as activities of daily living.
ALZHEIMER’S DEMENTIA CARE – This refers to personnel of the agency
that are specifically trained to provide care to those that are afflicted with
Alzheimer’s or other dementia related problems.
BONDED – Means that a bonding company has secured money that is available to
the consumer in the event they file a claim against the company.
FREE ASSESSMENT – Agencies that do not charge for the initial assessment
of the client which is usually facilitated by a nurse or other professional capable of
providing a detailed care plan.
HOMEMAKER/COMPANION – Non-medical assistance with meal
preparation, laundry, light housekeeping, errands, activities, outings,
companionship and other household duties. These agencies are licensed
HOURLY MINIMUM – This refers to the minimum number of hours
that an agency provides service.
INCONTINENCE - Lack of voluntary control over urination or defecation.
INSURED – This refers to what happens if someone gets hurt on the job.

ALZHEIMER’S/DEMENTIA ASSISTED LIVING COMMUNITIES –
Licensed assisted living facility or skilled nursing facility that specialize in delivering
care to victims of Alzheimer’s and dementia. Communities are typically bedroom-
style rental units with common areas for dining and activities. Many are locked for
residents’ safety. Specifically trained staff usually serves the special needs of this
population. Amenities vary for each community.
ASSISTED LIVING COMMUNITIES – Typically apartment-style with
kitchenettes and private baths. Some offer companion accommodations. Personal
assistance with Activities of Daily Living (ADLs) bathing, grooming, dressing,
toileting, eating and ambulation. Rates vary from an all-inclusive to base rates with
levels of care. Amenities vary for each community.
CCRC – Continuing Care Retirement Communities offer all levels of care on one
campus (independent living, assisted living and skilled nursing). An endowment
fee may be required that entitles residents to use assisted or skilled services when
needed throughout their lifetime. Each community offers varied buy-in and
payment plan options.
DAY CARE – Any provider can elect to provide day/night services on a short or
long term basis. Rates typically include a place to rest, one or two meals and snacks
and activities for the day. Licensed communities are prohibited by law to promote
these services without a specific license.
INDEPENDENT HOUSING – Apartments and communities for adults 55+
with little or no senior support services (e.g. no meals, etc.).
INTERMEDIATE CARE – 24 hour inpatient care residents who need
licensed nursing supervision and supportive care, but do not require
continuous nursing care. Residents may receive full assistance with ADL’s and
transfers. Residents receive meds from a nurse following a doctors
orders and may receive outpatient rehab services. Facilities may use a nurse as a
their consultant and the residents receive periodic assessments from a licensed
practitioner.

Housing and Resources for Aging Well
PRICE ALL INCLUSIVE – Price listed includes any and all amenities a
community has to offer.
RESPITE CARE – Otherwise known as a short-term stay. Any provider of IL, AL,
ALZ or SNF care can elect to provide fully furnished accommodations to a person
for a short period of time. Rates usually quoted on a daily basis and are typically
inclusive of all services and amenities.
RETIREMENT COMMUNITIES – Housing designed specifically for mature
adults. Typically Studio, 1 BR or 2 BR rental apartments with full kitchens,
and private baths are available. Services include meal plans, transportation,
housekeeping, laundry and maintenance. Amenities are usually abundant; formal
libraries, computer stations, swimming pools, gardens, and other social gathering
spaces. Rates are monthly and typically based upon size/ location of apartment.
SKILLED CARE – 24 hour licensed nursing services, eight hours of which are
RN covered. Patient may receive rehab services either inpatient or out-patient and
may be fully dependent for ADL’s. Patients receive medications by an RN according
to a licensed physicians orders.
SKILLED NURSING CARE FACILITIES – Providing 24/7 care for
residents and offering full assistance with ADL’s. Daily rates typically include a
furnished bedroom and a private or shared bath, meals, activities, transportation,
phone service, cable TV and all personal/nursing care. Payor sources usually
accepted are Medicare, Medicaid, VA, some insurance plans and private sources.
TYPE 1 CARE – Residents may need significant assistance with 2 ADL’s and
minimal assistance on more than 2 ADL’s daily. The resident must also be able to
evacuate a community under their own power and have stable health. Residents
receive 24/7 monitoring and may have an independent home health agency help
with services.
TYPE 2 CARE – Residents receive full assistance with ADL’s and are able to
permit aging in place. Residents may require the assist of one person for transfers
and evacuations. Residents receive 24/7 monitoring and may have an independent
home health agency help with services.

BUSINESS WITHIN THE TOWNSHIP OF WEST ORANGE
(CULTIVATORS AND MANUFACTURERS)
NOTICE TO PROSPECTIVE APPLICANTS
The Township of West Orange (the “Township”) is soliciting application by way of this
Request for Application (the “RFA”) for the issuance of a Resolution of Local Support for the
Suitability of a Cannabis Business consistent with N.J.A.C. 17:30-5.1(g) of the regulations
promulgated by the New Jersey Cannabis Regulatory Commission. This RFA is limited to
applicants seeking a resolution of local support for proposed Cannabis Cultivation or
proposed Cannabis Manufacturing as defined under the New Jersey Cannabis Regulatory,
Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq.
Annexed hereto as Exhibit “A” is a copy of the Application for the Submission of an
Application to the New Jersey Cannabis Regulatory Commission which contains the required
information and documents to be provided to the Township.
Annexed hereto as Exhibit “B” is a copy an excerpt of the Township’s Municipal Code
containing the provisions that govern the: (i) Zoning and Lang Use requirements and conditions
for Licensed Cannabis Entities; and (ii) the procedures and requirements for application for a final
Local License from the Township. Please note that a Resolution of Local Support does not
constitute an approval of a final Local License. Any and all applicants will require a Local License
from the Township after it obtains a license from the New Jersey Cannabis Regulatory
Commission consistent with the requirements of the Township’s Municipal Code.
Section 1.1 Introduction and Background
Section 5-34.4(b) of the Township’s Municipal Code limits the total number of Local
Licenses to:
four (4) active Local Licenses irrespective of the categories of
Licensed Cannabis Entities, except that any Local License to a
Targeted Microbusiness shall not count towards the total number of
Local Licenses pursuant to his section
Based on the maximum number of Local Licenses allowed within the Township, the Township
will not issue more than four (4) Resolutions of Local Support, except for applicants with proposed
Targeted Microbusinesses. As a result, this RFA, limited to applicants seeking a resolution of
local support for proposed Cannabis Cultivation or proposed Cannabis Manufacturing, represents
the first round of solicitations for applications to fill one of the four (4) potential Resolutions of
Local Support to be issued by the Township.

During this round of applications, the Township may issue up to four (4) Resolutions of
Local Support. If the Township does not deem any of the applicants suitable for operation of a
Cannabis Business within the Township, the Township may determine that no Resolutions of
Local Support will be issued in this round of applications.
Section 1.2 Township Taskforce and Advisory Committee Regarding Cannabis Businesses
On July 13, 2021, the Township Council adopted Resolution 188-21 with established the
Taskforce and Advisory Committee Regarding Cannabis Business for the Township (the
“Committee”).
Applications submitted in response to this RFA will be provided to the Committee for
scoring and evaluation. As part of the scoring and evaluation, the Committee may schedule
interviews with applicants to discuss the application or any other information the Committee
deems relevant to the evaluation of the application.
The Committee shall generate a report to the Township Council with its recommendations
as to which, if any, applications should receive a Resolution of Local Support. The Township
Council may accept or reject the recommendations of the Committee and shall have the final
authority as to whether a Resolution of Local Support is to be issued.
Section 1.3 Evaluation Factors and Criteria
In evaluating the applications submitted in response to this RFA, the Committee will
examine and evaluate the overall quality of the proposed Cannabis Entity including the following
factors and criteria:
Business Plan:
The Committee will examine and evaluate the Applicants’: (i)
finances; (ii) market analysis; (iii) proposed management; and (iv) valuation propositions. The
Applicant must demonstrate that it has the financial resources to successfully operate the proposed
Cannabis Facility. The Applicant must also demonstrate that its projections and analysis provide
a likelihood of a financially viable business model for the long-term sustaining and operation of
the Cannabis Facility. In preparing its financial analysis, the Applicant must account for the 2%
transfer tax established pursuant to: (i) N.J.S.A. 40:48I-1(a)(2) of the New Jersey Cannabis
Regulatory, Enforcement Assistance, and Marketplace Modernization Act; and (ii) Chapter 22,
Section 3 of the Township Municipal Code.
Design and Facility Plan:
The Committee will examine and evaluate the Applicants’
proposed designs of the proposed Cannabis Facility and the proposed facility plan. The
Committee shall consider whether the proposed design meets the aesthetics of the surrounding
area, including proposed signage and lighting and whether the facilities plan presents a safe and
sanitary environment for employees and workforce. The Committee will also consider the quality
and effectiveness the Applicant’s proposed security measures to secure the Cannabis Facility
consistent with Chapter 5, Section 34.8(e) of the Township Municipal Code.

Regulatory Plan:
The Committee will examine and evaluate the Applicants’
proposed plan to comply with both State and Local statutes, regulations, and ordinances governing
the operation of the proposed Cannabis Facility. The Committee will consider the measures and
proposed measures set forth in the Applications to determine whether they provide a realistic and
effective means of insuring that all of the record-keeping, monitoring, security, and reporting
requirements are fulfilled, including, but not limited to, the reporting requirements for the Local
Transfer tax set forth in Chapter 22, Section 3(d) and Section 3(e) of the Township Municipal
Code.
Environmental Plan: The Committee will examine and evaluate the Applicants’
proposed plans to mitigate any potential negative environment impacts from the manufacturing
and cultivation activities performed. The Committee will view favorably certain proposed
measures, although such measures are not required, including: (i) hydroponic and/or aeroponic
method; and (ii) use of solar power or other alternative energy sources in the Applicant’s
operations.
Community-Workforce Plan: The Committee will examine and evaluate the Applicants’
proposed plans to staff its operations within the Township and its support of the overall
community where it proposed to operate. The Committee will consider and evaluate the proposed
staffing plans and how it seeks to employ local residents, individuals from socio-economically
disadvantaged communities and individuals who have been victimized by past policies related to
the criminalization of cannabis. The Committee will also consider and evaluate proposed
community investments, including investments in other projects or efforts within the Township
and educational outreach to members of the community.
Local Support / Community Support: The Committee will examine the Applicants’
community or organization letter of support to confirm that the Applicant has performed some
level of outreach to the members of the community, heard and considered any concerns, questions,
or issues raised.
Section 1.4 Application Fee
All applications must be submitted with a $500 application fee.

LICENSED CANNABIS ENTITY.
5-34.1 Purpose.
The purpose of this section is to establish the requirements for duly Licensed Cannabis Entities
operating within the Township. The provisions of this section are subject to the enabling authority
of the State of New Jersey and are subject to compliance with all statutes and/or regulations
adopted by the State of New Jersey or its instrumentalities. If any provisions of this Section are
inconsistent with the statutes and/or regulations of the State of New Jersey, the State statute and/or
regulation shall govern.
5-34.2 Definitions.
For the purpose of this section, the following words and phrases shall have the meanings
respectively ascribed to them by this section:
Alternative Treatment Center means an organization issued a permit pursuant to the Jake Honig
Compassionate Use Medical Cannabis Act, N.J.S.A. 24:6I-1, et. al. to operate as a Medical
Cannabis Cultivator, Medical Cannabis Manufacturer, Medical Cannabis Dispensary, or clinical
registrant, as well as any organization deemed to concurrently hold a Medical Cannabis Cultivator
permit, a Medical Cannabis Manufacturer permit, and a Medical Cannabis Dispensary permit or
as otherwise defined under the Jake Honig Compassionate Use Medical Cannabis Act, N.J.S.A.
24:6I-1, et. al.
Applicant means a Licensed Cannabis Entity applying to the Township for a Local License to
operate within the Township.
Cannabis shall have the same meaning as defined in the New Jersey Cannabis Regulatory,
Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq.
Cannabis Cultivator means any licensed person or entity who holds a Class 1 Cannabis Cultivator
license that grows, cultivates, or produces Cannabis in this State, and sells, and may transport, this
Cannabis to other cannabis cultivators, or usable cannabis to cannabis manufacturers, cannabis
wholesalers, or cannabis retailers, but not to consumers or as otherwise defined under the New
Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act,
N.J.S.A. 24:6I-31, et. seq.
Cannabis Delivery Service means any licensed person or entity who holds a Class 6 Cannabis
Delivery license that provides courier services for consumer purchases of cannabis items and
related supplies fulfilled by a cannabis retailer in order to make deliveries of the cannabis items
and related supplies to that consumer, and which services include the ability of a consumer to
purchase the cannabis items directly through the cannabis delivery service, which after presenting
the purchase order to the cannabis retailer for fulfillment, is delivered to that consumer or as
otherwise defined under the New Jersey Cannabis Regulatory, Enforcement Assistance, and
Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq.
Cannabis Distributor means any licensed person or entity who holds a Class 4 Cannabis
Distributor license that transports cannabis in bulk intrastate from one licensed cannabis cultivator
to another licensed cannabis cultivator, or transports cannabis items in bulk intrastate from any

one class of licensed cannabis establishment to another class of licensed cannabis establishment,
and may engage in the temporary storage of cannabis or cannabis items as necessary to carry out
transportation activities or as otherwise defined under the New Jersey Cannabis Regulatory,
Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq.
Cannabis Manufacturer means any licensed person or entity who holds a Class 2 Cannabis
Manufacturer license that processes cannabis items in this State by purchasing or otherwise
obtaining usable cannabis, manufacturing, preparing, and packaging cannabis items, and selling,
and optionally transporting, these items to other cannabis manufacturers, cannabis wholesalers, or
cannabis retailers, but not to consumers or as otherwise defined under the New Jersey Cannabis
Regulatory, Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et.
seq.
Cannabis Retailer means any licensed person or entity who holds a Class 5 Cannabis Retailer
license from the Commission or the State of New Jersey that purchases cannabis from cannabis
growers and cannabis items from cannabis processors or Cannabis Wholesalers and sells these
to consumers from a retail store or as otherwise defined under the New Jersey Cannabis
Regulatory, Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et.
seq.
Cannabis Wholesaler means any licensed person or entity who holds a Class 3 Cannabis
Wholesaler License from the Commission or the State of New Jersey that sells cannabis items
for the purpose of resale either to another cannabis wholesaler or to a cannabis retailer or as
otherwise defined under the New Jersey Cannabis Regulatory, Enforcement Assistance, and
Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq.
Commission shall mean the Cannabis Regulatory Commission established under the New Jersey
Department of Health and established pursuant to the Jake Honig Compassionate Use Medical
Cannabis Act, N.J.S.A. 24:6I-1, et. al. in, but not of, the New Jersey Department of Treasury.
Licensed Cannabis Entity shall mean either a Licensed Cannabis Establishment or a Licensed
Medical Marijuana Facility as defined in this section.
Licensed Cannabis Establishment shall mean a duly licensed Cannabis Cultivator, a Cannabis
Manufacturer, a Cannabis Wholesaler, or a Cannabis Retailer licensed under the New Jersey
Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A.
24:6I-31, et. seq.
Licensed Medical Marijuana Facility shall mean a duly licensed Medical Cannabis Cultivator,
a duly licensed Medical Cannabis Manufacturer, a duly licensed Cannabis Dispensary, or an
Alternative Treatment Center lawfully operating pursuant to the Jake Honig Compassionate Use
Medical Cannabis Act, N.J.S.A. 24:6I-1, et. al.
Local License shall mean a license granted by the Township of West Orange to operate a Licensed
Cannabis Entity within the Township.
Medical Cannabis Cultivator means an organization holding a permit issued by the Commission
that authorizes the organization to: possess and cultivate cannabis and deliver, transfer, transport,

distribute, supply, and sell medical cannabis and related supplies to other Medical Cannabis
Cultivators and to Medical Cannabis Manufacturers, clinical registrants, and Medical Cannabis
Dispensaries, as well as to plant, cultivate, grow, and harvest medical cannabis for research
purposes or as otherwise defined under the Jake Honig Compassionate Use Medical Cannabis
Act, N.J.S.A. 24:6I-1, et. al.
Medical Cannabis Dispensary means an organization issued a permit by the Commission that
authorizes the organization to: purchase or obtain medical cannabis and related supplies from
Medical Cannabis Cultivators; purchase or obtain medical cannabis products and related supplies
from Medical Cannabis Manufacturers; purchase or obtain medical cannabis, medical cannabis
products, and related supplies and paraphernalia from other Medical Cannabis Dispensaries and
from clinical registrants; deliver, transfer, transport, distribute, supply, and sell medical cannabis
and medical cannabis products to other medical cannabis dispensaries; furnish medical cannabis,
including medical cannabis products, to a medical cannabis handler for delivery to a registered
qualifying patient, designated caregiver, or institutional caregiver, and possess, display, deliver,
transfer, transport, distribute, supply, sell, and dispense medical cannabis, medical cannabis
products, paraphernalia, and related supplies to qualifying patients, designated caregivers, and
institutional caregivers or as otherwise defined under the Jake Honig Compassionate Use Medical
Cannabis Act, N.J.S.A. 24:6I-1, et. al.
Medical Cannabis Manufacturer means an organization issued a permit by the Commission that
authorizes the organization to: purchase or obtain medical cannabis and related supplies from a
Medical Cannabis Cultivator or a clinical registrant; purchase or obtain medical cannabis products
from another Medical Cannabis Manufacturer or a clinical registrant; produce, manufacture, or
otherwise create medical cannabis products; and possess, deliver, transfer, transport, distribute,
supply, and sell medical cannabis products and related supplies to other Medical Cannabis
Manufacturers and to Medical Cannabis Dispensaries and clinical or as otherwise defined under
the Jake Honig Compassionate Use Medical Cannabis Act, N.J.S.A. 24:6I-1, et. al.
Targeted Microbusiness means a Licensed Cannabis Entity located within the Township which
qualifies as a microbusiness pursuant to the definitions and qualifications as set forth in N.J.S.A.
24:6I-33 and N.J.S.A. 24:6I-36(f)(2) of the New Jersey Cannabis Regulatory, Enforcement
Assistance, and Marketplace Modernization Act and or any other requirements set forth therein.
5-34.3 Local License Required; Violations and Penalties.
Pursuant to N.J.S.A. 24:6I-45 (c)(2) of the New Jersey Cannabis Regulatory, Enforcement
Assistance, and Marketplace Modernization Act, no Licensed Cannabis Entity shall be allowed to
operate within the Township of West Orange until such person or entity shall be licensed and
registered in accord with this section. For violation of any provision of this subsection, penalties
shall be in accordance with Chapter 1, § 1-5.
5-34.4 Local License Standards and Limitations.
a. The Township may approve or deny an application for a Local License to operate a License
Cannabis Entity at its sole discretion, consistent with all governing State Law, based on an
evaluation of the benefits compared to the potential harm of the prospective licensee’s

operation of a Licensed Cannabis Entity as proposed in the prospective licensee’s
application for a Local License.
b. The number of Local Licenses shall be limited to a combined total of four (4) active Local
Licenses irrespective of the categories of Licensed Cannabis Entities, except that any Local
License to a Targeted Microbusiness shall not count towards the total number of Local
Licenses pursuant to his section.
5-34.5 Application for Local License and Local License Fee.
a. Applications for licensing pursuant to this section shall be submitted to the Office of the
Township Clerk under oath on a form furnished by the Township. Upon the filing of the
application, the Applicant shall pay to the Township an application fee in an amount to be
established by resolution of the Township Council. The Office of the Township Clerk shall
then transmit the application to the Office of Police Chief for the West Orange Police
Department or the Chief’s designee for review of the application. The Office of the
Township Clerk shall also provide a copy of the application to the: (i) Board of Education;
(ii) the Township Zoning Officer; (iii) the Health Department; and the (iv) Township Fire
Chief, except for the transmission of the requirements set forth in subsection (b)(4)(a) of
this provision. These departments shall review the application and forward their comments
to the Police Chief for the West Orange Police Department or the Chief’s designee no later
than fourteen (14) days from transmission of the application.
b. The application shall require submission of the following information:
1. The name and home address of the Applicant. If the Applicant is not a natural person,
the Applicant shall submit a statement setting forth the names and home addresses of
all stockholders in the corporation or partnership who own 10% or more of its stock,
of any class or of all individual partners in the partnership who own a 10% or greater
interest therein, as the case may be. If one or more such stockholder or partner is itself
a corporation or partnership, the stockholders holding 10% or more of that corporation's
stock, or the individual partners owning 10% or greater interest in that partnership, as
the case may be, shall also be listed with its home address. The disclosure shall be
continued until names and home addresses of every noncorporate stockholder, and
individual partner, exceeding the 10% ownership criteria has been listed.
2. The name of any other business entities in which any of the individuals identified
pursuant to subsection (b)(1) of this provision have or have had an ownership interest
which: (i) cultivates, manufactures, wholesales or dispenses cannabis or cannabis
products; (ii) invests or finances in any such entity; or (iii) is regulated by any
governmental entity.

3. A copy of the license issued by the Commission authorizing the Applicant to operate
as a Licensed Cannabis Entity with a copy of all application materials and documents
submitted to the Commission for a license.
4. Plans prepared by a duly licensed architect, engineer, or planner which shall depict the
layout and design for the proposed location of the Licensed Cannabis Entity within the
Township.
(a). The required plans shall depict the proposed security measures for the location in
order for the West Orange Police Department to evaluate the sufficiency of the security
measures as required under this section. The plans shall be deemed confidential and
shall only be transmitted to the Police Chief for the West Orange Police Department or
the Chief’s designee.
(b). The Applicant shall also provide either a lease agreement or agreement of sale for
the property where the Applicant intends to operate the Licensed Cannabis Entity. The
lease agreement or agreement of sale may be contingent upon the Applicant’s ability
to successfully: (i) obtain a Local License; and (ii) if applicable, obtain approval from
the West Orange Planning Board or the West Orange Zoning Board of Adjustment.
5. Acknowledgment and agreement authorizing the West Orange Police Department to
perform background checks and/or investigations regarding any individuals disclosed
pursuant to subsection (b)(1) of this provision and any employees of the Applicant.
6. If the Applicant is applying for a Local License as a Targeted Microbusiness, a copy of
any and all documents issued by the Commission declaring the Applicant as
microbusiness under the New Jersey Cannabis Regulatory, Enforcement Assistance,
and Marketplace Modernization Act with a copy of all application materials and
documents submitted to the Commission for such a declaration.
c. The Police Chief for the West Orange Police Department or the Chief’s designee shall
review the application, review the comments from the departments provided pursuant to
subsection (a) of this provision, and prepare a memorandum addressed to the Township
Council: (i) analyzing the Applicant’s ability to comply with all of the Township’s
requirements for a Licensed Cannabis Entity, including the required security measures; (ii)
assessing the benefits compared to the potential harm of the Applicant’s proposed
operation of a Licensed Cannabis Entity; and (iii) recommending whether to grant or deny
the application for a Local License. The Police Chief or the Chief’s designee shall transmit
the memorandum to the Office of the Township Clerk.
d. Within sixty (60) days from the transmission of the memorandum to the Office of the
Township Clerk, the Township Council shall adopt a resolution either granting the
application or denying the application. The Township Council’s failure to adopt a
resolution within the sixty (60) day period shall be deemed a denial of the application.
5-34.6 License Term and Transferability.

a. All licenses shall be issued for the term of one year(s) and shall expire one year(s) after
the date of issuance.
b. Licenses shall not be transferable, assignable, or divisible.
5-34.7 Commission Permit.
Any Licensed Cannabis Entity shall provide a copy of its permit issued by the Commission to the
Police Department and Health Department no later than thirty (30) days prior to the
commencement of any operations. A Licensed Cannabis Entity shall insure that a current permit
is on file with the Police Department and Health Department at all times. A copy of the current
permit issued by the Commission shall be posted within the Licensed Cannabis Entity at all times
at a location readily visible by any and all patrons of the facility.
5-34.8 Operating Requirements and Prohibitions.
a. A Licensed Cannabis Entity may only operate from the hours of 8:00 A.M. through 7:00 P.M.
b. No persons under the age of twenty-one (21) shall be allowed in a Licensed Cannabis
Establishment no person under the age of eighteen (18) shall be allowed in a Licensed Medical
Marijuana Facility.
c. The sale or consumption of alcohol at a Licensed Cannabis Entity shall be prohibited.
d. Cannabis Consumption Areas, as defined in the New Jersey Cannabis Regulatory, Enforcement
Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et. seq., shall be prohibited.
e. A Licensed Cannabis Entity shall be secured and have full-time security protocols in place
subject to review and approval from the West Orange Police Department which shall include at
least a twenty-four (24) hour security video system with footage to be kept for at least thirty (30)
days and a vault for storage of money when the Licensed Cannabis Entity is closed. Prior to the
commencement of any operations, a Licensed Cannabis Entity must first obtain from the Police
Chief, or designee, written approval of the Licensed Cannabis Entity’s security protocols. The
Police Chief, or designee, shall have to authority to require additional safety and security measures.
5-34.9 Inspections.
The Health Department, the Zoning Official, the Police Department, and the Fire Department shall,
from time to time, make an inspection of the Licensed Cannabis Entity for the purpose of
determining whether the provisions of this section are complied with. It shall be unlawful for any
Licensed Cannabis Entity to refuse to allow such inspection or to hinder such an inspection.
V.
CHAPTER 22, SECTION 3 SHALL BE AND HEREBY IS ESTABLISHED AND
SUPPLEMENTED TO INCORPORATE THE FOLLOWING:

a. Pursuant to N.J.S.A. 24A:6I-10(i) of the Jake Honig Compassionate Use Medical Cannabis
Act and N.J.S.A. 40:48I-1(a)(1) of the New Jersey Cannabis Regulatory, Enforcement
Assistance, and Marketplace Modernization Act, there is hereby established a Cannabis
Transfer Tax in the Township of West Orange which shall be fixed at a uniform percentage
rate of two percent (2%) on all sales or transfers of cannabis products from a Licensed
Cannabis Entity, as defined in Chapter 5, Section 34.2, except for sales or transfers of
cannabis products from a Cannabis Wholesaler which shall be taxed at a percentage rate of
one percent (1%) on all sales or transfers of cannabis products.
b. Pursuant to N.J.S.A. 40:48I-1(a)(2) of the New Jersey Cannabis Regulatory, Enforcement
Assistance, and Marketplace Modernization Act, there is hereby established a Cannabis
User Tax in the Township of West Orange at the same rates set forth in subsection (a)
which shall apply to any Licensed Cannabis Entity which holds concurrent licenses and
operating more than one cannabis establishment. This Cannabis User Tax shall apply to
the value of each transfer or use of cannabis or cannabis items not otherwise subject to the
Cannabis Transfer Tax from the Licensed Cannabis Entity’s establishments to any of the
other Licensed Cannabis Entity’s establishments either without or outside the Township of
West Orange.
c. The Cannabis Transfer Tax shall be in addition to any other tax or fee imposed pursuant to
statute, state and federal, or local ordinance or resolution by any government entity upon a
Licensed Cannabis Entity.
d. The tax imposed by this section shall be paid to the Township on a quarterly basis no later
than the fifteenth (15th) day of the month following the last month of the quarter along
with a report certified as true and accurate by the Chief Financial Officer, Controller or
other similarly situated person showing the gross revenues for the Licensed Cannabis
Entity for each month of the quarter.
e. The Licensed Cannabis Entity operating within the Township shall filed on an annual basis
no later than February 1 of each year a financial report from an independent accountant
certifying as to the annual revenues for the preceding year.
f. A copy of this section shall be transmitted to the State Treasurer and to every Licensed
Cannabis Entity within the Township of West Orange.
VI.
CHAPTER 25, SECTION 4 SHALL BE AND HEREBY IS AMENDED AND

DEFINITIONS
b. Specific Definitions.
Cannabis Retailer means any licensed person or entity who holds a Class 5 Cannabis Retailer
license from the Commission or the State of New Jersey that purchases cannabis from cannabis

growers and cannabis items from cannabis processors or Cannabis Wholesalers and sells these
to consumers from a retail store or as otherwise defined under the New Jersey Cannabis
Regulatory, Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et.
seq.
Licensed Cannabis Entity shall mean either a Licensed Cannabis Establishment or a Licensed
Medical Marijuana Facility as defined in this section.
Licensed Cannabis Establishment shall mean a duly licensed Cannabis Cultivator, a Cannabis
Manufacturer, a Cannabis Wholesaler, or a Cannabis Retailer as defined by and licensed under the
New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act,
N.J.S.A. 24:6I-31, et. seq.
Licensed Medical Marijuana Facility shall mean a duly licensed Medical Cannabis Cultivator, a
duly licensed Medical Cannabis Manufacturer, a duly licensed Cannabis Dispensary, or an
Alternative Treatment Center as defined by and lawfully operating pursuant to the Jake Honig
Compassionate Use Medical Cannabis Act, N.J.S.A. 24:6I-1, et. al.
Medical Cannabis Dispensary means an organization issued a permit by the Commission that
authorizes the organization to: purchase or obtain medical cannabis and related supplies from
Medical Cannabis Cultivators; purchase or obtain medical cannabis products and related supplies
from Medical Cannabis Manufacturers; purchase or obtain medical cannabis, medical cannabis
products, and related supplies and paraphernalia from other Medical Cannabis Dispensaries and
from clinical registrants; deliver, transfer, transport, distribute, supply, and sell medical cannabis
and medical cannabis products to other medical cannabis dispensaries; furnish medical cannabis,
including medical cannabis products, to a medical cannabis handler for delivery to a registered
qualifying patient, designated caregiver, or institutional caregiver, and possess, display, deliver,
transfer, transport, distribute, supply, sell, and dispense medical cannabis, medical cannabis
products, paraphernalia, and related supplies to qualifying patients, designated caregivers, and
institutional caregivers or as otherwise defined under the Jake Honig Compassionate Use Medical
Cannabis Act, N.J.S.A. 24:6I-1, et. al.
VII.
CHAPTER 25, SECTION 24.2 SHALL BE AND HEREBY IS AMENDED AND
SUPPLEMENTED TO INCORPORATE THE FOLLOWING:
25-24.2 Conditional Uses.
b. Specific Requirements. Subject to the stipulations, guiding principles and conditions contained
in this section, the Planning Board shall have the power to grant conditional uses authorized by
the Table of District Regulations, in specified districts, as follows:
2. Business and Industrial Districts.
(o) Licensed Cannabis Entities. Licensed Cannabis Retailers and Licensed Medical Cannabis
Dispensaries shall be permitted as a conditional use in the B-1, B-2, and I Districts. All other
Licensed Cannabis Entities shall be permitted as a conditional use in the I Districts. These
conditional uses shall be subject to the following conditions:

(1) The Licensed Cannabis Entity shall be required to have a Local License pursuant to
Chapter 5, Section 34 of the Township of West Orange Municipal Code.
(2) No Licensed Cannabis Entity shall be located within one hundred feet (100’) of any
school building owned and operated by the West Orange Board of Education.
(3) No Licensed Cannabis Entity shall be housed in a vehicle or any movable or mobile
structure.
(4) No Licensed Cannabis Entity shall be allowed to operate as a Home Occupation.
(5) Any signage for a Licensed Cannabis Entity shall be subject to the approval from either
the Planning Board or the Zoning Board of Adjustment.
(6) A Licensed Cannabis Entity shall meet of the required security measures as set forth in
Chapter 5, Section 34 of the Township of West Orange Municipal Code.
(7) Cannabis Consumption Areas, as defined in the New Jersey Cannabis Regulatory,
Enforcement Assistance, and Marketplace Modernization Act, N.J.S.A. 24:6I-31, et.
seq., shall be prohibited from all Licensed Cannabis Entities.
